19940531 Regular City Council Meeting - Minutes I I MINUTES OF THE ADJOURNED CITY COUNCIL MEETING OF THE CITY OF VERNON HELD MAY 31, 1994 AT 5 P.M. IN THE COUNCIL CHAMBERS OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA MEMBERS PRESENT: Malburg, Ybarra, Davis, Gonzales, McCormick MEMBERS ABSENT: None The meeting was called to order by Mayor Malburg. Minutes of the Adjourned Regular City Council Meeting held April 26, 1994. (Deferred from the City Council Meeting held May 17, 1994.) Minutes of the City council Meeting held May 3, 1994. (Deferred from the City council Meeting held May 17, 1994.) Minutes of the City council Meeting held May 17, 1994. It was moved by Ybarra, seconded by Davis, that the above listed minutes of the City Council Meetings be deferred to the next City Council Meeting. Motion carried. The City Clerk advised that now was the time for anyone in the audience to address the Council on any matter listed on the Agenda other than with regard to any Public Hearings that may be listed. The Mayor asked if anyone in the audience wished to address the Council on any item listed on the Agenda other than with regard to any Public Hearings that may be listed. There was no one in the audience who wished to address the Council at this time. Communication from Bruce V. Malkenhorst, Director of Finance, dated May 26, 1994, was presented, transmitting the Minutes of the Adjourned Finance Committee Meeting held May 23, 1994, for approval of the recommendations contained therein. It was moved by McCormick, seconded by Davis, that the Minutes of the Adjourned Finance Committee Meeting held May 23, 1994, be approved. Motion carried. The Mayor called a recess at 5:18 p.m. The Council reconvened in regular session at 5:20 p.m., all members present before the recess again being present. It was moved by Ybarra, seconded by McCormick, that the Council go into Closed Session to confer with legal counsel on Item No. 1 listed below. Motion carried. All persons were excluded from Closed Session with the exception of the City Clerk, City Attorney, Interim Director of Community Services, Chief Deputy City Clerk, and civil Engineer Kevin Wilson. The Mayor ordered all communications to and from Closed Session deemed privileged and confidential. The Mayor was excused at 5:21 p.m. and Mayor Pro Tem Ybarra assumed the Chair. 4900 I I ..... CONFERENCE WITH LEGAL COUNSEL-EXISTING LITIGATION Name of Cases: (a) SoCalGas v. Vernon, LASC No. BS 017468; (b) CPUC Docket No. A.91-03-39 (SoCaIGas); (c) Central Basin Municipal Water District v. City of Vernon, LASC No. BS 028717; (d) City of Vernon v. Central Basin Municipal Water District Board of Directors. et al., LASC No. BS 028742; (e) City of Anaheim. etc.. et ale V. city of Vernon, LASC No. BC 104302. The Interim Director of Community Services and civil Engineer Kevin Wilson were excused at 5:41 p.m. Chair. The Mayor returned at 5:47 p.m. and assumed the Councilman Davis was excused at 5:47 p.m. Councilman Davis returned at 5:49 p.m. It was moved by McCormick, seconded by Ybarra, that the Council go out of Closed Session and resume regular session, the time being 5:50 p.m. Motion carried. It was moved by Ybarra, seconded by McCormick, that the law firm of Richards, Watson & Gershon, be retained to represent the City with regards to litigation with Central Basin Municipal Water District, and that the City Administrator be authorized to execute a letter agreement. Motion carried. Mayor Malburg abstained from voting on this matter. It was moved by Gonzales, seconded by McCormick, that Mr. Joseph J. O'Malley, Attorney-at-Law, be retained to represent the City in the matter of City of Anaheim. etc.. et ale V. City of Vernon, LASC No. BC 104302. Motion carried. Councilman Davis abstained from voting and disqualified himself because it is reasonably foreseeable that the decision may have a material financial effect on his source of income.
