MINUTES OF THE ADJOURNED CITY COUNCIL
MEETING OF THE CITY OF VERNON HELD
AUGUST 25, 1994 AT 5 P.M. IN THE
COUNCIL CHAMBERS OF THE CITY HALL
LOCATED AT 4305 SANTA FE AVENUE,
VERNON, CALIFORNIA
MEMBERS PRESENT: Ybarra, McCormick, Gonzales, Davis
MEMBERS ABSENT: Malburg
The meeting was called to order by Chairman Pro Tem
Ybarra.
The City Clerk advised that the Minutes of the City
Council Meeting held August 16, 1994, should be deferred to the
next meeting.
It was moved by McCormick, seconded by Gonzales, that
the Minutes of the City Council Meeting held August 16, 1994, be
deferred to the next City Council Meeting. Motion carried.
It was moved by Gonzales, seconded by McCormick, that
the Minutes of the Adjourned City Council Meeting held August 23,
1994, be approved and filed. Motion carried.
The City Clerk announced that now was the time for
anyone in the audience to address the Council on any matter
listed on the agenda other than with regard to any Public
Hearings that may be listed.
There was no one who wished to address the Council at
this time.
Decision on the Appeal by Central Basin Municipal
Water District of the Acting Director of Community Services's
denial of their request for an Encroachment Permit for Rio Hondo
Water Reclamation Project Phase II.
There was a Court Reporter present to record the
proceedings with regard to the decision on the appeal by Central
Basin Municipal Water District.
The City Attorney indicated that he had prepared two
(2) resolutions supporting Findings of Fact and Conclusions of
Law, one granting the appeal and one denying the appeal.
It was moved by McCormick, seconded by Gonzales, to
deny the Appeal by Central Basin Municipal Water District of the
Acting Director of Community Services' denial of their request
for an Encroachment Permit for Rio Hondo Water Reclamation
Project Phase II. Motion carried.
David B. Brearley, City Attorney, addressed the
Council and discussed the procedures that should be followed
regarding the aforementioned matter.
RESOLUTION NO. 6503 - A Resolution of the City
Council of the City of Vernon Denying the Appeal of the Central
Basin Municipal Water District Heard by the City Council on
August 23, 1994, and Adopting Findings of Fact and Conclusions of
Law, was presented.
Mr. Brearley addressed the Council and advised that
the Resolution No. 6503 needs to be supported by "Findings of
Fact and Conclusions of Law." He further advised that he had
prepared Findings of Fact and Conclusions of Law which should be
reviewed by the City Council at this time.

The City Council deliberations were reported by a
Court Reporter and can be found on Pages 8-37 of the transcript
of the proceedings.
The Mayor Pro Tem called a recess at 6:07 p.m.
The Council reconvened in regular session at 6:29
p.m., all members present before the recess again being present.
It was moved by Davis, seconded by Gonzales, that
Resolution No. 6503 be approved and adopted. Motion carried.
There being no further business to come before the
Council at this time, it was moved by McCormick, seconded by
Gonzales, that the meeting adjourn to Tuesday, August 30, 1994 at
5 p.m. Motion carried.
