MINUTES OF THE ADJOURNED REGULAR CITY
COUNCIL MEETING OF THE CITY OF VERNON
HELD JULY 30, 1996 AT 5 P.M. IN THE
COUNCIL CHAMBERS OF THE CITY HALL
LOCATED AT 4305 SANTA FE AVENUE,
VERNON, CALIFORNIA

The meeting was called to order by Mayor Malburg.
It was moved by Ybarra, seconded by Davis, that the
Minutes of the Adjourned Regular City Council Meeting held July
9, 1996, be approved as submitted and adopted. Motion carried.
Communication from Bruce V. Malkenhorst, City Clerk,
dated July 11, 1996, was presented, advising that the below
listed employees have qualified in the month of June for a
Perfect Attendance Award. This is awarded to employees on the

The Mayor called a recess at 5:10 p.m.
The Council reconvened in regular session at 5:14
p.m., all members present before the recess again being present.
Communication from Bruce V. Malkenhorst, City Clerk,
dated July 24, 1996, was presented, advising that the Light and
Power Department is awarding Jesus Martinez, Water & Power
Dispatcher I, a 1996 SPIRITS LEVEL I Award based on his
outstanding job performance during the past year.
It was moved by Gonzales, seconded by Ybarra, that
the communication from the City Clerk dated July 24, 1996, be
received and filed. Motion carried.
Police Department Activity Log for the period July 1
thru 15, 1996, was presented.
It was moved by McCormick, seconded by Davis, that
the Police Department Activity Log for the period July 1 thru 15,
1996, be received and filed. Motion carried.
Fire Department Activity Report for the period July 1
thru 15, 1996, was presented.
It was moved by Ybarra, seconded by Gonzales, that
the Fire Department Activity Report for the period July 1 thru
15, 1996, be received and filed. Motion carried.
Health Department Report for the month of June, 1996,
was presented.
It was moved by Davis, seconded by McCormick, that
the Health Department Report for the month of June, 1996, be
received and filed. Motion carried.
Risk Management Report for the month of June, 1996,
was presented.
It was moved by Gonzales, seconded by Ybarra, that
the Risk Management Report for the month of June, 1996, be
received and filed. Motion carried.
The City Clerk announced that now was the time for
anyone in the audience to address the Council on any matter
listed on the Agenda other than with regard to any Public
Hearings that may be listed.
There was no one present who wished to address the
Council at this time.
The City Clerk advised the Council that the following
matter should be deferred to the next Council meeting.
Communication from James Kinetz, First Vice President
of CB Commercial Real Estate Group, Inc., dated May 22, 1996, on
behalf of Zacky Foods and L.A. Industrial Laundry concerning
property at 3300 Bandini Boulevard, and requesting authorization
for the transfer of certain sewage units from Vernon to
Montebello. (Deferred from the City Council Meeting held July 9,
1996.)
It was moved by Ybarra, seconded by Gonzales, that
the aforementioned matter be deferred to the next City Council
Meeting. Motion carried.

Communication from Police Chief Louis Rosenkrantz,
dated July 2, 1996, was presented, requesting authority and funds
for Sgt. Michael Chavez to attend the 1996 California Association
of Police Training Officers Conference in Indian Wells! August
20-23, 1996, with an expense allowance of $631.40.
It was moved by Ybarra, seconded by Davis, that
authority be granted for Sgt. Michael Chavez to attend the afore-
mentioned conference with an expense allowance of $631.40.
Motion carried.
Communication from Police Chief Louis Rosenkrantz,
dated July 11, 1996, was presented, requesting authority and
funds for Lt. Steven Towles, Sgt. James Rodino, and Officers
Christian Moscoso, Robert Osborne, Glen Finley and Charles Solano
to attend a tactical and training session at Laser Village II in
Los Angeles on August 13, 1996, with an expense allowance of
$107.20 each (of which POST will reimburse each officer the
entire amount) .
It was moved by McCormick, seconded by Gonzales, that
authority be granted for Lt. Steven Towles, Sgt. James Rodino,
and Officers Christian Moscoso, Robert Osborne, Glen Finley and
Charles Solano to attend the aforementioned training session with
an expense allowance of $107.20 each. Motion carried.
Communication from Police Chief Louis Rosenkrantz,
dated July 11, 1996, was presented, requesting authority and
funds for Theresa Nicholas, Assistant Records Manager, to attend
the California Law Enforcement Association Records Supervisors
Regional Training in Pismo Beach on July 19, 1996, with an
expense allowance of $226.50.
It was moved by Davis, seconded by Ybarra, that
authority be granted for Theresa Nicholas to attend the afore-
mentioned training with an expense allowance of $226.50. Motion
carried.
Communication from Police Chief Louis Rosenkrantz,
dated July 11, 1996, was presented, requesting authority and
funds for Sgt. Michael Chavez to attend the Beretta Armor School
in Gardena, August 5-7, 1996, with an expense allowance of
$67.50.
It was moved by Ybarra, seconded by Davis, that
authority be granted for Sgt. Michael Chavez to attend the afore-
mentioned school with an expense allowance of $67.50. Motion
carried.
Communication from Lewis J. Pozzebon, Director of
Environmental Health, dated July 15, 1996, was presented,
advising that the City of Vernon jail was inspected on June 4,
1996 in compliance with Section 459 of the Health and Safety Code
and transmitting the Inspection Report. The report advises that
the facility complies with standards and requirements prescribed
by the Board of Corrections regarding sanitary conditions and a
copy will be sent to the Board of Corrections.
It was moved by Gonzales, seconded by Ybarra, that
the communication from the Director of Environmental Health dated
July 15, 1996 and supporting documents be received and filed.
Motion carried.
Communication from Bruce V. Malkenhorst, City Clerk,
dated July 16, 1996, was presented, recommending that Mayor
Leonis C. Malburg and Mayor Pro Tem Thomas Ybarra be appointed
Voting Representative and Alternate Voting Representative to act

on the City's behalf during the upcoming League of California
Cities conference in October of this year.
It was moved by Davis, seconded by Gonzales, to
approve the above recommendation of the City Clerk. Motion
carried.
Communication from Bruce V. Malkenhorst, City Clerk,
dated July 16, 1996, was presented, advising of the results, as
listed below, of Bids received and opened July 11, 1996 in
accordance with Contract No. 531 (Revised), Vernon Avenue Sewer
Rehabilitation:

The bids have been reviewed by the Director of Community
Services, and it is hereby recommended that the bid be awarded to
Insituform Southwest on the basis of their bid in the amount of
$41,620.
It was moved by Gonzales, seconded by Davis, that the
communication from the City Clerk dated July 16, 1996, be
received and filed, and that his recommendation be approved.

RESOLUTION NO. 6819 - A Resolution of the City
Council of the City of Vernon Accepting the Bid of Insituform
Southwest for Vernon Avenue Sewer Rehabilitation in Accordance
with Contract No. 531 (Revised) of the City of Vernon and
Approving the Execution of Said Contract, was presented.
It was moved by Ybarra, seconded by McCormick, that
Resolution No. 6819 be approved and adopted. Motion carried.
Communication from Bruce V. Malkenhorst, City Clerk,
dated July 16, 1996, was presented, advising of the results, as
listed below, of Bids received and opened July 11, 1996 in
accordance with Contract No. 533, Various Streets Improvement:

received and filed, and that his recommendation be approved.

RESOLUTION NO. 6824 - A Resolution of the City
Council of the City of Vernon Accepting the Bid of Security
Paving Company for Various Streets Improvement in Accordance with
Contract No. 533 of the City of Vernon and Approving the
Execution of Said Contract, was presented.
It was moved by Gonzales, seconded by Ybarra, that
Resolution No. 6824 be approved and adopted. Motion carried.

Communication from Kevin Wilson, Director of
Community Services, dated July 16, 1996, was presented, advising
that Douglas Steel Supply Company has submitted Final Parcel Map
No. 24212 subdividing the property located at the northeast
corner of Alcoa and Slauson Avenues, and transmitting the
following documents:
1. Final Parcel Map No. 24212
2. Los Angeles County Public Works Acceptance Letter
3. Excerpts from the Subdivision Map Act
At the City Council meeting held January 23, 1996, the Revised
Tentative Parcel Map was approved with three "Conditions" one of
which, dedication of right-of-way, has been completed. A Letter
of Credit has been provided to the City to insure that the
remaining conditions (offsite improvements) will be completed.
The project is consistent with the Vernon General Plan and the
State Subdivision Map Act and is exempt from the California
Environmental Quality Act, and it is therefore recommended that
Final Parcel Map No. 24212 be approved.
It was moved by Davis, seconded by Gonzales, that the
communication from the Director of Community Services dated July
16, 1996 and all supporting documents be received and filed, and
that Final Parcel Map No. 24212 be approved. Motion carried.
Communication from Bruce V. Malkenhorst, City Clerk,
dated July 23, 1996, was presented, advising that in the vicinity
of 5403 Santa Fe Avenue, Vernon Family Partnership, L.P. owns
three parcels of land (Parcels A, B and C) and Southern Pacific
Transportation owns Parcel D. The parcels are described and
shown on the attached Exhibit "A". The owners have requested an
adjustment of the boundary line between the parcels which will
result in a portion of land 17 feet wide by 440.64 feet long
being transferred from the railroad property to the three
adjacent parcels as described on the attached Exhibits "A" and
"B". This has been reviewed by the Director of Community
Services, and it is hereby recommended that the Lot Line
Adjustment be approved.
It was moved by Ybarra, seconded by Gonzales, that
the communication from the City Clerk dated July 23, 1996, be
received and filed, and that his recommendation be approved.
Motion carried.
RESOLUTION NO. 6823 - A Resolution of the City
Council of the City of Vernon Approving a Lot Line Adjustment
requested by Vernon Family Partnership, L.P. and Southern Pacific
Transportation Company, was presented.
It was moved McCormick, seconded by Davis, that
Resolution No. 6823 be approved and adopted. Motion carried.
Communication from Fire Chief Dave Telford, dated
July 24, 1996, was presented, requesting authority and funds for
Captain Andrew Guth to attend the Continuing Challenge Haz Mat
Emergency Response Workshop in Sacramento, September 3-6, 1996,
with an expense allowance of $503.36.
It was moved by Gonzales, seconded by Davis, that
authority be granted for Fire Captain Andrew Guth to attend the
aforementioned workshop with an expense allowance of $503.36.

Communication from Lewis Pozzebon, Director of
Environmental Health, dated July 24, 1996, was presented,
requesting authority and funds for Environmental Health
Specialists Paul Manasjan and Elizabeth Quaranta to attend the
Continuing Challenge Haz Mat Emergency Response Workshop in
Sacramento, September 3-6, 1996, with an expense allowance of
$503.36 each.
It was moved by Ybarra, seconded by Gonzales, that
authority be granted for Paul Manasjan and Elizabeth Quaranta to
attend the aforementioned workshop with an expense allowance of
$503.36 each. Motion carried.
Communication from Bruce V. Malkenhorst, City Clerk,
dated July 24, 1996, was presented, advising that a Computation
Report has been compiled by Kenneth J. DeDario, Director of Light
and Power, determining the Energy Cost Adjustment Billing Factor
for the next three month period. Based on actual fuel expenses
and revenues for the previous period and Southern California
Edison Company's forecast of fuel cost for the next three months,
it is hereby recommended that the new factor of negative $0.02524
per kwh be adopted for all bills rendered from August 1, 1996.
It was moved by McCormick, seconded by Gonzales, that
the communication from the City Clerk dated July 24, 1996, be
received and filed, and that his recommendation be approved.

RESOLUTION NO. 6825 - A Resolution of the City
Council of the City of Vernon Changing the Energy Cost Adjustment
Billing Factor Charged for Electrical Energy Distributed and
Supplied to its Electrical Customers, was presented.
It was moved by Ybarra, seconded by Gonzales, that
Resolution No. 6825 be approved and adopted. Motion carried.
Communication from Police Chief Louis Rosenkrantz,
dated July 25, 1996, was presented, requesting authority and
funds for Police Officer Jason Bogosian to attend a Drug
Influence Course (H & S 11550) in Santa Ana, August 26-28, 1996,
with an expense allowance of $127.40 of which $86.40 will be
reimbursed by POST.
It was moved by Davis, seconded by McCormick, that
authority be granted for Officer Jason Bogosian to attend the
aforementioned course with an expense allowance of $127.40.
Motion carried.
Communication from Bruce V. Malkenhorst, Director of
Finance, dated July 25, 1996, was presented, transmitting the
Minutes of the Adjourned Regular Finance Committee Meeting held
July 11, 1996, for approval of the recommendations contained
therein.
It was moved by Gonzales, seconded by Davis, that the
Minutes of the Adjourned Regular Finance Committee Meeting held
July 11, 1996, be approved. Motion carried.
RESOLUTION NO. 6799 - A Resolution of the City
Council of the City of Vernon Approving and Authorizing the
Execution of an Agreement for Special Services (June 1, 1996 to
May 31, 1997) By and Between the City of Vernon and Liebert,
Cassidy & Frierson, A Professional Corporation, to Provide
Special Legal Services Pertaining to EmploYment Relations Matters
and for Participation By the City in the South Bay Employee
Relations Consortium Training Sessions, was presented.

Personnel, dated July 25, 1996, was presented, transmitting the
Agenda for the Adjourned Regular Personnel Committee Meeting to
be held July 29, 1996, for approval of the recommendations
contained therein.
It was moved by Gonzales, seconded by Davis, that the
recommendations contained in the Agenda for the Adjourned Regular
Personnel Committee Meeting held July 29, 1996, be approved.

presented during the period of July 4 thru July 25, 1996, drawn

It was moved by Ybarra, seconded by Gonzales, that

Councilman Davis abstained from voting and disqualified himself
because it is reasonably foreseeable that the decision may have a
material financial effect on his source of income.

Councilman Davis abstained from voting and disqualified himself

RESOLUTION NO. 6826 - A Resolution of the City
Council of the City of Vernon Approving and Authorizing the
Execution of a Settlement Agreement in the Litigation Entitled
City of South Gate, et al. vs. City of Los Anqeles, et al., LASC
No. BC 129447, Court of Appeal No. 2ND CIV No. B100019.
(Deferred from earlier in the meeting.)
It was moved by Ybarra, seconded by Gonzales, that
Resolution No. 6826 be approved and adopted. Motion carried.
RESOLUTION NO. 6827 - A Resolution of the City
Council of the City of Vernon Authorizing the City Administrator
to Cause to be Prepared and Mailed or Otherwise Distributed
Letters to Residents and Electors in the Central Basin Municipal
Water District Providing Information and Suggesting Action
Regarding the District's Proposed Standby Charge to be Imposed by
the District in February 1997, was presented.
It was moved by Ybarra, seconded by Gonzales, that
Resolution No. 6827 be approved and adopted. Motion carried.
Mayor Malburg abstained from voting on this matter.
It was moved by McCormick, seconded by Gonzales, that
the City Attorney be authorized to join in an Amicus Brief on
behalf of the City of Vernon in the matter of Homer J. Olsen,
Inc. v. City of San Jose and that the City Attorney be authorized
to execute the appropriate authorization form. Motion carried.
It was moved by Ybarra, seconded by Davis, that the
