MINUTES OF THE CITY COUNCIL MEETING OF
THE CITY OF VERNON HELD MAY 20, 1997 AT

The meeting was called to order by Mayor Malburg.
It was moved by Ybarra, seconded by Gonzales, that
the Minutes of the City Council Meeting held May 6, 1997, be
approved as submitted and adopted. Motion carried.
Communication from Bruce V. Malkenhorst, City Clerk,
dated May 13, 1997, was presented, advising that the below listed

1997, was presented.
It was moved by Gonzales, seconded by McCormick, that
the Health Department Report for the month of April, 1997, be
received and filed. Motion carried.
Risk Management Report for the month of April, 1997,
was presented.
It was moved by Davis, seconded by Ybarra, that the
Risk Management Report for the month of April, 1997, be received
and filed. Motion carried.
The City Clerk announced that now was the time for
anyone in the audience to address the City Council on any item
listed on the Agenda other than with regard to any Public
Hearings that may be listed.
The Mayor asked if there was anyone in the audience
who wished to address the City Council.
There was no one in the audience wishing to address
the City Council at this time.
ORDINANCE NO. 1046 - An Ordinance of the City Council
of the City of Vernon Granting a Franchise to Pacific Pipeline
System, Inc. to Install, Maintain and Operate a Pressurized Steel
Pipeline and Appurtenances In and Under Alameda Street in the
City of Vernon, California, was read by title by the City Clerk
for a Second and Final Reading.
It was moved by McCormick, seconded by Gonzales, that
Ordinance No. 1046 be approved and adopted. Motion carried.

Communication from Louis Rosenkrantz, Police Chief,
dated May 6, 1997, was presented, requesting authority and funds
to attend the California Association of Polygraph Examiners
Seminar in San Diego, June 20-21, 1997, with an expense allowance
of $486.76.
It was moved by Ybarra, seconded by Davis, that
authority be granted for Police Chief Louis Rosenkrantz to attend
the aforementioned seminar with an expense allowance of $486.76.
Motion carried.
Communication from Kevin Wilson, Director of
Community Services, dated May 6, 1997, was presented, requesting
authority and funds for Richard Lucas, Senior Building Inspector,
and Wenceslao Reynoso, Engineering Aide, to attend the
International Conference of Building Officials "Means of Egress"
Seminar in Alhambra on May 22, 1997, with an expense allowance of
$85 each.
It was moved by Gonzales, seconded by McCormick, that
authority be granted for Richard Lucas and Wenceslao Reynoso to
attend the aforementioned conference with an expense allowance of
$85 each. Motion carried.

May 15 and 29, and in Ontario on May 22, 1997, with an expense
allowance of $398.50.
It was moved by Davis, seconded by Ybarra, that
authority be granted for Carol Dacey to attend the aforementioned
seminars with an expense allowance of $398.50. Motion carried.

Community Services, dated May 12, 1997, was presented,
transmitting results, as listed below, of bids received and
opened May 6, 1997, in accordance with Contract No. 535, Traffic

It was moved by Ybarra, seconded by Gonzales, that
the communication from the Director of Community Services dated
May 12, 1997, be received and filed, and that his recommendation
be approved. Motion carried.
RESOLUTION NO. 6953 - A Resolution of the City
Council of the City of Vernon Accepting the Bid of C.T. & F.,
Inc. for Traffic Signal Modernization-Emergency Vehicle
Preemption in Accordance with Contract No. 535 of the City of
Vernon and Approving the Execution of Said Contract, was
presented.
It was moved by McCormick, seconded by Davis, that
Resolution No. 6953 be approved and adopted. Motion carried.

Communication from Leonis C. Malburg, Chief Executive
of the Direction and Control Group of the Emergency Operations
Center, dated May 14, 1997, was presented, transmitting for
review the Standardized Emergency Management System (SEMS) Multi-
Hazard Functional Plan which was approved by the Governor's
Office of Emergency Services, The plan is consistent with the
State Emergency Plan and federal guidance, and it is hereby
recommended that the plan be approved and adopted.
It was moved by Ybarra, seconded by Gonzales, that
the communication from the Chief Executive of the Direction and
Control Group of the Emergency Operations Center, dated May 14,
1997, be received and filed, and that his recommendation be
approved. Motion carried.
RESOLUTION NO. 6961 - A Resolution of the City
Council of the City of Vernon Approving and Adopting the
Standardized Emergency Management System (SEMS) "Multi-Hazard
Functional Plan," was presented.
It was moved by Davis, seconded by Gonzales, that
Resolution No. 6961 be approved and adopted. Motion carried.
Communication from Bruce V. Malkenhorst, City Clerk,
dated May 15, 1997, was presented, advising that the first floor
of City Hall (police station) has not yet been retrofitted to
comply with the Americans with Disabilities Act. Boyle
Engineering can provide architectural services to redesign the
restrooms, counters, etc. at a cost of $10,345. This has been
reviewed by the Director of Community Services, and it is hereby
recommended that the agreement with Boyle Engineering be amended
to provide said architectural services.
It was moved by Ybarra, seconded by McCormick, that
the communication from the City Clerk dated May 15, 1997, be
received and filed, and that his recommendation be approved.

RESOLUTION NO. 6960 - A Resolution of the City
Council of the City of Vernon Approving and Authorizing the
Execution of an Addendum to the Agreement for Professional
Services (City Office Addition) as Amended By and Between the
City of Vernon and Boyle Engineering Corporation Pertaining to
the Redesign of City Hall Facilities for ADA Compliance, was
presented.
It was moved by Gonzales, seconded by Davis, that
Resolution No. 6960 be approved and adopted. Motion carried.
Communication from Bruce V. Malkenhorst, City Clerk,
dated May 15, 1997, was presented, advising that Chapter 22A of
the Vernon City Code, which deals with subdivisions, needs to be
updated to comply with the Subdivision Map Act. An ordinance has
been prepared that sets forth procedures and regulations for
submitting, reviewing, and approving Tentative, Final, and Parcel
Maps. Also, Chapter 19, Railroads, should be consolidated into
Chapter 22, Streets and Sidewalks, with minor amendments
clarifying existing language. This has been reviewed by the
Director of Community Services and City Attorney, and it is
hereby recommended that the following ordinances be adopted
reflecting the changes.
It was moved by Gonzales, seconded by Ybarra, that
the communication from the City Clerk dated May 15, 1997, be
received and filed, and that his recommendation be approved.

ORDINANCE NO. 1048 - An Ordinance of the City Council
of the City of Vernon Amending the Code of the City of Vernon,
California, 1959, By Renumbering Certain Code Sections Pertaining
to the Subdivision Map Act in Chapter 22A and By Adding Chapter
28, Articles I Through VII, and Repealing All Ordinances or Parts
of Ordinances in Conflict Therewith, was read by title by the
City Clerk for a First Reading.
It was moved by McCormick, seconded by Ybarra, that
Ordinance No. 1048 be approved for a First Reading. Motion
carried.
ORDINANCE NO. 1049 - An Ordinance of the City Council
of the City of Vernon Amending Chapters 19 and 22 of the Code of
the City of Vernon to Consolidate, Amend and Reorganize
Provisions Pertaining to Streets, and Repealing All Ordinances or
Parts of Ordinances in Conflict Therewith, was read by title by
the City Clerk for a First Reading.
It was moved by Gonzales, seconded by Davis, that
Ordinance No. 1049 be approved for a First Reading. Motion
carried.
Communication from Bruce V. Malkenhorst, City Clerk,
dated May 15, 1997, was presented, advising that the City
Council, at their meeting held December 17, 1996, approved
entering into an Electrical Service Agreement with Clougherty
Packing Company. Since that time, staff has had many discussions
with the company about their future electrical requirements and
type of electrical service. At this time, both Clougherty and
Vernon have mutually agreed to terminate the agreement while
Clougherty continues to assess their future electrical needs.
This has been reviewed by the Director of Light and Power, and it
is hereby recommended that said agreement be terminated.
It was moved by Ybarra, seconded by Davis, that the
communication from the City Clerk, dated December 17, 1996, be
received and filed, and that his recommendation be approved.
Motion carried.
RESOLUTION NO. 6958 - A Resolution of the City
Council of the City of Vernon Agreeing to Mutually Terminate the
Electrical Service Agreement By and Between the City of Vernon
and Clougherty Packing Company, was presented.
It was moved by McCormick, seconded by Gonzales, that
Resolution No. 6958 be approved and adopted. Motion carried.
Communication from Bruce V. Malkenhorst, City Clerk,
dated May 15, 1997, was presented, advising that at the meeting
held April 8, 1997, the City Council approved a Water Right
License with pabco Paper Products to extract 800 acre-feet of
Pabco's allowed pumping allocation for the period July I, 1997
thru June 30, 1998 at a cost of $140 per acre-foot or $112,000
total. It has been determined that Pabco's water rights are in
the name of Pacific Coast Building Products, Inc., therefore the
pabco License must be cancelled and a new license prepared
reflecting the name change. This has been reviewed by the
Director of Community Services and the City Attorney, and it is
hereby recommended that a Water Right License with Pacific Coast
Building Products, Inc. be approved and executed.
It was moved by Ybarra, seconded by McCormick, that
the communication from the City Clerk dated May 15, 1997, be
received and filed, and that his recommendation be approved.

RESOLUTION NO. 6959 - A Resolution of the City
Council of the City of Vernon Approving and Authorizing the
Execution of a Water Right License By and Between the City of
Vernon and Pacific Coast Building Products, Inc. Which Grants the
City of Vernon a License to Extract 800 Acre-Feet of Pacific's
Allowed Pumping Allocation for the Period July 1, 1997 Through
June 30, 1998, and Rescinding Res.olution No. 6935, was presented.
It was moved by Davis, seconded by Gonzales, that
Resolution No. 6959 be approved and adopted. Motion carried.
The City Attorney advised the Council that the
following matter should be deferred to the next City Council
Meeting.
Communication from Bruce V. Malkenhorst, City Clerk,
dated May 15, 1997, advising that after extensive research of
public contracts law and procedures in the State of California,
an ordinance revising Vernon City Code Sections 2.24, 2.27, 2.28,
and 2.29 has been prepared. The ordinance increases the amounts
which distinguish between three categories of purchases or
contracts: (1) those not requiring bids, (2) those allowing
purchases on the open market pursuant to an informal bid
procedure, and (3) those requiring formal bid procedures.
Henceforth, purchases less than $1,000 will not require a bid.
The proposed revisions have been reviewed by the Community
Services Department and the Light and Power Department, and it is
hereby recommended that an ordinance amending the procedures for
purchasing and contracts be adopted.
ORDINANCE NO. 1047 - An Ordinance of the City Council
of the City of Vernon Amending the Procedure for the Award of
Contracts, and Repealing All Ordinances or Parts of Ordinances in
Conflict Therewith. (FIRST READING)
It was moved by Ybarra, seconded by Davis, to defer
the aforementioned matter to the next City Council Meeting.
Motion carried.
Communication from Bruce V. Malkenhorst, Director of
Finance, dated May 15, 1997, was presented, transmitting the
Minutes of the Finance Committee Meeting held May 13, 1997, for
approval of the recommendations contained therein.
It was moved by Ybarra, seconded by Gonzales, to
approve the Minutes of the Finance Committee Meeting held May 13,
1997. Motion carried.
RESOLUTION NO. 6955 - A Resolution of the City
Council of the City of Vernon Establishing Health Permit,
Hazardous Materials Establishment Permit, and Application Fees
for Permits Granted by the City of Vernon Pursuant to Sections
11.25, 13.7, 13.31, 13.53, 25.12, and 25.13-6 of the Vernon City
Code and Repealing Resolutions Nos. 6354, 6618, and 6619, was
presented.
It was moved by McCormick, seconded by Davis, that
Resolution No. 6955 be approved and adopted. Motion carried.
RESOLUTION NO. 6956 - A Resolution of the City
Council of the City of Vernon Approving and Authorizing the
Execution of an Amendment to Workers' Compensation Self-Insurance
Service Agreement By and Between the City of Vernon and Colen and
Lee, Inc. Providing for an Increase in Fees for the Adminis-
tration of a Workers' Compensation Self-Insurance Program, was
presented.

RESOLUTION NO. 6957 - A Resolution of the City
Council of the City of Vernon Approving and Authorizing the
Execution of an Amendment to Liability Self-Insurance Agreement
By and Between the City of Vernon and Colen and Lee, Inc, was
presented.
It was moved by McCormick, seconded by Davis, that
Resolution No. 6957 be approved and adopted. Motion carried.
Communication from Bruce V. Malkenhorst, Director of
Personnel, dated May 15, 1997, was presented, transmitting the
Agenda for the Personnel Committee Meeting to be held May 19,
1997, for approval of the recommendations contained therein.
It was moved by Gonzales, seconded by Ybarra, to
approve the recommendations contained in the Agenda for the
Personnel Committee Meeting held May 19, 1997. Motion carried.
Communication from Bruce V. Malkenhorst, Director of
Finance, dated May 15, 1997, was presented, transmitting the
Agenda for the Adjourned Finance Committee Meeting to be held May
19, 1997, for approval of the recommendations contained therein.

the recommendations contained in the Agenda for the Adjourned
Finance Committee Meeting held May 19, 1997. Motion carried.
WARRANT REGISTER NO. 963 covering claims and demands
presented during the period of May 2 thru May 15, 1997, drawn on
Wells Fargo Bank totaling $422,486.51, which includes Demand Nos.
61691 thru 61905 (inclusive), excluding Light and Power Demands
and Void Demand Nos. 61721, 61743 thru 61745 (inclusive) and
61804 (accounting period May, 1997), was examined and audited.
It was moved by Ybarra, seconded by McCormick, that
Warrant Register No. 963 be approved and payment authorized for
claims and demands totaling $422,486.51, excluding Light and
Power Demands. Motion carried.
WARRANT REGISTER NO. 963 covering claims and demands
presented during the period of May 2 thru May 15, 1997, drawn on
Wells Fargo Bank totaling $121,399.90, which includes Light and

It was moved by Gonzales, seconded by Ybarra, that
Warrant Register No. 963, including Light and Power Demands, be
approved and payment authorized for claims and demands totaling
$121,399.90. Motion carried. Councilman Davis abstained from
voting and disqualified himself because it is reasonably
foreseeable that the decision may have a material financial
effect on his source of income.
PAYROLL WARRANT REGISTER NO. 491 covering claims and
demands presented during the period of March 16 thru April 12,
1997, drawn on Wells Fargo Bank totaling $1,608,627.45, which
includes Demand Nos. 5224 thru 5264 (inclusive) (accounting
period April, 1997), was examined and audited.

It was moved by McCormick, seconded by Ybarra, that
Payroll Warrant Register No. 491 be approved and payment
authorized for claims and demands totaling $1,608,627.45. Motion
carried.
Communication from Bruce V. Malkenhorst, City Clerk,
dated May 12, 1997, was presented, advising that Police Captain
James Mason has filed an application with the Public Employees
Retirement System (PERS) for a disability retirement, and based
on the medical reports, it is hereby recommended that Captain
Mason's request be approved.
It was moved by Gonzales, seconded by Davis, that the
communication from the City Clerk dated May 12, 1997, be received
and filed, and that his recommendation be approved. Motion
carried.
RESOLUTION NO. 6951 - A Resolution of the City
Council of the City of Vernon Granting the Industrial Disability
Retirement of James E. Mason, a Local Safety Member Employed by
the City of Vernon (Government Code Sections 21154 and 21156),
was presented.
It was moved by Ybarra, seconded by McCormick, that
Resolution No. 6951 be approved and adopted. Motion carried.
Captain Mason addressed the City Council and spoke
briefly of his work history with the City and the Police
Department and his appreciation of the positive and professional
work environment that the City provides.
The Mayor called a recess at 5:52 p.m.
The Council reconvened at 6:07 p.m., all members
present before the recess again being present.

It was moved by Gonzales, seconded by Ybarra, to go
into Closed Session to confer on Item No. 1 listed below, the
time being 6:08 p.m. Motion carried.
All persons were excluded from the Closed Session
with the exception of the City Clerk, City Attorney, Chief Deputy
City Clerk, the Chief of Police, Director of Community Services,
the Police Officer, the Police Officer's attorney, and Eduardo
Olivo, legal associate from the City Attorney's office.
The Mayor ordered that all communications to and from
the Closed Session be deemed privileged and confidential.

It was moved by McCormick, seconded by Ybarra, that
the Council go out of Closed Session and resume regular session,
the time being 6:47 p.m. Motion carried.
It was moved by Gonzales, seconded by Ybarra, that
the Utilityman be disciplined as recommended. Motion carried.
It was moved by Ybarra, seconded by Gonzales, to deny
the Liability Claim of Easton R. Roberts, Miriam H. Roberts,
Easton R. Roberts, Trustee of the E & M Roberts Revocable Trust
and Commercial Process Company. Motion carried.
It was moved by Ybarra, seconded by Gonzales, to deny
the Liability Claim of Scottsdale Insurance Company. Motion
carried.
It was moved by Gonzales, seconded by Davis, to
accept the "Release of All Claims" executed by Anuilani Liua and
approve settlement in the amount of $76.29. Motion carried.
There being no further business to come before the
Council at this time, it was moved by McCormick, seconded by
Ybarra, that the meeting adjourn. Motion carried.
