20000822 Regular City Council Meeting - MinutesMINUTES OF THE ADJOURNED REGULAR CITY COUNCIL MEETING OF THE CITY OF VERNON HELD AUGUST 22, 2000 AT 5:00 P.M. IN THE COUNCIL CHAMBERS OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA MEMBERS PRESENT: Malburg, Ybarra, Gonzales, McCormick, Davis MEMBERS ABSENT: None The meeting was called to order by Mayor Malburg. It was moved by Gonzales, seconded by Ybarra, that the Minutes of the City Council Meeting held August 8, 2000, be approved as submitted and adopted. Motion carried. Communication from Bruce V. Malkenhorst, City Clerk, dated August 16, 2000, was presented, advising that the below listed employees have qualified in the month of July for a Perfect Attendance Award. Police Department Activity Log for the period August is' thru 15th, 2000, was presented. It was moved by McCormick, seconded by Davis, that the Police Department Activity Log for the period August 1st thru 15th, 2000, be received and filed. Motion carried. Fire Department Activity Report for the period August lst thru 15th, 2000, was presented. Adjourned City Council Minutes August 22, 2000 It was moved by Ybarra, seconded by Gonzales, that the Fire Department Activity Report for the period August 1st thru 151h, 2000 be received and filed. Motion carried. Health Department Report for the month of July, 2000, was presented. It was moved by Davis, seconded by McCormick, that the Health Department Report for the month of July, 2000 be received and filed. Motion carried. Risk Management Report for the month of July, 2000, was presented. It was moved by Gonzales, seconded by Ybarra, that the Risk Management Report for the month of July, 2000 be received and filed. Motion carried. The City Clerk advised that now was the time for anyone in the audience to address the City Council on any item on the Agenda other than with regard to any Public Hearings that may be listed. The Mayor asked if there was anyone in the audience who would like to address the City Council. There was no one wishing to address the City Council. PUBLIC HEARING to consider a variance application from World Wide Drapery Fabric, Inc. for the property located at 3113 26th Street. It was moved by Davis, seconded by Gonzales, to open the Public Hearing to consider a request from World Wide Drapery Fabric, Inc. for a variance, the time being 5:13 p.m. Motion carried. Samuel K. Wilson, Director of Community Services and Water Department, addressed the City Council and summarized his report and gave a brief slide presentation. Communication from Bruce V. Malkenhorst, City Clerk, dated August 16, 2000, was presented, advising that World Wide Drapery Fabric, Inc. has requested a variance from the Comprehensive zoning Ordinance Section 26.4.2-8(c), Development Standards for the property located at 3113 26th Street in the City of Vernon. The variance is to allow the use of eight (8) non -conforming truck loading spaces. All the loading spaces will be restricted to trucks that do not extend into the public right-of-way. Submitted herewith are the following documents: 1. Staff report. 2. Application for variance. Page 2 of 13 Adjourned City Council Minutes August 22, 2000 3. Notice of Public Hearing, copies of notification letters to owners and tenants in the area and affidavits of posting and mailing. It is hereby recommended that the variance be granted with the following conditions: a) The applicant shall maintain the fifty (50) foot loading dock on the property free, clear, and accessible for longer trucks to utilize. b) The usage of the non -conforming truck loading spaces shall be limited so that any truck parked at or using the loading docks does not extend into the street right-of-way as shown on the Master Plan of Streets, dated June 16, 1992. c) The owner of the property shall provide and maintain for the City of Vernon utility easements for the existing power lines on the east end of property and for the electrical substation on the roof of the building located on the owners property in d) a form and manner subject to approval of the Director of Community Services and Water. e) This variance shall only be valid while World Wide occupies the property. A new variance will be required upon change of occupancy or ownership. f) All existing and future tenants shall be notified of these restrictions and a condition stating this shall be placed in all future leases. g) This variance shall automatically expire at the time of any expansion or structural alteration of the building, or on August 19, 2009, whichever occurs first. At that time the use of the parking, access, or loading area(s) allowed by this variance shall be discontinued unless brought into compliance with all applicable standards for parking, access, and loading areas set forth in the Comprehensive Zoning Ordinance. It is the intent of the City Council that said parking, access or loading area(s) be treated in the same manner as a legal nonconforming use subject to Section 26.4.E-4(b). Councilman Davis asked, "how old is the building?" The Director of Community Services and Water responded, "it might be about 50 to 60 years old." The City Clerk asked, "with regard to the non- conforming trucks where will the trucks be maneuvering" The Director of Community Services and Water responded that they will use the street until the year 2009 when full compliance is required. The Mayor asked, "what are we going to be doing in 2009? Will they have to divide up the building in order to comply? Page 3 of 13 Adjourned City Council Minutes August 22, 2000 The Director of Community Services and Water responded "the lot appears to have sufficient space to allow for parking, but if it doesn't, part of the building might have to be removed in order to provide for parking or parking will have to be provided within 1000 ft. of the property." The City Clerk asked, "what kind of traffic do you have on 26th Street now?" The Director of Community Services and Water advised that right now it is heavily used during peak periods. The City Clerk asked, "with the re -construction of 261h Street the traffic is only going to get worse. Can we restrict them to only certain times of the day to maneuver on the streets?" The Director of Community Services and Water responded "that is an option that we could consider." The Mayor asked, "what if they only used smaller trucks?" The Director of Community Services and Water stated, "the code allows us to consider granting a variance for hardships, however it is our goal to require all maneuvering on site." Councilman Davis, asked, "how far are the docks from the sidewalk?" The Director of Community Services and Water replied that they were about 25 to 30 feet from the sidewalk. The Mayor asked if anyone in the audience had any questions? It was moved by Gonzales, seconded by McCormick, to continue the Public Hearing for a request for a variance for World Wide Drapery Fabric, Inc., to the first meeting in September. Motion carried. RESOLUTION NO. 7600 - A Resolution Of The City Council Of The City Of Vernon Granting A Variance To World Wide Drapery Fabric, Inc. From Section 26.4.2-8(C), Development Standards, Of The Comprehensive zoning Ordinance, For The Property Located At 3113 26th Street In The City Of Vernon. It was moved by McCormick, seconded by Ybarra, that Resolution No. 7600 be deferred to the first meeting in September. Motion carried. PUBLIC HEARING to consider establishing Vernon's Transmission Revenue Requirements (TRR) for its high voltage transmission facilities and entitlements for the purpose of becoming a Participating Transmission Owner (PTO) with the California Independent System Operator (ISO). Page 4 of 13 Adjourned City Council Minutes August 22, 2000 It was moved by McCormick, seconded by Gonzales, to open the Public Hearing to consider establishing Vernon's Transmission Revenue Requirements, the time being 5:27 p.m. Motion carried. Communication from Bruce V. Malkenhorst, City Clerk, dated August 17, 2000, advising that in accordance with AB1890, the ISO filed a Transmission Access Charge tariff with the Federal Energy Regulatory Commission (FERC) on March 31, 2000. The tariff provides a process for a utility to become a PTO with the ISO. The City retained the services of Fred Saffer & Associates, Inc. to assist in preparing and recommending a TRR to be filed with the FERC as part of the application process to become a PTO. It is hereby recommended that the TRR be approved RESOLUTION NO. 7608 - A Resolution Of The City Council Of The City Of Vernon Establishing The Transmission Revenue Requirements Associated With Vernon's High Voltage (Over 200 kV) Transmission Facilities And Entitlements (All Located Outside The City) For The Purpose Of Becoming A Participating Transmission Owner With The California Independent System Operator. It was moved by Davis, seconded by Ybarra, that the aforementioned Public Hearing and Resolution No. 7608 be continued to August 29, 2000. Motion carried. Communication from Bruce V. Malkenhorst, City Clerk, dated August 3, 2000, was presented, transmitting for review and discussion, a letter dated July 11, 2000 from the County Sanitation Districts of Los Angeles County for support of the State Water Resources Control Boards (SWRCB) draft environmental impact report and general order covering general waste discharge requirements for biosolids land application. (Deferred from the City Council Meeting held August 8, 2000) Samuel K. Wilson, Director of Community Services and Water, addressed the City Council and gave them a brief report. Councilman Hilario Gonzales, "how long will it be before this company will decide whether they will locate in Vernon?" Samuel K. Wilson, Director of Community Services and Water advised that to his knowledge there is no date yet, but that he did know the company has met with the Sanitation District to discuss the issue of biosolids. It was moved by McCormick, seconded by Davis, that the aforementioned communication be received and filed. The Mayor abstained. Motion carried. RESOLUTION NO. 7599 - A Resolution Of The City Council Of The City Of Vernon Supporting The State Water Resources Control Board General Order Covering General Waste Discharge Requirements For Biosolids Land Application. Page 5 of 13 Adjourned City Council Minutes August 22, 2000 The above resolution was removed from the agenda and no further action was taken. Communication from S. Kevin Wilson, Director of Community Services and Water, dated August 14, 2000, was presented, advising that Traffic Signal Maintenance Contract No. 443, with Signal Maintenance, Inc. expires August 31, 2000. The contract provides for extension by mutual agreement under the Section Contract Extension of the Special Provisions. Signal Maintenance, Inc. has indicated that they would like to continue under the present contract. Under the Compensation Section of the Special Provisions they are eligible for a Consumer Price Index (CPI) increase in the contract. This would be 75% of the CPI as published September 2000. The last CPI adjustment for Signal Maintenance, Inc. was September, 1991. Going back to this date the CPI adjustment would be 20%. Signal Maintenance is only requesting a 5% increase in the monthly rate and the labor rate, leaving the equipment at the existing rate. This would be an increase of the present monthly contract from $2,291.78 to $2,406.37. It is hereby recommended that the contract be extended to August 31, 2001. It was moved by Ybarra, seconded by Gonzales, that the aforementioned communication from the City Clerk dated August 14, 2000, be received and filed and his recommendation approved. Motion carried. RESOLUTION NO. 7609 - A Resolution Of The City Council Of The City Of Vernon Approving And Authorizing The Execution Of A One Year Extension Of Contract No. 443 (2000/2001) By And Between The City Of Vernon And Signal Maintenance, Inc, was presented. It was moved by McCormick, seconded by Davis, that Resolution No. 7609 be approved and adopted. Motion carried. Communication from Bruce V. Malkenhorst, City Clerk, dated August 15, 2000, was presented, was presented, advising that the City is required to update its Housing Element by December 31, 2000. Submitted herewith is a proposal from Cotton/Beland/Associates (CBA) to prepare the 2000-2005 Housing Element for the City. CBA previously prepared the City's General Plan and Housing Element, and prepared a draft Housing Element update in 1996. This has been reviewed by the Director of Community Services and Water and City Attorney, and it hereby recommended that CBA be retained at a cost not to exceed $14,330.00, an Agreement be approved and executed, and a Resolution adopted. It was moved by Gonzales, seconded by Ybarra, that the aforementioned communication from the City Clerk dated August 15, 2000 be received and filed and his recommendation approved. Motion carried. Page 6 of 13 Adjourned City Council Minutes August 22, 2000 RESOLUTION NO. 7603 - A Resolution Of The City Council Of The City Of Vernon Approving And Authorizing The Execution Of A Consulting Services Agreement For 2000 General Plan Housing Element By And Between The City Of Vernon And Cotton/Beland/Associates, Inc, was presented. It was moved by Davis, seconded by McCormick, that Resolution No. 7603 be approved and adopted. Motion carried. Communication from Bruce V. Malkenhorst, City Clerk, dated August 15, 2000, was presented, advising that Ricardo Villanueva, Trustee of the Ricardo Villanueva Revocable Living Trust, is the owner of two adjoining parcels of land located at 5151 Heliotrope Avenue and 4731 52nd Drive. Mr. Villanueva has requested an adjustment of the boundary lines between the parcels. The boundary line adjustment will result in a portion of land being transferred from the westerly parcel to the easterly parcel. It is hereby recommended that the requested lot line adjustment be granted. It was moved by Gonzales, seconded by McCormick, that the aforementioned communication from the City Clerk dated August 15, 2000 be received and filed and his recommendation approved. Motion carried. RESOLUTION NO. 7601 - A Resolution Of The City Council Of The City Of Vernon Approving A Lot Line Adjustment Requested By Ricardo Villanueva, Trustee Of The Ricardo Villanueva Revocable Living Trust, was presented. It was moved by Ybarra, seconded by Davis, that Resolution No. 7601 be approved and adopted. Motion carried. Communication from Bruce V. Malkenhorst, City Clerk, dated August 16, 2000, was presented, advising that the Finance Committee at their meeting held August 7, 2000 recommended that certain property in various departments be declared surplus due to their being damaged, obsolete or in poor condition. This was subsequently approved by City Council on August 8, 2000 and it is hereby recommended that the following resolution be approved and adopted. It was moved by McCormick, seconded by Gonzales, that the aforementioned communication from the City Clerk dated August 16, 2000 be received and filed and his recommendation approved. Motion carried. RESOLUTION NO. 7602 - A Resolution Of The City Council Of The City Of Vernon Authorizing The Sale Of Surplus Property From The Following Departments: City Administrator/City Clerk (Finance), Community Services & Water (Warehouse), Fire And Police, Pursuant To Section 2.31 Of The Vernon City Code, was presented. It was moved by Gonzales, seconded by Ybarra, that Resolution No. 7602 be approved and adopted. Motion carried. Page 7 of 13 Adjourned City Council Minutes August 22, 2000 Communication from Bruce V. Malkenhorst, City Clerk, dated August 17, 2000, was presented, transmitting an updated City of Vernon Records Retention Schedule. The current retention schedule was previously approved in 1992 with no subsequent updates. The updated schedule will assist in keeping with local government records retention requirements and maintaining the City's records destruction program. This has been reviewed by the City Attorney, and it is hereby recommended that the City of Vernon Records Retention Schedule 2000 be approved. The Mayor asked if the records to be destroyed were microfilmed first before destruction. The Chief Deputy City Clerk advised, no, that the records were just destroyed in accordance with the retention schedule. It was moved by Ybarra, seconded by Davis, that the aforementioned communication from the City Clerk dated August 17, 2000 be received and filed and his recommendation approved. Motion carried. RESOLUTION NO. 7605 - A Resolution Of The City Council Of The City Of Vernon Approving And Adopting A City Of Vernon Records Retention Schedule 2000 For Maintaining Documents And Records By All City Departments Except The Police Department, was presented. It was moved by Gonzales, seconded by McCormick, that Resolution No. 7605 be approved and adopted. Motion carried. Communication from Bruce V. Malkenhorst, City Clerk, dated August 17, 2000, was presented, transmitting lists of records from the City Clerk's Office, Finance Department, Customer Service Division, and Risk Management/Personnel Division. In accordance with the City's Records Retention Schedule, the listed records are authorized for destruction. This has been reviewed by the City Attorney, and it is hereby recommended that the attached lists of records be approved for destruction. It was moved by Ybarra, seconded by Davis, that the aforementioned communication from the City Clerk dated August 17, 2000 be received and filed and his recommendation approved. Motion carried. RESOLUTION NO. 7606 - A Resolution Of The City Council Of The City Of Vernon Authorizing The Destruction Of Certain City Records, Documents, Instructions, Books And Papers, Pursuant To Government Code Section 34090, was presented. It was moved by Gonzales, seconded by Ybarra, that authority and funds be granted to Gerald Chavez to attend the Lewellyn Technology Seminar with an expense allowance of $669.00. Motion carried. Communication from Richard Wiles, Battalion Chief, dated August 3, 2000, was presented, requesting authority and funds for Greg Galvan, Firefighter, to attend the Hazmat Continuing Challenge at Sacramento on September 5th thru 8tn 2000, with an expense allowance of $830.40. Malkenhorst, Director of Finance, dated August 17, 2000, was presented, transmitting the Agenda for the Adjourned Finance Committee meeting to be held August 22, 2000 for approval of the recommendations contained therein. It was moved by Ybarra, seconded by Davis, that the recommendations on the August 22, 2000 Adjourned Regular Finance Committee Meeting Agenda be approved. Motion carried. Communication from Bruce V. Malkenhorst, City Clerk, dated August 15, 2000, was presented, advising that In accordance with the Fourth Side Letter Agreement dated September 3, 1997, By and Between the Vernon Police Officers' Benefit Association and the Municipal Employee Relations Representative (MERR") of the City of Vernon, it is hereby recommended that the Vernon Police Officers in Group 2 be granted a salary adjustment of 3.25% and that the court pay appearances and court stand-by status receive a 3.3% adjustment. If approval is granted it shall be effective September 1, 2000. RESOLUTION NO. 7607 - A Resolution Of The City Council Of The City Of Vernon Amending Resolution No. 6048 Which Set The Time And Place For Regular Meetings Of Committees And Commissions Of The City Of Vernon, was presented.
