20001003 Regular City Council Meeting - MinutesMINUTES OF THE CITY COUNCIL MEETING OF THE CITY OF VERNON HELD OCTOBER 3, 2000 AT AT 5:00 P.M. IN THE COUNCIL CHAMBERS OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA MEMBERS PRESENT: Malburg, Ybarra, Gonzales, McCormick, Davis MEMBERS ABSENT: None The meeting was called to order by Mayor Malburg. It was moved by Ybarra, seconded by Davis, that the Minutes of the City Council Meetings held August 29th and September 5th, 2000 be approved as submitted and adopted. Motion carried. It was moved by Gonzales, seconded by McCormick, that the Minutes of the City Council Meeting held September 19th, and the Adjourned Meeting held September 26th, 2000 be approved as submitted and adopted. Motion carried. The City Clerk announced that now was the time to present the Service Pins. The Mayor presented Service Pins to the following employees and extended congratulations on behalf of the entire City Council. Bruce V. David Zapien Police Officer 15 yrs Daniel Santos Police Officer 5 yrs The Mayor called a short recess at 5:06 p.m. The City Council reconvened at 5:09 p.m., all members present before the recess again being present. Police Department Activity Log for the period September 16th thru 30th, 2000, was presented. It was moved by McCormick, seconded by Davis, that the Police Department Activity Log for the period September 16th thru the 30th, 2000, be received and filed. Motion carried. Fire Department Activity Report for the period September 16th thru 30th, 2000, was presented. It was moved by Ybarra, seconded by Gonzales, that the Fire Department Activity Report for the period September 16th thru the 30th, 2000, be received and filed. Motion carried. City Council Minutes October 3, 2000 The City Clerk announced that now was the time for anyone in the audience to address the City Council on any item on the Agenda other than with regard to any Public Hearings that may be listed. The Mayor asked if there was anyone wishing to address the City Council at this time. There was no one wishing to address the City Council at this time. Communication from Bruce Olson, Police Chief, dated September 5, 2000, was presented, requesting authority and funds for Roberto Sousa, Police Detective, to attend the Institute of Criminal Investigation Core Course at San Diego on October 16th thru 27th, 2000, with an expense allowance of $1,413.40 of which POST will reimburse $1,103.20. It was moved by Gonzales, seconded by Ybarra, that authority and funds be granted for Roberto Sousa to attend the aforementioned course with an expense allowance of $1,413.40. Motion carried. Communication from Samuel Kevin Wilson, Director of Community Services and Water, dated September 25, 2000, was presented, requesting authority and funds for himself to attend the Tenth Annual "Avoiding Contractor Claims on Public Works Projects" Seminar at Ontario on October 12th, 2000, with an expense allowance of $225.00. It was moved by McCormick, seconded by Davis, that authority and funds be granted for Samuel Kevin Wilson to attend the aforementioned seminar with an expense allowance of $225.00. Motion carried. Communication from Mark Whitworth, Battalion Chief, dated September 26, 2000, was presented, requesting authority and funds for the following fire personnel to attend the Confined Space Rescue Operational Train the Trainer Seminar at Anaheim on October 2"d, thru 6th, 2000, with an expense allowance of $325.00 each. • Bryan Dome, Firefighter • Ryan Fogg, Firefighter • Jed Hulsey, Fire Captain • Todd Painton, Fire Engineer It was moved by Ybarra, seconded by Davis, that authority and funds be granted to the above listed Fire Personnel to attend the above listed seminar with an expense allowance of $325.00 each. Motion carried. Communication from Bruce V. Malkenhorst, City Clerk/ City Administrator, dated September 27, 2000, was presented, requesting authority and funds for himself to attend the National League of Cities Conference at Boston, Massachusetts on December 6th, to 9th, 2000, with an expense allowance of $2,579.77. Malkenhorst to attend the National League of Cities Conference with an expense allowance of $2,579.77. Motion carried. Communication from Bruce V. Malkenhorst, City Clerk/ City Administrator, dated September 27, 2000, was presented, requesting authority and funds for the Council Members listed below to attend the National League of Cities Conference at Boston, Massachusetts on December 6th, thru 9th, 2000, with an expense allowance of $1,100.00 each. • Hilario Gonzales • William Davis It was moved by Ybarra, seconded by Davis, that authority and funds be granted to the above listed City Officials to attend the National League of Cities conference with an expense allowance of $1,100.00 each. Communication from Bruce V. Malkenhorst, City Clerk/ City Administrator, dated September 27, 2000, was presented, requesting authority and funds for himself to attend the California Public Employer Labor Relations Association's 25th Annual Training Conference at Monterey on November 15th, thru 17th, 2000, with an expense allowance of $1,058.00. It was moved by Gonzales, seconded by McCormick, that authority and funds be granted to Bruce V. Malkenhorst to attend the aforementioned conference with an expense allowance of $1,058.00. Motion carried. Communication from Samuel Kevin Wilson, Director of Community Services and Water, dated September 27, 2000, was presented, requesting authority and funds for Wenceslao Reynoso, Code Enforcement Inspector, to attend the California Building Officials Training Institute Education Week 2000 Conference at Ontario on October 16th 18th and 19th, 2000, with an expense allowance of $435,00. It was moved by Ybarra, seconded by Davis, that authority and funds be granted for Wenceslao Reynoso to attend the aforementioned conference with an expense allowance of $435.00. Motion carried. Communication from Samuel Kevin Wilson, Director of Community Services and Water, dated September 27, 2000, was presented, requesting authority and funds for Leo Lee, Code Enforcement Inspector, to attend the California Building Officials Training Institute Education Week 2000 Conference at Ontario on October 16th and 17th, 2000, with an expense allowance of $290.00. It was moved by Davis, seconded by McCormick, that authority and funds be granted for Leo Lee to attend the aforementioned conference with an expense allowance of $290.00. Motion carried. Page 3 of 8 City Council Minutes October 3, 2000 Communication from Samuel Kevin Wilson, Director of Community Services and Water, dated September 27, 2000, was presented, requesting authority and funds for Jerry Schreiber, Senior Electrical Inspector, to attend the California Building Officials Training Institute Education Week 2000 Conference at Ontario on October 17th and 19th, 2000, with an expense allowance of $290.00. It was moved by Ybarra, seconded by Gonzales, that authority and funds be granted for Jerry Schreiber to attend the aforementioned conference with an expense allowance of $290.00. Motion carried. Communication from Bruce V. Malkenhorst, City Administrator/City Clerk, dated September 25, 2000, was presented, advising that Akzo Nobel, located at 3492 E. 26th Street has requested an additional year extension for their temporary office trailers to September 18, 2001 because they are consolidating their company's catalyst production in Texas and will probably be closing the Vernon facility in the near future. Akzo Nobel has paid for the extension of the trailer permit and it is hereby recommended that the permit be extended to September 18, 2001. It was moved by Gonzales, seconded by Davis, that the aforementioned communication from the City Clerk/City Administrator dated September 25, 2000, be received and filed and his recommendation approved. Motion carried. Communication from Bruce V. Malkenhorst, City Administrator/City Clerk, dated September 27, 2000, was presented, advising that the Community Services and Water Department is submitting a proposed In -Lieu Replenishment Agreement with the Water Replenishment District of Southern California covering the period of July 1, 2000 thru June 30, 2001. It is hereby recommended that the agreement be approved and executed. It was moved by Ybarra, seconded by McCormick, that the aforementioned communication from the City Clerk/City Administrator dated September 27, 2000, be received and filed and his recommendation approved. Motion carried. RESOLUTION NO. 7641 - A Resolution Of The City Council Of The City Of Vernon Approving And Authorizing The Execution Of An In -Lieu Replenishment Agreement (Central Basin And West Coast Basin: July 1, 2000-June 30, 2001) By And Between The City Of Vernon And The Water Replenishment District Of Southern California, was presented. It was moved by Davis, seconded by Gonzales, that Resolution No. 7641 be approved and adopted. Motion carried. Communication from Bruce V. Malkenhorst, Director of Personnel, dated September 28, 2000, was presented, transmitting the Agenda for the Personnel Committee meeting to be held October 2, 2000 for approval of the recommendations contained therein. Communication from Bruce V. Malkenhorst, Director of Finance, dated September 28, 2000, was presented, transmitting the Finance Committee Minutes for the meeting held September 26, 2000 for approval of the recommendations contained therein. It was moved by McCormick, seconded by Davis, that the recommendations on the September 26, 2000, Finance Committee Minutes be approved. Motion carried. RESOLUTION NO. 7627 - A Resolution Of The City Council Of The City Of Vernon Approving And Authorizing The Execution Of A Consulting Services Agreement By And Between The City Of Vernon And MSW Consultants For Services Relating To AB 939 Compliance And Franchise Fees, was presented. It was moved by Gonzales, seconded by Ybarra, that Resolution No. 7627 be approved and adopted. Motion carried. RESOLUTION NO. 7639 - A Resolution Of The City Council Of The City Of Vernon Authorizing The Purchasing Agent To Purchase Equipment And Support Services For The Upgrading Of The City's Computer Network And Approving And Authorizing The Execution Of An Equipment Purchase Contract By And Between The City Of Vernon And Network Catalyst, In Accordance With Section 2.27(a) Of The Vernon City Code, was presented. It was moved by Ybarra, seconded by Davis, that Resolution No. 7639 be approved and adopted. Motion carried. Communication from Bruce V. Malkenhorst, City Administrator/City Clerk, dated September 28, 2000, was presented, advising that in accordance with Contract No. 555, Vernon Gas Distribution System - Replacement of Gas Main Couplings, bids were opened on September 26, 2000. One bid was received from Doty Brothers Equipment Co. in the amount of $582,010.00 including a 10% Bid Bond and it has been submitted to the Director of Community Services and Water for review. The Mayor asked about the couplings. Director of Community Services and Water advised that yes, they are being tested. There was definitely a malfunction and we have discussed this with the original consultant. In the meantime, we have sought bids for this project. There was only one received and we are currently negotiating the price." The Mayor, "Is this the responsibility of the contractor?" Director of Community Services and Water, "Yes, and it is presently in the hands of the attorney at this time." It was moved by Gonzales, seconded by McCormick, that the aforementioned communication from the City Administrator/City Clerk dated September 28, 2000, be received and filed and his recommendation approved. Motion carried. Page 5 of 8 City Council Minutes October 3, 2000 Communication from Bruce V. Malkenhorst, City Administrator/City Clerk, dated September 28, 2000, was presented, advising that City Council approved and executed an agreement with Beylik Drilling for the repair of Well No. 17. Based on the original bid specifications, the Community Services and Water Department is requesting two changes which are acceptable to Beylik Drilling: • The first change consists of changing the request for stainless steel line shafts to C- 1045 carbon based line shafts • The second change involves additional work of cleaning out the perforations along the entire length of the casing. The new total cost for the entire bid is $54,057.00 which is approximately $1,930.00 lower than the original bid. It is hereby recommended that the agreement with Beylik Drilling be amended to include the two revisions for Well No. 17 at a new cost of $54,057.00. It was moved by Ybarra, seconded by Davis, that the aforementioned communication from the City Administrator/City Clerk dated September 28, 2000, be received and filed and his recommendation approved. Motion carried. RESOLUTION NO. 7640 - A Resolution Of The City Council Of The City Of Vernon Approving And Authorizing The Execution Of An Amendment No. One To The Equipment Purchase Contract By And Between The City Of Vernon And Beylik Drilling, Inc., was presented. It was moved by McCormick, seconded by Gonzales, that Resolution No. 7640 be approved and adopted. Motion carried. WARRANT REGISTER NO. 1050 covering claims and demands presented during the period of September 15th, thru September 28th, 2000, drawn on Wells Fargo Bank totaling $347,781.95, and includes check Nos. 79645 thru 79859 (inclusive), excluding Utility demands and voided checks Nos. 79724 thru 79728. (accounting period October, 2000). It was moved by Ybarra, seconded by Davis, that Warrant Register No. 1050 be approved and payment authorized for claims and demands totaling $347,781.95, excluding Utility demands and voided checks as listed above. Motion carried. Councilman Davis abstained from voting and disqualified himself because it is reasonably foreseeable that the decision may have a material financial effect on his source of income. The Mayor called a recess at 5:28 p.m. The City Council reconvened in Regular Session at 5:34 p.m., all members present before the recess again being present. The City Clerk advised that there was nothing to be discussed in closed session. 1.
