20030319 Regular City Council Meeting - MinutesMINUTES OF THE REGULAR CITY COUNCIL COUNCIL MEETING OF THE CITY OF VERNON HELD MARCH 19, 2003, AT 5:00 P.M. IN THE COUNCIL CHAMBERS OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA MEMBERS PRESENT: Malburg, Ybarra, Gonzales, McCormick MEMBERS ABSENT: Davis The meeting was called to order by Mayor Malburg. It was moved by Ybarra, seconded by Gonzales, that the Minutes of the Regular City Council Meeting held March 5, 2003, be approved and adopted as submitted. Motion carried. The City Clerk advised that now was the time to present the 10851 Award. Presentation of a 10851 Award to Police Officer Fernando Valenzuela by the California Highway Patrol for his outstanding performance while recovering stolen vehicles and/or arrests related to grand theft auto. Ed Dario from the Automobile Club of Southern California and Captain Tyler from the California Highway Patrol addressed the City Council and explained the award and how it can be attained. Captain Tyler presented the 10851 Award for the year 2002 to Officer Valenzuela for his recovery of three (3) "moving stolen" vehicles and 10 abandoned vehicles. Communication from Bruce V. Malkenhorst, City Administrator/City Clerk, dated March 13, 2003, was presented, advising that the below listed employees qualified in the month of February 2003 for a Perfect Attendance Award. It was moved by McCormick, seconded by Gonzales, that the Police Department Activity Log for the period March 1 through 15, 2003, be received and filed. Motion carried. Fire Department Activity Report for the period March 1 through 15, 2003, was presented. It was moved by Ybarra, seconded by McCormick, that the Fire Department Activity Report for the period March 1 through 15, 2003, be received and filed. Motion carried. Risk Management Report for the month of February 2003, was presented. It was moved by Gonzales, seconded by Ybarra, that the Risk Management Report for the period of February 2003, be received and filed. Motion carried. Health Department Report for the month of February 2003, was presented. It was moved by McCormick, seconded by Gonzales, that the Health Department Report for the period of February 2003, be received and filed. Motion carried The City Clerk announced that now was the time for anyone in the audience who wished to address the City Council on any item on the agenda other than with regard to any public hearings that may be listed. The Mayor asked if there was anyone in the audience who wished to address the City Council at this time on any items that are on tonight's Agenda? Mr. Jose Gavina, President of Gavina Coffee addressed the City Council to express his concerns with regard to a proposed trip to Cuba. The Mayor thanked Mr. Gavina for his comments and advised him that those planning to attend had earlier this day chosen not to attend. Dolores Pettullo, President of the Vernon Chamber of Commerce, discussed current events with the Chamber and current issues (railroads) affecting the City of Vernon. The City Clerk advised that the following matter should be deferred to the next City Council Meeting. Communication from Bruce V. Malkenhorst, City Administrator/City Clerk, dated February 27, 2003, advising that this legislative body previously agreed to rebate a portion of Kal Kan Food, Inc.'s personal property tax. This was based on Kal Kan's intent to expand their manufacturing facility. Page 2 of 11 Regular City Council Meeting Minutes March 19, 2003 As a condition of that agreement a Utility Use Agreement for the purchase and use of electricity, water, natural gas, and communication services for a five (5) year period has been prepared. This has been reviewed by the City Attorney and it is hereby recommended that the Utility Use Agreement be approved and executed. (Deferred from City Council Meeting held March 5, 2003.) RESOLUTION NO. 8166 - A Resolution of the City Council of the City of Vernon Approving and Authorizing the Execution of a Utility Use Agreement By and Among the City of Vernon, the Redevelopment Agency of the City of Vernon and Kal Kan Foods, Inc. (Deferred from City Council Meeting held March 5, 2003.) It was moved by Gonzales, seconded by Ybarra, that the aforementioned communication and Resolution No. 8166 be deferred to the next City Council Meeting. Motion carried. Communication from Bruce V. Malkenhorst, City Administrator/City Clerk, dated March 11, 2003, was presented, advising that on February 5, 2003, this legislative body adopted Ordinance No. 1091 declaring a moratorium on the acceptance of applications for, or the issuance of, permits for any Adult - Oriented Businesses pending further study. In order to more thoroughly review this matter it is necessary that the moratorium be extended and Ordinance No. 1092 be adopted, pursuant to Government Code Section 65858. This has been reviewed by the City Attorney and the Director of Community Services and Water and it is hereby recommended that the moratorium be extended to February 3, 2004. It was moved by Ybarra, seconded by McCormick, that the aforementioned communication from the City Administrator/City Clerk, dated March 11, 2003, be received and filed and his recommendation approved. Motion carried. ORDINANCE NO. 1092 - An Interim Ordinance of the City Council of the City of Vernon Extending Interim Ordinance No. 1091, Making Findings with Respect Thereto, Declaring the Urgency Thereof and a Basis for Said Ordinance to Take Effect Immediately. It was moved by McCormick, seconded by Gonzales, that Ordinance No. 1092 be approved and adopted. Motion carried. Malkenhorst, City Administrator/City Clerk, dated March 13, 2003, was presented, advising that the California Department of Conservation (CDC) has announced that, pursuant to Section 14581(a)(4)(A) of the California Beverage Container Recycling Litter Reduction Act, the City of Vernon is eligible for $5,000.00 in grant funds for the years 2003-2004. Staff is requesting approval to apply for the grant funds and utilize them to develop and distribute public information items to promote recycling. Page 3 of 11 Regular City Council Meeting Minutes March 19, 2003 If the grant is approved, the Environmental Health Department is proposing to retain the services of KJ Services, their current Used Oil Recycling consultant. It is hereby recommended that authorization be granted to submit the Grant Fund Application. It was moved by Gonzales, seconded by Ybarra, that the aforementioned communication from the City Administrator/City Clerk, dated March 13, 2003, be received and filed and his recommendation approved. Motion carried. RESOLUTION NO. 8169 - A Resolution of the City Council of the City of Vernon Approving and Authorizing the Execution of a Grant Application Under the California Beverage Container Recycling and Litter Reduction Act to the Department of Conservation's Division of Recycling. It was moved by Ybarra, seconded by McCormick, that Resolution No. 8169 be approved and adopted. Motion carried. Communication from Bruce V. Malkenhorst, City Administrator/City Clerk, dated March 13, 2003, was presented, transmitting for consideration and execution a Quitclaim Deed for an easement across the property located at 2501 Vernon Avenue. In 1917 the original deed was recorded for the construction and maintenance of a storm water sewer; however, the construction did not take place. Noran Company (the property owner) is requesting that the easement be Quitclaimed so that they may possess clear title to the property. This has been reviewed by the Director of Community Services and Water and the City Attorney and it is hereby recommended that the Quitclaim Deed be approved and executed. It was moved by Ybarra, seconded by Gonzales, that the aforementioned communication from the City Administrator/City Clerk, dated March 13, 2003, be received and filed and his recommendation approved. Motion carried. Communication from Bruce V. Malkenhorst, City Administrator/City Clerk, dated March 13, 2003, was presented, advising that Tetra Tech, Inc., has completed the 26th Street and Soto Street Corridor Studies, which have been reviewed by the Director of Community Services. It is hereby recommended that the Final Project Study Reports be received and filed. Communication from Bruce Olson, Chief of Police, dated February 21, 2003, was presented, requesting authority and funds for Detective Jerry Chavez to attend the "Basic Homicide Investigation Course" at Garden Grove on April 7 through 11, 2003, with an expense allowance of $160.00. It was moved by McCormick, seconded by Ybarra, that authority and funds be approved for Detective Jerry Chavez to attend the aforementioned training with an expense allowance of $160.00. Motion carried. Communication from Bruce Olson, Chief of Police, dated February 21, 2003, was presented, requesting authority and funds for Sergeant David Zapien to attend the "Field Training Program Management" at Newport on April 7 through 9, 2003, with an expense allowance of $514.00. It was moved by Gonzales, seconded by McCormick, that authority and funds be approved for Sergeant David Zapien to attend the aforementioned training with an expense allowance of $514.00. Communication from Lewis Pozzebon, Director of Environmental Health, dated February 27, 2003, was presented, requesting authority and funds for Environmental Specialist Jerrick Torres to attend the "California Stormwater Quality Association Meeting" at Downey on April 21 and 22, 2003, with an expense allowance of $233.20. It was moved by Ybarra, seconded by Gonzales, that authority and funds be approved for Environmental Specialist Jerrick Torres to attend the aforementioned training with an expense allowance of $233.20. Motion carried. Communication from Bruce Olson, Chief of Police, dated March 4, 2003, was presented, requesting authority and funds for himself to attend the "Los Angeles County Police Chiefs Annual Conference" at Palm Springs on April 23 through 25, 2003, with an expense allowance of $488.28. It was moved by Ybarra, seconded by McCormick, that authority and funds be approved for the Chief of Police Bruce Olson to attend the aforementioned training with an expense allowance of $488.28. Motion carried. Malkenhorst, City Administrator/City Clerk, dated March 13, 2003, was presented, requesting authority and funds for himself and Mayor Pro Tem Thomas Ybarra to attend the "CMTA Conference" at Indian Wells on April 29 through May 2, 2003, with an expense allowance of $1,102.29 each. It was moved by Gonzales, seconded by McCormick, that authority and funds be approved for the City Officials to attend the aforementioned training with an expense allowance of $1,102.29 each. Motion carried. Communication from Bruce V. Malkenhorst, City Administrator/City Clerk, dated March 13, 2003, was presented, requesting authority and funds for the below listed Councilmen to attend the "CMTA Conference" at Indian Wells on April 29 through May 2, 2003, with an expense allowance of $1,077.29 each. • Hilario Gonzales • William Davis It was moved by Ybarra, seconded by McCormick, that authority and funds be approved for the Councilmen to attend the aforementioned training with an expense allowance of $1,077.29 each. Malkenhorst, Director of Finance, dated March 13, 2003, was presented, transmitting the Agenda for the Adjourned Regular Finance Committee Meeting to be held March 19, 2003, for approval of the recommendations contained therein. It was moved by McCormick, seconded by Gonzales, that the recommendations on the Agenda for the Adjourned Regular Finance Committee Meeting held March 19, 2003, be approved. Motion carried. RESOLUTION NO. 8170 - A Resolution of the City Council of the City of Vernon Approving and Authorizing the Execution of an Agreement for Professional Consulting Services (Fire Station No. 2 Replacement and Police Department Remodeling) By and Between the City of Vernon and RRM Design Group and Terminating the Existing Agreement dated February 27, 2002, and any Amendments Thereto. It was moved by Ybarra, seconded by Gonzales, that Resolution No. 8170 be approved and adopted. Motion carried. RESOLUTION NO. 8171 - A Resolution of the City Council of the City of Vernon Amending Resolution No. 8007 By Amending Pages 4 and 5 of Schedule II (EXHIBIT "B") of Said Resolution Which Fixed the Compensation for Certain Employees of Said City and Authorized Certain Expense Allowance. RESOLUTION NO. 8172 - A Resolution of the City Council of the City of Vernon Approving and Authorizing the Execution of an Agreement for Professional Consulting Services By and Between the City of Vernon and Technical & Business Systems, Inc. for the Malburg Generating Station Project. It was moved by Gonzales, seconded by Ybarra, that Resolution No. 8172 be approved and adopted. Motion carried. RESOLUTION NO. 8173 - A Resolution of the City Council of the City of Vernon Authorizing the Issuance of Request for Proposals From Qualified Consultants for the Investigation and Assessment of the Atlantic Blvd. Bridge Over the Los Angeles River Improvement Project. It was moved by McCormick, seconded by Ybarra, that Resolution No. 8173 be approved and adopted. Motion carried. Communication from Bruce V. Malkenhorst, Director of Personnel, dated March 13, 2003, was presented, transmitting the Agenda for the Regular Personnel Committee Meeting to be held March 18, 2003, for approval of the recommendations contained therein. It was moved by Gonzales, seconded by McCormick, that the recommendations on the Agenda for the Regular Personnel Committee Meeting held March 18, 2003, be approved. Motion carried. The City Clerk advised that the below referenced Warrant Register should be No. 1110 NOT 1109 & asked that the correction be so noted. Warrant Register No. 1109 covering claims and demands presented during the period of February 27, 2003 through March 12, 2003, drawn on Wells Fargo Bank totaling $845,258.53, which includes demand nos. 209421 through 209700, (inclusive), excluding Utilities' demands and voided check no. 209500 (Accounting period March 2003). It was moved by Ybarra, seconded by Gonzales, that the City Clerks advisement be accepted & that Warrant Register No. 1110 be approved and payment authorized for claims and demands totaling $845,258.53, excluding Utilities' demands and voided check as listed above. The City Attorney asked that the following item be deferred to the next Council Meeting. Communication from Bruce V. Malkenhorst, City Administrator/City Clerk, dated March 13, 2003, advising that staff of the Utilities Department and the City Attorney have been negotiating changes to the Transmission Service Agreement with Sunlaw Cogeneration Partners I. It is hereby recommended that if the proposed amendment, as prepared by the City Attorney's office, meets with SunLaw's approval that it be approved & executed. It was moved Ybarra, seconded by McCormick, that the aforementioned matter pertaining to Sunlaw Cogeneration Partners I be deferred to the next City Council meeting. Motion carried. The Mayor called a short recess at 5:45 p.m. The City Council reconvened in regular session at 5:51 p.m., all members present before the recess again being present.
