MEETING OF THE CITY OF VERNON HELD
MONDAY, OCTOBER 26, 2009, AT 9:02 A.M.
IN THE COUNCIL CHAMBERS OF THE CITY HALL
LOCATED AT 4305 SANTA FE AVENUE,
VERNON, CALIFORNIA
MEMBERS PRESENT: Gonzales, McCormick, Davis, Maisano, Newmire
MEMBERS ABSENT: None
The meeting was called to order by Mayor Gonzales.
CHANGES TO THE AGENDA - The Chief Deputy City Attorney
announced that three resolutions regarding Aetna, Lincoln, and
Metropolitan Life needed to be removed from the agenda. He
further announced that pages two and six of the Minutes of the
Regular Council Meeting held October 19, 2009, needed to be
corrected to reflect Mayor Pro Tem McCormick rather Mayor
Gonzales.
The Chief Deputy City Attorney announced that this was
the time for public comments.
The Mayor asked if there was anyone in the audience
who wished to address the City Council at this time.
There was no one in the audience who wished to address
the City Council at this time.
It was moved by Davis, seconded by McCormick that the
Minutes of the Regular City Council Meeting held October 19,
2009, be approved and adopted as corrected. Mayor Gonzales
abstained from voting on this matter. Motion carried. 4-0
The Chief Deputy City Attorney announced that now was
the time to open the Public Hearing - to consider evidence to
establish Vernon's new Transmission Revenue Balancing Account
Adjustment for its high voltage (over 200 kV) Transmission
entitlements (all located outside the City) pursuant to Vernon's
Transmission Owner Tariff; and to consider evidence to establish
Vernon's new Existing Transmission Contract Adjustment for its
high voltage (over 200 kV) Transmission entitlements (all
located outside the City) pursuant to Vernon's Transmission
Owner Tariff.
It was moved McCormick, seconded by Maisano to open
the public hearing, the time being 9:05 a.m. Motion carried.
Electric Resources Planning & Development Manager
Abraham Alemu addressed the City Council and provided full
details pertaining to the Transmission Revenue Balancing Account
Adjustment (TRBAA) and the Transmission Revenue Requirements
(TRR) as part of the responsibilities of a Participating
Transmission Owner (PTO) in the California Independent System
Operator (CAISO).
The Electric Resources Planning & Development Manager
recommended that the Appendix I for each one of the resolutions
pertaining to this public hearing (listed below) be approved.

The Mayor asked if there was anyone in the audience
who wished to address the City Council on this matter.
There was no one in the audience who wished to address
the Council at this time.
It was moved by McCormick, seconded by Newmire, to
close the public hearing, the time being 9:25 a.m. Motion
carried.
Resolution of the City Council of the City of Vernon
Establishing a Transmission Revenue Balancing Account Adjustment
for 2010 in Accordance with Vernon's Transmission Owner Tariff
and Providing for Tariff Sheet Changes to Implement the
Adjustment, was read by title.
It was moved by Maisano, seconded by McCormick, that
Resolution No. 10,092 be approved and adopted. Motion carried.

Resolution of the City Council of the City of Vernon
Adopting a New Transmission Revenue Requirement for 2010 in
Accordance with Vernon's Transmission Owner Tariff and Providing
for Tariff Sheet Changes to Implement the Transmission Contract
Adjustment for High Voltage Transmission Entitlements, was read
by title.
It was moved by Davis, seconded by McCormick, that
Resolution No. 10,091 be approved and adopted. Motion carried.

ORDINANCE NO. 1160 - An Ordinance of the City Council
of the City of Vernon Amending the Code of the City of Vernon by
Amending Article IV of Chapter 13, Sections 13.48 through 13.73,
Adding a New Section 13.74 to Article IV of Chapter 13 and
Repealing All Ordinances or Parts of Ordinances in Conflict
Therewith, was read by title for a first reading.
It was moved by McCormick, seconded by Davis, that
Ordinance No. 1160 be introduced. Motion carried.

ORDINANCE NO. 1161 - An Ordinance of the City Council of
the City of Vernon Amending the Code of the City of Vernon,
California, 1959 by Amending Sections 25.100, 25.101, 25.102,
25.103, 25.104, 25.105, 25.106(B), 25.107(A); Adding a New Section
25.112; Adopting by Reference the Department of Water Resources
State Model Landscaping Ordinance; and Repealing All Ordinances or
Parts of Ordinances in Conflict Therewith, was read by title for a
second and final reading.
It was moved by Maisano, seconded by Davis, that
Ordinance No. 1161, be approved and adopted. Motion carried.

the City of Vernon, California Amending Article XIV of Chapter 2
of the Code of the City of Vernon, California 1959, Relating to
the Recall of Members of the City Council, was read by title for
Introduction and Adoption.
It was moved by McCormick, seconded by Maisano, that
Ordinance No. 1162 be introduced, approved, and adopted. Motion
carried.

Resolution of the City Council of the City of Vernon
Approving the Renewal of Health Care Benefits for Active
Employees, Identified Consultants, and City Council Members for
the Calendar Year 2010 from Aetna Health of California Inc. and
Aetna Life Insurance Company Inc., was removed from the agenda.
Resolution of the City Council of the City of Vernon
Approving the Renewal of Life Insurance Benefits from the
Lincoln National Life Insurance Company for Active Employees,
Identified Consultants and City Council Members, was removed
from the agenda.
Resolution of the City Council of the City of Vernon
Renewing the Metropolitan Life Insurance Company Group Policy
for Dental Care Benefits for Active Employees, Identified
Consultants, and City Council Members, was removed from the
agenda.
Resolution of the City Council of the City of Vernon
Approving and Authorizing the Execution of a Limited

Approving and Authorizing the Execution of a Services Agreement
by and between the City of Vernon and General Pump Company, Inc.
for the Rebuild and Installation of Pump Equipment at the Downey
Underpass Stormwater Pumping Station, was read by title. .
It was moved by Davis, seconded by Maisano, that
Resolution No. 10,089 be approved and adopted. Motion carried.

Resolution of the City Council of the City of Vernon
Approving and Authorizing the Execution of Amendment No. 1 to
the Services Agreement for Emergency Repairs to Water Production
and Distribution Related Equipment by and between the City of
Vernon and General Pump Company, Inc., was read by title.

It was moved by Maisano, seconded by McCormick, that
Resolution No. 10,090 be approved and adopted. Motion carried.

The Chief Deputy City Attorney announced that now was
the time for the Director of Community Services & Water
Department to report on the I-710/Slauson Interchange and North
End Terminus - Initial Geometric Plan.
The Director of Community Services & Water distributed
to the entire City Council a hard copy of the power point
presentation; made copies available of the same for the public;
and addressed the proposed improvements.
Mayor Gonzales asked if there were any questions from
the City Council on this matter.
Councilmember Davis asked if the Orangeline High Speed
transportation project would be aboveground or underground.
The Director of Community Services & Water reported
that for the most part, the Orangeline High Speed transportation
project would be elevated.
The Mayor asked if there were any other questions from
the City Council on this matter.
There were no more questions on this matter.
All five members of the City Council expressed support
for the recommendations of the Director of Community Services &
Water.
The Chief Deputy City Attorney announced that now was
the time for Conference/Seminar reports from Elected Officials
for the period of October 19 through October 25, 2009.
There were no reports made for said period.
The Chief Deputy City Attorney announced that now was
the time for the City Administrator Reports and announcements.
There were no reports or announcement made by the City
Administrator at this time.
The Chief Deputy City Attorney announced that now was
the time for City Council Reports and announcements.
There were no reports or announcements made by the
City Council.
The Mayor called a short recess at 10:01 a.m.
The City Council reconvened in regular session at
10:10 a.m., all members present before the recess/again being
present.
The Chief Deputy City Attorney announced that this was
the time to go into closed session.

It was moved by McCormick, seconded by Davis, to go
into Closed Session for the items listed on the agenda, the time
being 10:10 a.m. Motion carried. 5-0
It was moved by McCormick, seconded by Maisano, that
the City Council go out of closed session and resume open
session, the time being 10:45 a.m. Motion carried. 5-0
OPEN SESSION
Closed Session Reports: The City Attorney reported
that the one claim was denied.
There being no further business to come before the
City Council at this time, it was moved by McCormick, seconded
by Davis, that the meeting be adjourned, the time being 10:47
a.m. Motion carried. 5-0
