20100205 Regular City Council Meeting - MinutesMINUTES OF THE SPECIAL CITY COUNCIL MEETING OF THE CITY OF VERNON HELD FRIDAY, FEBRUARY 5, 2010, AT 3:45 P.M. IN THE COUNCIL CHAMBERS OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA MEMBERS PRESENT: Gonzales, McCormick, Davis, Maisano, Newmire MEMBERS ABSENT: None The meeting was called to order by Mayor Gonzales. The Chief Deputy City Attorney announced that there were no changes to the agenda. The Chief Deputy City Attorney announced that this was time for public comments. Mayor Gonzales asked if there was anyone in the audience who wished to address the City Council. There was no one in the audience who wished to address the City Council at this time. Resolution No. 2010-21 - A Resolution of the City Council of the City of Vernon Authorizing the City Administrator to Execute a Purchase and Sale Agreement in Connection With the Sale of 12,420 Acres of Property in Kern County, California The City Administrator addressed the issues on the staff report and the need to take action on this matter due to the current financial market. Councilman Davis asked of the location of the area of the 12,420 acres and if there were any easement rights in .the agreement. The City Administrator reported that the acres of land being proposed for sale are between other energy projects and that the agreement includes easement rights for the city. City Attorney Wiener advised that the sale price of no less than $35 million, which appeared on the proposed resolution, meant that in case the bidders submitted a proposal for less than $35 million, the City Administrator would be required to report to City Council with the potential proposal for their consideration. Any offer made in the amount over $35 million, by approving the proposed resolution, the City Administrator would be authorized to take action without further reporting to the City Council. The City Administrator reported that once the two proposals come in, the selection of the best proposal will be made. Mayor Pro Tem McCormick asked if there would be any adverse effect in selling the land. Special City Council Meeting Minutes February 5, 2010 The City Administrator advised that on the contrary, the sale of the 12,420 acres would have a favorable effect. He further advised that this would be the first step to move forward with the City's renewable energy project. Mayor Gonzales asked if there were any questions. There were no questions. It was moved by McCormick, seconded by Davis, that Resolution No. 2010-21 be adopted.
