IN THE COUNCIL CHAMBER OF THE CITY HALL LOCATED
AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA
MEMBERS PRESENT: Gonzales, McCormick, Maisano, Newmire
MEMBERS ABSENT: Davis

The meeting was called to order at 9:02 a.m. by Mayor
The City Clerk announced that there were no changes to
the agenda.
The City Clerk announced that this was the time
allotted for public comments.
The Mayor asked if there was anyone in the audience
who wished to address the City Council. No one responded.
The Consent Calendar was presented.
CONSENT CALENDAR
Light & Power Department
1. Resource Procurement Report for the month of March 2010, to
be received and filed.
Treasurer's Department
1.. Approval of the following Warrant Registers covering the
period of May 4 through May 10, 2010.
a. Warrant Register No. 1313, totaling $480,763.66, which
consists of the following:
■ Ratification of the issuance of early checks totaling
$4,746.99; and
■ Authorization to issue pending checks totaling
$476,016.67
b. Light & Power Warrant Register No. 278, totaling
$169,478.93, which consists of the following:
■ Ratification of wire transfers totaling $109,658.21;
■ Ratification of the issuance of early checks totaling
$25,591.07; and
■ Authorization to issue pending checks totaling
$34,229.65.
c. Gas Warrant Register No. 66, totaling $4,392.29, which
consists of the following:
■ Ratification of the issuance of early checks totaling
$4,115.26; and
■ Authorization to issue pending checks totaling
$277.03.
It was moved by McCormick, seconded by Maisano, that
the matters on the Consent Calendar be approved as recommended.

ORDINANCE NO. 1168 - An Ordinance of the City Council
of the City of Vernon Amending Section 2.1 of the Vernon City
Regular City Council Meeting Minutes
May 17, 2010
Code Relating to the Time, Place and Agenda Topics of City
Council Meetings, was read by title for a first reading.
Councilman Maisano recommended that Section 2(a) of
Ordinance No. 1168 be amended to set the regular City Council
meetings on a bi-monthly schedule, with meetings on the first
and third Monday of each month, and set the start time for the
Light &Power meeting at 8:00 a.m. and the start time for the
non Light & Power meeting at 9:00 a.m.
It was moved by Maisano, seconded by McCormick, that
Ordinance No. 1168 be introduced with the changes recommended by
Councilman Maisano. Motion carried. 4-0
RESOLUTION NO. 2010-56 - A Resolution of the City
Council of the City of Vernon Approving the Submittal to the
California Department of Transportation of a Functional
Classification Map Change Request Form Relating to Changes in
the Functional Classification of Streets and Roads Within the
City of Vernon.
It was moved by McCormick, seconded by Maisano, that
Resolution No. 2010-56 be approved and adopted. Motion carried.

RESOLUTION NO. 2010-57 - A Resolution of the City
Council of the City of Vernon Approving and Authorizing the
Execution of a Rental and Maintenance Agreement By and Between
the City of Vernon and United Site Services, Inc. for Fencing.
It was moved by McCormick, seconded by Newmire, that
Resolution No. 2010-58 be approved and adopted. Motion carried.

RESOLUTION NO. 2010-58 - A Resolution of the City
Council of The City Of Vernon Approving Sewer System Management
Plan (SSMP) Volume I and Appendix "O" of SSMP Volume II in
Compliance with the Statewide General Waste Discharge
Requirements for Sanitary Sewer Systems.
It was moved by Maisano, seconded by Newmire, that
Resolution No. 2010-58 be approved and adopted. Motion carried.

RESOLUTION NO. 2010-59 - A Resolution of the City
Council of the City of Vernon Approving the City's Participation
in the Steering Committee for the Pacific Electric Right -Of -Way
(PE ROW)/West Santa Ana Branch Corridor Alternatives Analysis
and Appointing the City's Representatives.
It was moved by McCormick, seconded by Maisano, that
Resolution No. 2010-59 be approved and adopted. Motion carried.

The City Clerk announced that this was the time to
hold the discussion regarding the Los Angeles River Bacteria
Total Maximum Daily Load (TMDL) program.
Director of Community Services & Water Kevin Wilson
distributed updated handouts to the City Council and gave a
slide presentation on the L.A. River Bacteria TMDL program. The
total estimated costs to bring the L.A. River into compliance

with current TMDL requirements over the next 25 to 30 years is
$1 billion for dry weather and $5.4 billion for wet weather.
Vernon's share of these costs is estimated at $12 million for
dry weather and $48 million for wet weather, for a total cost of
$2.4 million per year for the next 25 years.
Director Wilson advised that Vernon is in Reach l of
the implementation plan, thereby having three years to develop a
treatment plan and five years to implement said plan. A public
hearing on the matter is scheduled for July in Ventura and the
affected cities are trying to get the hearing rescheduled to
August in Los Angeles.
Director Wilson recommended the City inform the
Regional Board of some of its primary concerns, including the
exorbitant implementation costs and the impact those costs will
have on other City services, the impracticality of
implementation due to the lack of scientific support, the
impractical recreational -use classification of the L.A. River,
and the lack of a stakeholder process. L.A. Cities have been
voicing concerns with the Regional Board about other TMDL
requirements over the years, but the Bacteria TMDL has been the
most difficult and impractical to comply with and by far the
most costly. The City will also work with the Coalition of
Practical Regulation on this matter, which will likely provide
additional comments.
The City Clerk announced that this was the time for
conference/seminar reports from elected officials for the period
of May 10 through May 16, 2010.
The Mayor reported that none of the Councilmembers
attended conferences or seminars during the period of May 10
through May 16, 2010.
The City Clerk announced that this was the time for
reports and announcements from the City Administrator.

City Administrator Donal O'Callaghan reported as
1. The scheduled annual MGS outage is under way and
expected to be completed within the next week or
two. The City has been able to purchase the
energy required to meet its demands at
competitive prices during the outage.
2. The final draft of the proposed 2010-2011 fiscal
year budget is nearly complete. Tremendous
effort has been put forth by the Department Heads
to reduce operating costs moving forward.
Discussions with the Vernon Police Officers
Benefit Association will begin this week.
The City Clerk announced that this was the time for
reports and announcements from members of the City Council.
None of the Councilmembers had anything to report at this time.
The City Council recessed into closed session to
discuss the items listed on the closed session agenda.
Closed Session Reports: The City Attorney reported
that there were no reportable actions.

City Administrator O'Callaghan stated that the new
budget has considered making Police cuts and no Police cuts,
along with trying to identify new sources of revenue, and the
outsourcing of services. Monthly and quarterly reports will be
provided.
It was moved by McCormick, seconded by Newmire, that
the meeting be adjourned at 10:32 a.m. Motion carried.
