THE CITY OF VERNON HELD TUESDAY, MARCH 6, 2012,
IN THE COUNCIL CHAMBER OF THE CITY HALL LOCATED
AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA
MEMBERS PRESENT: Davis, McCormick, Maisano, Newmire
MEMBERS ABSENT: None
The meeting was called to order at 9:00 a.m. by Mayor Pro-Tem
Davis.
Councilman McCormick led the flag salute.
The City Clerk announced that that there were no changes to the
agenda.
The City Clerk announced that this was the time allotted for
public comment. The Mayor Pro-Tem inquired whether anyone in
the audience wished to address the City Council.
Mike Curiel, Public Affairs for Southern California Gas Company,
formally introduced himself and advised that any concerns
related to the services can be communicated through him.
Lissette Gavina-Lopez questioned the reasoning and the benefits
received for the services of the Law Offices of Eric T. Fresch.
Counsel Dana Reed advised that this was a public comment. He
advised that Gavina-Lopez can submit the questions to be
addressed at the next meeting. Reed reported that the Brown Act
does not allow for dialog.
Gavina-Lopez stated that it was her understanding that the
Fresch contract is scheduled to terminate in May, but questioned
the value of the services.
Gavina-Lopez also questioned expenses related to SRT
Helicopters, Power Consultants, Inc. and C142MHILL. She
expressed her concerns over the half -a -million dollars spending
in two weeks on the Tehachapi Project and wondered what the
benefit to the businesses would be when the cost of doing
business continues to increase.
Gavina-Lopez urged the Council to scrutinize every dollar spent
before approving and to ask what the benefit to businesses will
be.
PRESENTATIONS
1. Service Pin Awards
The Mayor Pro-Tem presented service pins to Jose Cervantes,
Utilityman II, for his 30 years of service; and victor Vasquez
Jr., Utilityman iv, for his 10 years of service.
MINUTES
It was moved by McCormick and seconded by Maisano to approve the
Minutes of the Regular City Council Meeting held January 3,
2012. Motion carried, 4-0.

CONSENT CALENDAR
It was moved by McCormick and seconded by Newmire, that the
matters on the Consent Calendar be approved as recommended.
Motion carried, 4-0.
1. Warrant Registers
a. Ratification of City Warrant Registers to record the
following voided checks:
1. City Warrant Register No. 1348 to record voided
check no. 335910 in the amount of $30.00; and
2. City Warrant Register No. 1348 to record voided
check no. 336103 in the amount of $818.03; and
3. City Warrant Register No. 1350 to record voided
check no. 336292 in the amount of $75.00.
b. Approval of City Warrant Register No. 1352, totaling
$498,922.10, which covers the period of February 14,
through February 27, 2012, and consists of the
following:
1. Ratification of wire transfers totaling
$140,469.72, and
2. Ratification of the issuance of early checks
totaling $47,211.41; and
3. Authorization to issue pending checks totaling
$311,240.97; and
4. Record voided check no. 336632 totaling
$10,463.00.
c.Approval of RDA Warrant Register No. 419, totaling
$675.00, which covers the period of January 31,
through February 27, 2012, and consists of the
following:
1. Authorization to issue pending checks totaling
$675.00.
2. Police Department
a.Activity Log and Statistical Summary of Arrest and
Activities for the period of February 1, through
February 15, 2012, to be received and filed.
RESOLUTIONS
1. Resolution No. 2012-39 - A Resolution of the City Council
of the City of Vernon Approving and Authorizing the.
Execution of Encroachment License Agreement No. 415 By and
Between the City of Vernon and Packers Investors, Inc.
Kevin Wilson, Director of Community Services a Water, reported
on the need to lay a pipeline for vapor extraction in order to
remediate the system to the satisfaction of the Health
Department. This would result in one versus two extraction
units. Wilson reported that once the vapor has been
extracted, the agreement can be terminated.
It was moved by McCormick and seconded by Maisano to approve
Resolution No. 2012-39. Motion carried, 4-0.

2. Resolution No. 2012-40 - A Resolution of the City Council
of the City of Vernon Authorizing the Issuance of a Notice
Inviting Sealed Proposals or Bids for the citywide
Rubberized Emulsion -Aggregate Slurry (REAS) Seal Phase I
Project, Contract No. CS-0052
Kevin Wilson, Director of Community Services & Water, reported
that this was a 3-phase capital improvement project to repave
streets in the western half of the city and to mitigate
damages in the eastern portion. In response to Mayor Pro-Tem
Davis, Wilson advised that the process will require street
closure for a few hours, but that the City will be
communicating with businesses to try and coordinate the work
around their schedules.
In response to Councilman McCormick, Wilson reported that the
work on Fruitland Avenue has been postponed in anticipation of
an evaluation on gas pipes which will require borings.
In response to Councilman Maisano, Wilson advised the
requested process involves a new rubberized component and is
hopeful about having an alternative for street resurfacing.
Wilson advised that if a surface is in very poor condition,
then resurfacing is necessary but that it varies on each
street.
It was moved by Maisano and seconded by Newmire to approve
Resolution No. 2012-40. Motion carried, 4-0.
3. Resolution No. 2012-41 - A Resolution of the City Council
of the City of Vernon Approving a Conflict of Interest Code
for the Sustainable Development and Energy Efficiency
Commission
It was moved by Newmire and seconded by Maisano to approve
Resolution No. 2012-41. Motion carried, 4-0.
ORDINANCES
1. ORDINANCE No. 1182 - An ordinance of the City Council of
the City of Vernon Adding a New Section 17-17 to Chapter
17, Offenses -Miscellaneous, to the Code of the City of
Vernon Relating to the Sale of Fireworks by Nonprofit
Organizations, Adopting Rules and Regulations for the Sale,
Use and/or Manufacture of Fireworks in the City of Vernon
and Repealing ordinance No. 644 (second reading)
It was moved by Newmire and seconded by Maisano to adopt
Ordinance No. 1182. A role call vote was taken:

City Administrator Mark Whitworth reported on the staggered
terms, and advised that the remaining members would serve four
years.
It was moved by McCormick and seconded by Newmire to approve the
initial term of two years for the three representatives. Motion
carried, 4-0.
DISCUSSION AND POSSIBLE ACTION
1. Recruitment of a two part-time positions, Computer Aided
Drafting Technician and Account Clerk, within the Light &
Power Department.
Director of Light & Power Carlos Fandino reported on the
resignation of two department employees and the need for two
part-time employees to assist in various capital projects.
It was moved by McCormick and seconded by Maisano to authorize
the recruitment of two part-time employees. Motion carried,
4-0.
ORAL REPORTS
Interim Police Chief Daniel Calleros reported on the theft of a
steel water meter cover on February 21, 2012,. There were no
leads but officers will be investigating local scrap yards.
On February 27, 2012, a patrol officer was injured in a traffic
collision while on route to assist another officer. The officer
is recovering from his injuries and the California Highway
Patrol is handling the investigation.
Calleros reported of additional truck battery thefts and
continued investigations.
On March 17, 2012, officers will be participating in the annual
LAURA Unity and Peace Resource Fair and providing information on
crime victim resources, crime prevention, and general
information about law enforcement in the southeast area.
Calleros reported that there had been no incidents of vandalism
since the last Council meeting. Councilman McCormick reported
on two vandalisms.
Fire Marshall Jed Hulsey reported that there have been no
significant incidents in Area E and Vernon since the last
council meeting. Hulsey advised that Assistant Chief Andrew
Guth and Battalion Chief Mike Wilson were attending a planning

session for the upcoming Alameda Corridor Drill to simulate a
haz-mat event.
Hulsey mentioned that a new C.E.R.T.S. class will be graduating
and the Fire Department will participate at the LAURA Unity and
Peace Resource Fair.
Interim Director of Health and Environmental Control Leonard
Grossberg reported on the Sustainable Development and Energy
Efficiency Commission's first meeting.
Kevin Wilson, Director of Community Services and Water, reported
that the next Advisory Committee on Business Development will
include a presentation by the Los Angeles County Economic
Development Corporation and that the Committee will be
discussing city revenues and a proposed special parcel tax.
Carlos Fandino, Director of Light & Power, reported that the
Advisory Committee on Electric Rates will meet March 7, 2012, at
8:00 a.m. Fandino reported that the Committee will be reviewing
the 2012 rate study and invited all to attend.
Mark Whitworth, City Administrator, reported on his trip to
Sacramento with Councilman McCormick and Counsel Dana Reed. The
trip included meetings with Senators Lieu and De Leon. The
responses to Vernon's recent reform efforts were positive.
Whitworth reported on his attendance at the League of California
Cities directors' meeting.
Whitworth mentioned that Greg Longstreet from Farmer John was
recently appointed to the board for the California Chamber of
Commerce.
Whitworth reported on the introduction of the proposed special
parcel tax at the Advisory Committee on Business Development
meeting on February 8, 2012, and on the parcel tax workshop
scheduled for March 14rh and March 15`h
Whitworth advised that the Vernon Quarterly would be out by the
end of the week.
Whitworth announced that the next Vernon Housing Commission
meeting is scheduled for March 8, 2012. He reported that
approximately 30 expression of interest forms had been received
for City Housing.
Whitworth reported on the Matheson Tri Gas easement and advised
that the City is looking at properties to move or sell,.
Whitworth mentioned that the Police and Fire Department MOU's
were under review and that they were going through the meet and
confer process and that the 2012-2013 budget was also under
review.
The City Clerk announced that there were no further items on the
agenda.
