THE CITY OF VERNON HELD WEDNESDAY, JUNE 27, 2012,
IN THE COUNCIL CHAMBER OF THE CITY HALL LOCATED
AT 4305 SANTA FE AVENUE, VERNON,. CALIFORNIA
MEMBERS PRESENT: (Roll Call) Davis, McCormick, Ybarra
MEMBERS ABSENT: Maisano
The meeting was called to order at 3:00 p.m, by Mayor Pro-Tem
Davis.
Councilman McCormick led the flag salute.
The City Clerk announced that this was the time allotted for
public comment. Mayor Pro-Tem Davis inquired whether anyone in
the audience wished to address the City Council. There was no
response.
ORDINANCE
ORDINANCE NO. 1197 - An Ordinance of the City Council of the
City of Vernon amending Chapter 2, Article XII of the Vernon
City Code establishing procedures for election contests.
Marguerite Leoni of Nielsen, Merksamer, Parrinelo, Gross, and
Leoni, stated that the Ordinance pertained to all election
contests and that the Vernon City Charter provides the City
Council with jurisdiction over the matter.
The proposed ordinance provides timelines as to when contests
are to be filed, the grounds for contests, and procedures, such
as the ability to call witnesses and subpoena power. Leoni
stated that the purpose of the ordinance is to provide, among
other things, transparency, an expression of the will of the
Vernon voters, along with certainty, and a sense of legitimacy
as to who was elected in the June 5, 2012 Special Election.
Moreover, the ordinance was designed to avoid disruption of city
government and city businesses.
Leoni stated that since this ordinance related to an election,
this ordinance could be introduced, adopted, and effective upon
passage by the council. Leoni reasoned that there is a sense of
urgency related to the matter as there is nothing presently in
place to address contested elections.
Councilman McCormick moved that Ordinance No. 1197 be approved
and adopted. The motion was seconded by Ybarra.
The City Clerk informed the Council of a typographical error on
Page 6, line 2, changing the word from "that" to "than."
Councilman McCormick amended his motion to approve. The motion
was seconded by Ybarra. A roll call vote was taken:
Mayor Pro Tem Davis: Yes
Councilman McCormick: Yes
Councilman Ybarra: Yes
The motion passed, 3-0.
The City Clerk announced that there were no further items on the
agenda.

At 3:14 p.m., it was moved by McCormick and seconded by Ybarra,
that the meeting be adjourned. Motion carried.
