CARD TABLES. No person, firm or 15 corporation shall engage in managing, conducting or carrying on the business of maintaining a place where tables are used by the public for playing cards, and for the use of which, a fee or com- 16 17 18 pensation is charged players until such person shall have first obtained a permit and license for each table he uses or proposes 19 20 to use in said business, as hereinafter provided; every person, 21 firm or corporation proposing to engage in managing, conducting or carrying on the business of maintaining a place where tables 22 23 24 25 are used by the public for playing cards, and for the use of which a fee or compensation is charged players, shall first fill out an application obtainable from the City Clerk, to secure a permit so to do from the City Council, and in addition thereto, shall pay a license fee of $180.00 per annum in advance, for the first table, and $180.00 per annu~ in advance, for each additional table, whether or not the same is in actual use, such license fee to be payable to the City Clerk of said City at the time of the filing of the application for the permit from the City Council. 32 - 1 - ~ 26 z o .... ~ 0: ~~1'l27 <( '" - 0 m~ z 3 ~ 8 mzo"u" 28 "::::la: ~ ' - z oJ:Owo~~ '" 1-> ~ II: 0 ~ai"''''" <(.J 09 .. <louu.w '" ~z>->ii: Z ~ O"'!: 0 0 ~ UlUu: ~ ; 30 0: '" z ~ <( 0 _ .. u :l ~ 31 J: 1 2 Each applicatlon filed with the City Clerk for such permit shal1 a180 be accompanied with a payment of a $25.00 application fee for payment of the costs of investigating the application and building, and in a,ddi tion thereto, any applicant for a permit and 3 4 5 license to conduct such place of business, shall pay to the City 6 lof Vernon a permit fee in the sum of $3000.00; sE,id permi t fee to 7 be paid at the time of filing of the application for a permit and license, and shall be payable to the City Clerk of said City. Should said permit not be issued, the applicant shall be entltled to a refund of such money paid by him for and on account of a 8 9 10 11 license fee and permit fee for which a permit was not issued, but 12 I in all events, the $25.00 application fee shall be retained by 13 I the City. I 14 Before the City Council shall consider the application for such permit, the City Clerk shc,ll refer same to the Chief of 15 16 Police and the Building Inspector for a full end complete investi- gation of the building and location where applicant proposes to conduct such place of business, as to the type of tables to be used 17 18 19 at, the type of games to be played at, and the location of the 20 to,bles in the proposed place of business. Upon completion 4 of investigations by the Chief of Police and the Building Inspec- 5 tor, their reports shall be submitted to the City Council, in 6 written form, whereupon the City Council shall for the purpose 7 of further investigation withhold any and all action relative to 8 the granting or denying of such permit for a period of not less 9 I than 20 days. The opinion of the City Council shall be con- 10 I clusive and any granting or denial of any applicant for such 11 permit shall be final. Any permit issued wrongfully or any 12 13 14 license used in violation of the foregoing prohibitions shall be null and void. Provided, however, that this Section 25.11 of the 15 Ordinance shall not apply to regularly incorporated benevolent, 16 charitable, social or fraternal organizations, which are non- 17 profit organizations, which pay no salaries and which give no consideration of value of any kind to the people employed in or 18 19 by such organization conducting such a buslness and whlch organ- 20 ization uses the entire receipts from such tables for charitable 21 or benevolent purposes, and providing further that such non- 22 profit organizations shall be subject to any and all rules and 23 regulatlons as may be adopted by the City Council of the City 24 of Vernon, should such action be deemed necessary. 25 I That the total permits and licenses in the City of II Illvernon for permission to operate such businesses, shall not ex- Illceed the issuance of more than one such permit and license for leach 1500 people in number, or major fraction thereof, as to IlpoPulation, based upon the federal census of 1940. It shall be unlawful for any person to operate or use 31 more tables than those for whlch he or his employer has obtained 32 - 3 - 1 a permit and has paid the necessary license fee therefor. 2 Nothlng hereln contained shall in any manner whatsoever 3 be construed as permitting any gaming prohibited by the laws of 4 the State of California, or the Ordinances of the City of Vernon. 5 Each and all of such games shall be operated in full conformlty 6 with and subject to all of the provisions of the laws of the 7 State of California, and of the Ordinances of the City of Vernon. 8 The City Councl1 reserves the right to determine at any 9 time by resolution, the establishment of rules and regulations 10 under which any permittee may operate any business licensed under 11 IthiS section of this ordinance. 12 Any permit or license lssued hereunder may be revoked I 13 Iby the City Council of the City of Vernon upon any showing that 14 the person holdlng such permit and license is not conducting his 15 place of business in accordance with the provisions of the laws 16 of the State of California or of the Ordinances of the City of 17 Vernon, or in accordance with the terms of any rule or regulation 18 established by said City Council. Any person now holding a per- 19 mit or license heretofore issued by the City of Vernon shall not 20 be required to pay the application fee or the permit fee herein- 21 above set forth unless he wishes an additional permit, but shall 22 be subject to any and all rules and regulations adopted by the 23 City Councl1 as elsewhere provided for in this Ordinance. U I'll- '" ~ 31 J: 25 I $ I,and upon payment of a 10.00 investigation fee to cover the in- 26 vestigation as to the building and games to be played at as Ilspecified elsewhere in this Ordinance shall, wi th the consent of 'Ithe City Council be permitted to move his place of business to I [a new location. But no permit or license issued under the pro- \visions of this Ordinance shall be transferable from any permittee, firm or corporation to another permittee, firm or corporation, 32 - 4 - 1 wi thout first having obte,ined permission from the council so to 2 do." 3 (B) "REGULATION OF THE GAME OF 'DRAW POKER'. That 4 in addition to the provisions contained in Section 25.11 of the 5 above entitled Ordinance and as supplementary thereto, and by 6 way of regulation of the business to be operated by a permittee 7 and licensee who permits the playing of the game of 'Draw Poker', 8 it is hereby ordained, declared and provided: 9 IISubdivision (a). The City Council of the City of 10 Vernon, California, does hereby declare that the playing of games 11 not prohibited by statute is conducive to public morals and that 12 in any proceeding to annul license or to abate the business con- 13 ducted thereunder, or to prosecute the licensee or his employees 14 for any acts authorized thereby, it shall be presumed that such 15 acts are not unlawful and that such business is not a public or 16 private nuisance. 17 "Subdivision (b). That any person, firm or corporation 18 engaged in, or proposing to engage in, the managing, conducting 19 or carrying on the business of maintaining a place where tables 20 \are used by the public for playing the game of 'Draw Poker' pur- 21 \suant to the provisions of Section 25.11 of this Ordinance, shall 22 II:state in his application for his permit and license that the game 23 to be conducted by such permittee and licensee is the game of 24 I, Draw Poker'." , I II 25 il "Subdivision (c). U :l ~ 31 J: 1 any such permittee or licensee or any of his agents or employees to permit any person over the age of 21 years to play the game of 'Draw Poker' upon said premises between the hours of 4:00 o'clock A. M. and 10:00 o'clock A. M. of any day, any such per- mittee or licensee or any of his agents or employees who shall violate the provisions of this subdivision of this Ordinance shall be guilty of a misdemeanor. 2 3 4 5 6 7 8 This ordinance shall take effect thirty (30) days 9 I after its final passage. 10 Section 4. There is no newspaper printed and published 11 within said City of Vernon. The City Clerk shall certify to the 12 passage of this Ordinance and shall cause the same to be posted 13 in three of the most conspicuous places in the City of Vernon, to 14 wit: the northwest corner of the 38th street and Santa Fe Avenue; 15 the northwest corner of 37th Street and Santa Fe Avenue; and on 16 the bulletin board in the lobby of the City Hall of the City of 17 Vernon, located at 4305 Santa Fe Avenue, in said City. This 18 Ordinance shall be posted for a period of not less than thirty 19 (30) days prior to its effective date, and shall be in ful1 force 20 and effect on and after the Day of , 1949. 21 ADOPTED THIS Day of October, 1949. 22 23 24 25 R.
