The Board of Trustees of the city of Vernon do ordain as follows:- Section 1. Th~Jt the Tight) privilege sncl permission be, and the same ls, hereby granted to the SoutherD Pacific ~-1Ailroad Company, 8 aorporatioll, its successors aDu assigns, to laj-~, con- struct, maintain and operate a railroaG spur track aorOss ~lameda Street in the city of Vernon, county of Los Angeles, stRte of C&lifornia, batvwsen the points hereinafter described, to wit:- Commencing at a point in the easterly line of Al~,meda Street, s~id point measured along said easterly line, being distant 100 feet more or less northerly from the interseotion of SSid easterly line with the northerly line of Fifty-second Street; thence ~ , northwesterly or a e~ved line 80 ft. more or less to 8 point in the westerly line of Alameda Street, said point measured along said wester ly line, being distant 170 feet northerly from interseotion of sl"id i\esterly line with the northerly line 0 f ~'ifty-seoond Street projected. Section 2. That the spur track which rosy be 1a10 and oonstructed under the privilege hereby granted shall correspond to the 0 fficial grade ot. the street Rcross or along which it may be plaoed, as now established by said oity of Vernon; the tops 01' the rails to be flush with the surrounding suxfeee of the street, and in the event such street shall be graded, paved or otherwise improved under the authority of said city of Vernon, then such spur tracl!: over or upon such street and the ground for a distance of two (2) feet on each side thereOf, shall be by grantee, or its assigns, made to conform to said grads, and shall be so maintained by said grantee, its successors or assigns. with the tops of said rails flush with the surface of said street. , (2) ~ section 3. The right, privilege and permission hereby granted shell be exeroieed and enjoyed eubject to the following oondit1one:- lst:- That no oars or locomotives ehell be permitted at any time to stand upon the streets oocupied by said spur track except during the time actually employed in a_itching, loading or unloading car. placed thereon, and that said spur track shall at all times be used eo as to obstruct the use of said streets and alleY8 by vehicles or passengers as little as possible oonsistent with the uses for whioh said spur traok is to be constructed; 2nd:- That said grantee, 1ts sueO.Beors and a.Bslgna, shall con- ~truct all necessary flumes and culverts for the passage of water under said track whenever or wherever necessary; and that all such flumes or culverts shall be constructed in aocordance with the plana and specifica- tions therefor, approved by the Oity Engineer of the Oity of Vernon; 3rd:- That said grantee, its successors and assigns, will plank and replant, gravel and regravel, pave and repave all portions of the street occupied by said spur track, and for a distance of two (2) ~eet on each side thereat with the same material and under the same epecif1c~ tlone and in the Same manner as said streets and alleys are naw, or may b.reaft~r be planked or replanked, graveled or regravel ed, paved or re- paved, and that all such work shall be done under the instructions of, and to the satis~aotion of the Board of Trustees of the oity o~ Vernon; 4th:- That any neglect, failure or refusal on the part of the grantee, its 8ucoeSBora and assigns, to obBerve or complY with any ot the terms or conditions in this Ordinance contained ehall effect & forfeiture of the right, privilege and permissiom hereby granted, and the laid city, by its Eoard of Trustees, may thereupon declare SUCh rights and privileges forfeited, and may exclude sald grante., its successOrs and a8signs, from any ~urther use of the etreets and all eye oooupied by said epur track, and the grant hereby made shall thereupon become and remain null, void and of nO effect. . , ..
