It shall be unlawful for any person, as principal. agent or contractor, to make any improvement in any of the streets of the City of Vernon by or under private oontraot, unless permission from the Board of Trustees therefor 1s first secured and unless the deposit herein provided for is made. Any permission granted by the BO!...tr,:t of Il'ruster,,8 '~_.(:.:':' tLe illaLinf of !;l,ny such improvement, by or under private contract, s116.11 be deeraed to have been subject to the terms of this ordinance. Before any such permission shall become effecti ve for any purpotle, there shall be de-posited vd th the ~upcrinteDdent of ~treets such Sum of money as may be estimated by the Superintendent of ;:jtreets to be necessary to cover the cost of inspeotion and supervision by his department for said improve- ment, and also such sum of money as Hlay be estimated by the City .:c;ngineer of said City to be necessa.ry to cover the expenses that may be incurred by the City l~n?ineer's uepartment in connection with said improvement. SaiQ improveffient shall be made under the direction, and to the satisfaction of the Superintendent of streets and all work shall, during its progress and on its completion, conform to the lines and levels which may frOD time to time be given by the City Engineer. Upon its acoeptance by the duperin- tendent ot Streets, he shall deduct from the deposit made, as herein required, the cost to the City of ilispection and supervision thereof. and such expenses as shall have been incurred by the 0i ty Enfineer' s department in connection wi th, said improvement. and the remainder of such deposit, if there by any, shall be re- turned to th~ person making the same upon d..ema.nds approved, audited and allowed, as in the case of other deffiands aeainst the City.. In the event that the estimated amount of the cost of in- spection and supervision of said improvement, and said City ~ngi- neer's expenses, shall prove to be insufficient, the Superintendent of streets may cause the work of ma.king- su.oh improvements to be otopped until such additional sum is deposited as will cover said cost, in which case it shall be unlawful to continue said work until such additional sum is deposited. The duperintend~nt of streets shall be given at least twenty-four hours' notice in writing of the time of co~~encenent of the work of making any improvement, permission to make which is granted hereunnerJ in order that he may procure and assi~n an inspector to inspec.:t the same; and in case the services of the City Engineer are required for l~ying out any portion of s~id work, twenty-fpurhours' notice shall be given said City I~nginEler of the time when such services shall be required; and. it shall be unlawful for any person as principal, aGent or contractor to commence any such work until after suoh notice has been f,iven. -. - - , . . ~" SECTION 3, It shall be the duty of the City 3ngineer to cause to be kept a just and true account of all expenses in- curred by his department in conneotion with said improvement. It shall be the duty of the Superintendent of Streets to caUSe suoh improvements made by or under private oontract to be duly inspected and supervised during the progress of the work thereupon and to cause to be kept a just and true acoount of the cost of inspection and Rupervision of such improvement; and otherwise to oarry out the provisions of this ordinanoe. SECTION 4. Any person ae principal, agent or contractor, who ahall violate any of the provisions of this ordinance, ahall be deemed puilty of a misdemeanor and upon conviction thereof shall be punishable by a fine of not to exceed One Thlndred Dollars (~lCO.OO), or by imprisonment in the city jail, for a period not to exceed thirty (30) days, or by both such fine and imprisonment, .".~ ,., 5.
