The Board of Trustees of the City of Vernon, as a measure of public health and of public safety in the use of the streets of said City. do ordain as follows: Section 1: The City of Vernon, its duly author- ized and licensed scavengers, as herein defined and pro- vided, shall have the exclusive right to gather and col- lect, and to remove, dump snd deposit, or otherwise dis- pose of, and to convey and transport in, upon and over any public street, allay. or other public place of said City, market refuse, combustible and non-combustible rubbish, and it shall be unlawful for any person, firm or corpora- tion, except as provided in this ordinance, to gather, collect or remove in the City of Vernon, or to oonvey or transport into or throngh said City~ in~ upon or over any public Btreet~ alley, or other public place thereof~ or to dump or deposit in or upon any place in said City, any market refuBe~ combustible or non-combustible rubb18h~ Section 2: For the purposes of this ordinance, the following definitions are adopted: .,-., 2. Vernon, in, UpOll, or over any public street, alley. or or non-combustible rubbish, in the City of Vernon, or who convays or transports into or through said Ci t,y of wise disposes of, any market refuse, combustible rubbish in this ordinance, is defined to be and shall be held to mean and include every person, firm, or corporation, who gathers, collects, removes, dumps or deposits, or other- cans and other metallic substances, and similar articles or substances, as will not cinerate thro~gh contact with fl~es of ordinary tem~erature. (d) The word "scavenger,r or "scavengers1T, as used to be and shall be held to mean and include such rubbish, composed of ashes, bottles, broken crockery, glass, tin through contact with flames of ordinary temperature. (c) The term "non-combustible rubbish" is defined composed of paper. paste-board, excelsior, carpets, rags, clothing, books, boots. shoes, straw packing, barrels, bOXes, furniture and similar articles, as will cinerate be and shall be held to mean and include such rubbish. (b) The term "combustible rubbish!' is defined to meat, fish, fruit and vegetables, from meat, fish, fruit and vegetable markets, and animal and vegetable refuse from such markets. shall be held to mean and include decayed and unsound. ~ (a) The term "market refuse" is defined to be and . ., . . . . . . . .' other -public -place of said Ci ty t an;y market refuse, com- bustible rubbish or non-combustible rubbish. f Seotion ~: It shall be unlawful for any sca.venger to gather, collect, remove, dum~, deposit, or otherwise dispose of, or to cause or permit to be gathered, collect- ed, removed, dumped, deposited, or otherwise disposed of, in the City of Vernon, or to conveyor transport into or through the City of Vernon, in, u~on, or OVer any public atreet, alley, or other public place of said City, any market refuse, combustible rubbish or non-combustible rub- bish without first applying for and receiving a permit therefor, in writing, from the Board of Trustees.. in the manner hereinafter provided; provided, however, that the proviSions o~ this section shall not apply to any person, firm or corporation with whom the City of Vernon may here- after enter into a contract for the removal, conveyance, or disposal of market refuse, combustible rubbish or non- combustible rubbish, or to any employe of such contractor. during such time as such contract shall be in force. Section 4: Any person, firm or corporation desir- ing to obtain a permit to gather, collect, remove, dwnp. deposit, or otherwise dis~ose of, market rafuse, combus- tible rubbish or non-combustible rubbish in the City, of Vernon, or to conveyor transport into or throu~h the 3. . . - ~ .. City of Vernon, in, upon or along any public street, alley, or other pul)lic place t shall file an application therefor, in writing. with the Board of Trustees of said City, which application shall be signed by the applicant and shall con- tain the address of such applicant; in such application, such applicant shall agree to obey and conform in all re- spects to all the ordinances of the City of Vernon now in force, or that may hereafter be adopted, and all regulations of the Board of Trustees of said City relative to the re- moval, disposal and conveyance of market refuse, combustible rubbish and non-combustible rubbish, and shall further agree that such applicant will dispose of, or will caUSe to be dis-poaed of, all market refuse, combustible ru.bblsh and non-combustible rubbish gathered, collected, or removed, in said City of Vernon, or conveyed or transported into or thraurrh said City, as hc~cin provided, at the place or dumping g-ro1.J..Ild designated by the Baerd of Trustees of said City. and Will not dispose of, and will not cause or per- mit to be disposed of, any of such market refuse, combus- tible rubbish or non-combustible rlwbish, at any place in said City other than said dumpine; erourJ.d, and will not sell or deli vel', and will not cause or permtt to be sold or de- livered, any of such market refuse, combustible rubbish or non-combustible rubbish, to any ~erson. firm or corporation that disposes of, or will dispose of the same, at any place in said City other than said City dumping ground. 4. ,. . ~. -;" . . Seotion 5: It ,~hall be unlawful for any scavenger, ~ holding a -permit issued pursuant to the provisions of this ordi:::mnce, authorizing him to r--ather, collect, renov8, dump, deposit, or otherwise dispose of, market refuse, com- bustible rubbish or non-combustible rubbish, in the City Of Vernon, or to conveyor transport into or through the Ci ty of Vernon, in, upon or over any public street, alley, or other public place, to deposit, unload or deliver, or to cause or suffer to be conveyed or transported for the pur~ose of depositing, unloading or delivering, to any place in said City other than said City dumpin~ ground, any market refuse. combustible rubbish or non-combustible rub- bish. ~ Section 6: He permit issued pursuant to the pra- visions of this ordinance shall be assigned or transferred, and no suoh permit shall be issued to extend to a later date than the t"irst day of Jannary next sucoeeding the date of the issuance of such permit. Seotion 7: In the event that any scavenger, hold- ing a permit issued p~suant to the provisions of this ordinance, shall violate, or shall cause or suffer to be violated, any condition of such permit, or any provision of this ordinance, or any provision of any other ordinance, or any regulation of the Board of Trustees of the City of Vernon, relating to or regulating- the colleotion, removal, oonveyanoe or disposal of market refuse, combustible rub- 5. 6. place of business, then at his place of residence, or by leaving such notice at the place of business of such scavenger, or at the place of residence of such scavenger, business of such scavenger, or if such scavenger has no , . Section 9: It shall be unlawful for any scavenger to remove, conveyor transport, or cause to be removed, conveyed or transported, any market refuse upon or along any -public street, alley, or other :!,)ublic place, except in water-tight vessels, receptacles, tanks or wagon-boxes, rnolmted on wheels; every such vessel, receptacle, tank or wagon-box when containing market refuse shal1 be secure- ~ ly arill tightly covered in such manner as to prevent the contents thereof or any oclor escaping therefrom; evor;; such vessel, receptacle, tank or wagon-box shall be thor- oughly oleaned daily and the same shall be disinfectec1 at least twice each week; every vehicle carrying such ves- sel, receptacle, tank or wagon-box shall be so loaded and driven that none of the contents thereof shall fall there- from; there shall be painted u~on each side of every vehicle containing any such vessel, receptacle, tank or wagon-box, the worJ,s Tfl,'larket Hefuse11", and the number of the permit issued therefor by the Board of Trustees pur- suant to the provisions of thi.s ordinance. all ire plain black letters and fie:ures not less than four inches in 8. . . - ~ ... ~ height on a white background. and the same shall be at all tirres plain and unobscuredj provided, however, that if aH.y -person, firm or corporation with whom tho 01 ty of Vernon may hereafter enter into a contract for the collec- tion, removal or disposal of market refuse shall obtain a permit pursuant to the provisions of this ordinance and shall remove, conveyor transport any such market refuse, such person, firm or corporation shall not, during such time as such contract shall be in force, be required to have painted on any vehicle belonging to such parson, firm or corporation and used for the conveyance of such market refuse, the words and fiGures required by this section, if such vehicle is marked and desiRnated in the manner required by such contract. Seotion 10: It shall be unlawful for any persor, firm or corporation to remove or convey, or to cause or permit to be removed or conveyed, any combustible rubbish Or non-combustible rubbish upon or along any ~lb]ic street, alley, or other public place except in strong, tight ves- sels, receptacles, tanks or wagon-boxes mounted on wheels; if it shall be or become necessary to build up the sides of the wagon above the bed, close fitting side and end boards shall be usedi every vehicle carrying any suoh vessel, receptacle, tank or wagon-box shall be so loaded and driven that none aT the contents thereof shall fall or be blown therefrom; there shall be painted upon each 9. .. . . - ~ .. ~ f side of every vehicle oontaining any 8uch vessel, recep- tacle, tank or wagon-box the word ~Rubbiah", and the nlunber of the permit issued therefor by the Board of Trus- teea pursuant to the provisions of this ordinance, all in plain black letters and fiRuxes not less than four inches in height on a white background, and the same shall be at all times plain and unobscured; provided, however, that if any person, firm or corporati.on with whom the City of Vernon may hereafter enter into a contract for the 0011eo- tion, removal or disposa.l of combustible rubbish or non- co~bustible rubbish shall obtain a permit pursuant to the provisions of this ordinance and shall remove, conveyor transport any suoh rubbish, such person, firm or corpora- tion shall not9 during such time as such contract shall be in force9 be required to have painted on any vehicle be- longing to such person, firm or oorporation and used for the conveyance of such rubbish, the words and fisures re- guired by this seotion, if such vehicle is marked and designated in the manner re~uired by such contract. Seotion 11: It shall be unlawful for any person, firm or corporation removing or conveying, or causing to be removed or conveyed, any market refuse, combustible rubbish or non-combustible rubbish, to fail, refuse or negleot to replace immediately in such vessel, receptacle. tank or wagon-box any such market refuse, combustible rubbish or non-combustible rubbish that shall ha.ve fallen 10. . . - '- . .. or shall have been blown therefrom in or upon any public I street. alley. or other 'punlic place. or in or upon any premises. Seot ion 12: It shall be unlawful for any person, firm or corporation to convey, or cause or permit to be conveyed, any combustible rubbish or non-combustible 1:"ub- bish in any vessel, receptacle, tank or wagon-box in which there is any market refuse or garbage, or in which any market refuse or garbage shall have been plaoed at any prior time, unless such vessel, receptacle, tank or waeon- box shall have been thoroughly cleaned and all market refuse and garbage removed therefrom befora any such rub- bish is placed therein. Seotion 1!l,: Nothing in this ordinanoe oontained shall be deemed to co~flict with or to repeal any portion of any ordinance regulating the collection, removal or disposal of garbage, but any such ordinance and this or- dinance shall each be so construed as to p,ive effect to every provision thereof and each shall be deemed to be independent of the other. Seotion 14: Any person, firm or corporation violat- ing any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be punishable by a fine of not less than Twenty-five Dol- lars (f:~25.00), nor more than Two Hundred and Fifty Dollars 11. 12. Section 16: The collection, removal and dumping, and the conveyance into and transportation upon and over the public streets, alleys, and other public places, in- discriminately and without regulation, of markct refuse, combustible rubbish and non-combustible rubbish, in the City of Vernon, ie hereby declared to be a nuisance, and this ordinance is declared to be urgently required for the protection of the public health and safety of said City. and upon this ordinance being certified and posted, as herein directed and provided, the same shall thereupon and thereafter take sffect and be in force. Section 15: There being no newspaper of general circulation published in the City of Vernon. the Clerk shall certify to the passage of this ordinance and post or cause the same to be posted in three (3) of the most pUblic places in the City of Vernon, tawit: the northwest corner of East 37th Street and Santa Fe Avenue; the northwest corner of gast 38th Street and Santa Fe Avenue; and at the entrance of the Vernon City Hall at the north- west corner of East 38th street and Irving street.
