That the right, privilege and :permission be a.nd the same 1E1 hereby granted The Atchison, Topeka and Santa Fe Railway Company, a corporation, its successors and aEsigne. to lay, oonstruct, maintain and operate a railroad spur track across 30th street, in the City of Vernon, County of ~ Angeles, 8tate of California. aE shown in y~~ow on blue-print attached, tre center line of which is more par- ticularly described as follows: Beginning at a point in the southern line of eaid 30th Street produced across the said Railway Company's right of way, distant 39,19 feet westerly, along said street line produoed from the said Rail~ay Company's eastern right of way line; thence northeaBterly 36.15 feet on a curve concave to the 6outbeaf't and having a radius of 287.94 feet; thence northeasterly 27,0 feet on a curve concave to t~e northwest and havin~ a radius of 287.94 feet to a point in the northern line of ~aid 30th Street, produced. distant 18.86 feet westerly along said Street line fron; the said ea6tern right of w~ line' Tangent to curve at said northern line o~ street intersects ea1~ street line at an angle of 74 degrees, 35 minutes. Section 2. The right. privilege and :permission hereby granted shall be exercised and enjoysd subjeot to the follow_ ing conditione: _2_ (A) That no cars or locomotives shall be permitted at any time to stand upon the etreet occupied b~l said spur track, except during the time actually employed in switching, and that said spur track shall at all times be used so as to obstruct the use of said street by vehicles or pa,8sengers I as 11 ttle as possible, consistent with the uses for whicb said spur track ip to be constructed. r (B) Tr~t said granteet ita BUccessore and aEsigns, shall con- struct all necessary flumes or culverts for the passage of wajer wherever and whenever necessary. and that all such flumes or culverts e~~l be constructed in accordance with the plane and specifications therefor approved b;y~ the City Engineer of the City of Vernon.. (c) That said grantee, its successore or a~~1gne, will pave and repave portions of the said street occupied by said spur track a.nd for a distance of two (2) feet on each side thereof, with the eame materials and undex the eame specifications and in the same manner as such street is now or may hereafter be paved or repaved, and that all such work shall be done unde~ the instructions and to the specification of the Board of Trustees of the City of Vernon. (D) That any neglect. failure or refusal on the part of the grantee, 'te successors or a:',s1gns, to observe or comply with any of the terms ar.d conditions of this ordinance contained, sball effect a forfeiture of the rigbt, privilege or permis- sion ~ereby granted. and the said City, by its Board of Trustees, may thereupon declare euch right and privilege forfeited. and may exclude from any further use of the street occupied by said spur track. and the grant hereby made shall tnereupon become and remain null, void and of no effect. (E) That the City of Vernon expressly reserves the right to sewer, repave or resewer said street acrose which the right to construct said railroad spur track is hereby granted, and ~o l~v gas, water. and other pipe therein, such work to be done so So:;:' to injure sa.id railroad as little as possible. (F) That no obstructions. whether its cars or rOlling stock or iteffi of any kind wha.tsoever, shall. by the said Rail~ay Compal~, for a period longe>> than three (3) ~ucoes6ive minuteB at ~ny one time, obstruct, hinder or delay traffic from paseing along and in the apace of aix (6) feet on either aide Of the oenter line of said 30th street, and at all times when said track is in use. the Railway Compa.l1Y shall keep, at its own expense, a flagman or signalman thereat for the ~ur9oBe of in- dicating, EUld who shall indicate to the public the fact tlJat said. track is in uf.le, and who shall do all such things as are nece86ary and proper to protect the public from danger or in- jury by reason of such use.
