An ordinance granting to the Southern Paci fi c Company. the
right, Drivileg€ and perrr~saion to p~ and construct a railroad spur
in the Ci ty of "'{ernon,
The Board of Trustees of the City of Vernon do ordain as
follows:
Section 1. That the right, :privilege and pet'missian be, and the
same is hereby granted to the Southern Pacific Railroad Cnm,anyJ a
corporati:m, i ts SUCCe~:'30r6 and assigns I to lay I constr'.lct I maintain
and operate a railroad spur track across Alameda St., in tbe City of
Vernon, County of Los Angeles, State of C~lifornia, oetween the points
heTel nafter desert bed to wi t:
J::Seginning at a point in the westerly right of way li!le of the
Sout11ern Pac! fi c Rai lroad Com:flany's San Pedro :Branch, said point being
located at a distance of 566.78 feet measured southerly alone said right
of way line from its intersecti on Wi th the center line of 55th Street.
prolongated easterly; thence northwesterly al~ng a curve concave to the

left, having 8. radLls of 449.51 feet, a distance of 54.10 feet to '-\ point
in the boundary line between the City of Vernon and the City of LOB An-
geles.
Section 2. That the spur track which may be laid and constructed
under the privilege hereby granted shall correspond to the official
grade and the street across or along which it may be placed, ~9 now es-
tablished by said Ci ty of Vernon; the tops of t:r~e rails to be flush
wi th the surrounding surface of the street, and in the event such street
shall be graded, paved or otherwise improved under the authority of said
City of Vernon, then such spur track over or upon such street and the
ground for a di stance of two (:-.::) feet on e~\ch Gide thereof, sha] l he by
grantee, or its a.ssigns r.:ade to conform to said grade. 9,nd shall be so
maintained by said Grantee, its successors or assignro, ;.vith the tops of
said rails flush with the surface of said street.
Section 3. The right, privilege, and per!illssion hereby granted
shall be exercised and enjoyed subject to the following conditions:

1st. That no cars or locomotives shall be per:ui tted at any
time to stand upon the streets occupied by said spur track except during
the time actually employed in 8vli tching, loading or unloadine; cars placed
thereon, and that Baid 9;pllr tra~k shall at all times be used so as to
obstruct the use of said streets and alleys by velli cles or passengers
as little as possible consistent \vith the usee for which said spur track
is to be constructed:
2nde That said e;rantee, :t ts BlicceS':lCrS and ~SSien6. shall
construct all nececs<J.ry flumes and culverts ::or the lJaSsa,:;e of water
under said track whenever or wherever necessary, and that all SUcl1 flu~es
or culverts shall be construoted in accordance wi th the plans and speci-
fi cati ons therefor, approved by the Ci ty Engineer of the Ci ty of Vernon.
3rd.. That said grantee, its successors and assigns, will
~lank and replank, gravel and regravel, ~ave and repave all portions of
the street occupied by said SpUT track, and for a di stance of two (2)
feet on each side thereof wi th the same ~naterial and under tl~e same
speci!'i ca.tions and in the S<.l.me manner as said streets and alleys are
now. or ::aay heree..fter "be :planked, 01' replanked, graveled or reRraveled,
paved or repaved, and that all such work shall be done under the in-
structions of, and to the satisfaction of the Board of Tru8tees of
t:i.e Ci ty of Vernon:
4th. That any neglect, failure or refusal on the ij3.rt of the
grantee, its successors and assigns, to observe or COL1};lly wi th any of
the terms or condi tions in this ordinance contained shall effect a for-
fei ture of the ri ght, Dri vi lege and :permi ssion hereby granted, and the
said City, by the Board of Trustees, may thereupon declare such rights
and pri vi leges forfei ted, and :nay exclude sai d grantee, its successors
and assigns, from any furtlier use of tIle streets ~.nd al1e:/5 occupied by
said spur track, 8.nd tl1e grant hereby made shall thereupon becol~e and
remain null, void and of no effect.
That the Ci ty of Vernon expressly reserves the right to
pave, macadar.li ze, sewer, or repave, remacadaJ':1.i ze or resewer said street
across whi ch the richt to construct said railroe,d spur track j s hereby
granted, and to lay gas, water and other pipes therein, such work to be
done so as to injure said railroad as little as possible.

Section 4. 'nmt said railroa.d cO:r.l.pany shall at -l;he ti:ne said spur
track is constructed, construct a crosaing acroBs, in and along said
Alameda Street at the place of crossing exhmding two feet from the
rails, the same class of pavement as the rest of the street, so as to
make a good and sufficient crossing for teams and wagons, and it and
its successors and assigns shall at all times while said spur track is
maintained, maintain said crossing in like good manner and failing there-
in the City of Vernon shall have the right to construct said croBsing
and maintain the same t and said railro'1..d company, its successors or
assigns, shall pay to the City whatever amount it shall have expended
to such construction and maintenance.
Section 5. The City Clerk shall certify t.o the :passage 0:': this
ordinance, and shall cause the same to be printed and pasted as re-
qui red by law.
