ORDAIN AS FOLLO"~:
Section 1. That the right, ~rivilege and permi65ion
be and the 8ame is hereby granted to The Atchison,Topeka and

Santa 'Fe Railway COIn})any, a. corporation. its successors and
assigns, to lay, oonstruct, maintain and operate a railroad
apur track across 26th street,in tne City of Vernon, County
of Los Angeles, State of Cali:':Jrnia as shown in red on the
attached blue-;print, the center line of which is mOI'e par-
ticularly described as follows:
Beginning at a point in the north line of said
East 26th Street, distant 182.51 feet easterly from the
seoond an~le point, in said street line, eaet of Boyle
Avenue; thence southwesterly 57.00 feet on a curve con-
cave to the southeast, having a radius of 398.94. feet to
a point in the south line of said East 26th Street, dist.
ant 145.60 feet west of the second angle point, in the
south line of said. East 26th Street, east of Boyle
Avenue.

!he rignt,privilege and permission hereby
granted shall be exercised and enjoyed subject to the follow-
ing conditione:

(A) That no care Or locomotives shall be l'lermi tted at
any time to stand upon the street occupied by said spur track
except during the time actually employed in switching, and
that said spur tracks ~hall at all times be used so as to ob-
struct the use of said atreet by vehicles or passengers, as
little a.s p06sible. consistent with the uses for which said
spur tracK is to be constructed,

(:a) That 8a.id. grantee, its successors or a.ssigns, snall
oonstruct a.ll necessary flumeB Or oulverts for the passage of
water Wherever and whenever necessary. and that all Buch flumes
Or culverts shall -be constructed in accordA.nce with the plana
a~d specifications therefor approved by the City hngineer of
~~e City of Vernon.

(C) Tnat said grantee, its euccessors or assigns, will
pave and repave portions of tIle said street occupied by said
spur track and for a distance of two (2) feet on each side
thereof, with the same materials and unuer the same specifi-
cations and in the sa.me mCl.nner as such street is now or Ll3.Y
herea.fter be paved or repaved,and th8,t all SUCll work shall "be
done under the instructions and to the specification of the
Board of Trustee8 of the City of Vernon.
(D) That any neglect, failure or refusal on tne part of
the grantee, its successors or assigns, to observe Or comply
witn any of the terms and conditione of tilis ordinance con-
tained, Bhall effect a forfeiture of the right, Frivileee or
permission hereby granted, and the said City, by its Board of
Trustees, may thereupon declare au.ch right and privilege for-
feited, and may exclude from any furtner use of the street
occupied by said spur tracKs,and the grant hereby made Shall
t.nereupon become and rellJain null, void Bnd 01' no effect.

(E) That ~~e City of Vernon expre55ly reaerves the right
to sewer ,repave or resewer said street QCr053 whicIl the right
to construct said railroad spur track io bereby granted,and to
lay gaB, water and other pipe therein, such work to be done ao
&s to injure said railroad as little as possible.
(F) That no obstructions, whether its cars or rOlling
stock or item of any kind Whatsoever, shall, by the said Rail-
way Company, for a period longer than three (3) Buccessive
minutes at anyone time. obstruct. hinder or delay traffic
from passing along and in the space of eix (6) feet on either
side of the center line of said 26th ~treet and at all times
When said track is in use, the Railway Company Shall ~eep
a.t its OV;TI expense,a flagma.n or signal mCin tnereat for the
purpose of indicating, and Who shall indicate to tne public
the fact that aaid trac~ 13 in use, ana who sh~ll do all SUCh
tnings as are necessary and ~roper to protect the public from
danger or injury by reason of such use.
