Section 1.
That the right, privilege and permis~ion be

construct, maintain and operate a. railroad spur track across 28th
Street, in the City of Vernon, County of Los Angeles, State 01'
Calij'ornia, as sho'Ym in red On blue print attached, the center line
of WhiCh is more particularly described ae follows:
Beginning at a point in the southern line of 28th
atreet, in the City of Vernon, Los AAt;eles County,
Calfornia, 34.19 feet eaaterly from the northeast corner
of Lot 19. Block E, Day Star Tract, measured along south-
ern line of Baid. 28th street; thence northerly 80 feet
to a lloint in the northern line of said 28th Street, 33.90
feet. easterly from the southeaBt corner of' Lot 20,Bloc.k:
D, Day Star Tract.
Section 2.
The right, privilege and perroiBBion hereby
granted. e.hal1 be exercised and enjoyed subject to the follo\ring
conditione.: .
(A). That nO Cars Or looomotivee. shall be :permitted at any
time to stand upon the street occupied by saiu spur track, exce~t
during tne time actually employed 1n switChing, and that said spur
track Shall at all times be used 60 as to obstruot the use of said
street by vehicles or passengers,as little as possible, consistent
with the uses for Which aaia spur track. 1s to be constructed.

(B) That said grantee l its 6ucceeeors or assigns, 5hall construct
all necessary flumes or culverts for the passage of water ~~erever
and whenever necessary. and tnat all such flumea Or culverts Shall
be constru.cted in accordance wi tn the plans and specifications
therefor approved by tne City Engineer of the City of Vernon.
(c) That said grantee, its successors or assigns, will pave and
repave :portions of the said street occupied by said spur trac,j( and
for a diatance of two (2) feet On each side therea:f, with the same
IIlaterialB and under the Bame specificat.ione and in the Bame manner
as such street is now or may hereafter be paved Or repaved, and
that all such work shall be done. under the instructions and to the
specifics,tien of the Board of Trustees of the eit;y of Vernon.

(D) 'l\hst any neglect, failure or refusal on tlH:l part of the
grantee, its succesSOrS Or aSfiigns, to obaer~e or comply with
any of the terms and conditions of thiG ordin8.nce contccined, shall
effect a forfeiture of the right, privilege ar ~ermission hereby
granted, and the 6a.id City, by its Board. of Trustees, may t.here-
upon declare such right and privileges forfeited, and may exclude
from any fUrther use of the street occupied by said spur track,
and the grHnt hereby made shall thereu~on become and remain null
void and of nO effect.

(F) fast no obstructions, Whether its cars or TOlling stock or
item of a~ kind Whatsoever, Shall, by the said RailWay C Offip any,
for a period longer than three (3) successive minutes at any Qne
time, obstruct, hinder or delay traI~f1c ironl pas8ing: p~long and in
the space of' six (6) feet on either aide of tne center line of
said 2.8th street, and at all timeD When said tra.ck is in use, the
Railway Company Shall ~eep, at its o~m expense, a flagman or
signalman thereat for the purpoae of indicating, and ,mo snaIl
indicate to the public the f",ct that said track is in use, and
Who shall do all such things a6 are ~eces6ary and proper to pro-
tect the public from danger or injury by rea.son of such use"

(G) There being nO newspa~er of general circulation publi5hed
and circulated in the City of Vernon, the Clerk is hereby direct-
ed to poet this ordinance in tnree of tne mo~t public places in
8aid City; to wit, the nor~hwest corner of 38th Street and ~anta
Fe Avenue, the northwest corner of 31th Street and Ja~ta Fe Avenue
and at the entrance oi the City Hall at the northwest corner of
36tfi Strest and Irving Street.
