4 fifty (50) feet along the line thereof, from sunset each day to
5 sunrise of the next day, until such excavation is entirely pre-

Section 8. Afte~ such excavation is commenced the work
9 of making :god refilline the same shall be prosecuted with due
10 diligence and so as not to obstruct. the street or other public
}! place or travel thereon more then is actually necessary therefore.
If the work is not so prosecuted or if the work of refilling
13 does not in the judgment of said Board comply with the tet'mB of this

14 ordinance, said Board shall notify the person, firm or corporat.ion
15 named in the permit that the work 1s not being prosecuted with due
16 diligence or that the refilling of, such excavation has not been
17 properly done, and shall require such person, firm or corporation,

19 diligent prosecution of such work, or properly to complete the
20 Bame as the case may be. Such notice shall be written or printed,

and shall be served personally or by leaving the same at the resl-
22
dence or place of business of such person, firm or corporation; or

if such persom, firm or corporation cannot be found, and such place
24
of business or residence is unknown, or is outside of tbe City of

Section 9. The said Board shall cause a statement showing
the amount due the city from every person, firm or corporation for
any work performed by the city pursuant to the provisions of this
ordinance to be mailed to every such person, firm or corporation
or to liis, its or their agent in said City of Vernon on or before
the l2th day of any month for sny snd all such work persormed dur-
ing the previous month. The amount due the city as known by any
such statement shall be paid by every such person, firm or cor-
poration, to the city on or befors the 25th day of the month in
which sny such statement is mailed herein provided. In case of
a special deposit, the balance shall be returned upon the exp1-
ration of one ~ear les3 the amount hereinbefore stated, which
shall be paid into the Street Repair Fund within thirty dsys
atter the street aurface has been replaced by the said Boa.rd.
Said City of Vernon shall deduct the cost of any work done and
all inspection fees or repairs made by the Board, as herein pro-
vided from any and all deposits than on hand belonging to or
that may hereafter be made by any person, firm or corporation
under the provisions of this ordinance.
Section 10. The decision of said Board as to the cost of
any work done Or repairs made by it under its direction, pursuant
to the provisions of this ordinance, shall be final and concl\.lsive
as to the cost thereof.
Section 11. All moneys refunded pursuant to the provision~
of this ordinance shall be paid upon demands audited and paid in

within 30 days sfter such abandonment, file in the office of the

of the pipe, conduit, duct, tunnel or other structure so abandoned.
Each map or set of maps filed pursuant to the provisions of this
section shall show in detail the location of all such pipes, oon-

to fail, refuse or neglect to file any map or set of maps at the

Section 17. That any person, firm or corporation vialat-
ing any of the provisions of thts ordinance shsll be deemed guilty
of a misdemeanor, and upon conviction thereof shall be punishable
by a five of not less tI'sn $10.00, nor more than $200.00, or by
imprisonment in the city jail for a period not to exceed thirty
(30) days, or by both such 1'lne 8nd imprisonment.

Each such person, firm or corpor~ticn shell be deemed

guilty of a separate offense for every day during any portion of
