An ordin~noe granting to the sout~ern Pacific Company, the
right_ pri~ilege and permission to lay and construct a railroad spur
tu.ok in the City of Vernon.
The Board of Truste's of the City of Vernon do ordain as
follows:
Section 1. That t.he right, privilege and permission be,
and the same is hereby granted to the Southern Paoific Railroad
Company, a oorporation. its successors and assigns, to l~, construct,
maintain and operate a railroad spur track on Center Avenu.. in the
City of vernon, County of Los Angeles, State of California, between
the pointe hereinafter described to w1t:-
beginning at a point in the center line of Center Avenue,
which point ia also in the easterly line and 8.5 feet northerly,
measured at right angle 1'1, from the southerly line of the A.G.Hewton
1.71 Acre Tract, as recorded Dec. 21, 1906, M.B. 11 P.136 L.A. Coun-
ty. Thenoe westerly along "aid center line of Center Avenue, a dis-
tanoe of 498 feet ~r. .r les8 to a point. Thence northwesterly
along a curve concave to the right, having a radius of 239.1? feet
and tangent to the last described course, a distance of 121.08 feet
to a point in the future north line of Center Avenue. whiCh point
measured easterly along said line is distant 139 feet more or leSH
from its intersection with the right of w~ line of Southern Pacific
Comp any .
Seotion 2. That the .pur traok which ~ be laid and
constructed under the privilege hereby granted shall correspond
to the official grade of the street &or... or along which it may
be placed, as now established by Said City of Vernon; the tops of
the rails to be flush with the surrounding surface of the street
and in the event such street mall be Iraded, paved or otherwiee',j,m.
proved under the authority of said City of vernon. then such. .pur
track over or upon 5uch street and the ground for a diBtance of two
feet on eaCh side thereof, anall be by grantee, or its assigns made
to confQrm to Baid grade. and shall be so maintained by said grantee,
.its successors or assigns. with the tops of said rails flush with
the surface of said street.

. .4J section 3. The right, privilege and pennie.ion hereby
granted ~lall be exercised and enjoyed subject to the following
oonditione.
let: That no cars or locomotives shall be permitted at any time
to stand upon the streets occupied by .aid spur track except during
the time actually employed in Bwit ching , loading or unloading care
placed thereon, and that said spur track Bhall at all times be UBed
~ it eo as to obstl~uct the use of said streets and alleys by vehicles
or passengers as little as possible consistent with the uaee for whioh
said spur track 1s to be con atrueted.
2nd: That said grantee, its successors and assigns. ~hall con-
struct all neeescary flwnee Rnd culverts for the passage of water
under said track whevever or Wherever necessary. and th&t all BU~~
flumee or culverts shall be constructed in accordance with the plane
~ ~ and s~ecifications therefor, a~proved by the City Engineer of the
ei ty of Vernon.
3rd: That said grantee, its successors and assigns, will plank

and replank, gravel Qnd regravel, pave and repave all portiona of the
street occupied by said spur track, and for a distance of two (2)
feet on each side thereof Witil the same material and under the same
specific~tions and in the same manner as said streets and alleys are
nmw. or may hereafter be planked or replanked, graveled or regraveled.
paved or repaved. and that all SUcll work shall be done under the
instruction!! of, a.nd to the satisfaction of the Board. of Trustees
of the City of Vernon.
4th: ~hat any neglect, ~ailure or refusal on the part of the
grantee. its succesaors and assigns, to observe or comply with any
of the terms or conditions in this or~lnance contains shall effect
a forfeiture of the right. privilege and per.miQslon hereby granted.
and the said city, by its Board of Trustees, ~ thereupon declare
such rigllts end privileges forfeited, and may exclude said grantee,
its 8ucceBSOrs and aeaigns, from any further use of the streets and
alley. oocupied by suid .pur traCk, and the grant hereby made shall
thereupon become and remain null, void and of no effect.

5th: That the City of Vernon eA~reBBly reserves the right to
pav&, macadamize, sewer, or repave, remacadamize or resewer said
street across whioh the right to construct said ra.ilroad spur tra.ck
1e hereby graDbed~ and to p~ gaB, wa.ter and other pipes therein,
auch work to be done eo ae to injure said railroad as little ae
po as i bl e.
Section 4. That said railroad company shall at the time Bald
spur track 1s constructed, construct a crossing aoross, in and along
said Center Avenue at the place of croBsing extending two feet from
the rails, the same class of pavement as the rest of the street, eo
as to ~ake good and oufflcient croBsing for teams and wagons, nnd
it and its successors and assigns shall at all times while Baid epur
track 18 maintained, maintain said crossing in like good rranner and
failing therein the said City of Vernon shall have the right to
construct said croBBing and maintain the same. and said railroad
company. ita successors or assigns, Shall p~ to the City whatever
amount it shall have expended to such construction ~d aa1ntenance.
Seotion 5. The City Clerk shall oertifY to the passage of
this ordinance, and shall cause the same to be printed 3nd pasted
as required by law.
