Section 1..
That the right. privilege and permission be and
the same is hereby granted to the Atchison. To~eka and Santa Fe
Railway CO:r.!Pany. a. corporation. its successors and assigns, to
lay, construct, maintain and operate Railro~d Spur Track across
East 26th ~~reet in ~le City of Vernon, County of Los Angeles.
State of California, as shown in red on blue print attached, the
center lines of which are more particularly desoribed as follows:
"Beginning at a point in the Northern Line of
Bast,26th Street, distant 557.52 feet westerly
thereon from the Southern Line of The A. T. & S. ~. Ry
Co'e. 100 ft. rlight of Way; thence southerly 40.04 ft.
on a direct line making a Northwesterly angle of 870261
with said Northern Line of East 26th Street to a point
in the southern Line of said street distant thereon,
549.38 ft. Westerly from the angle point in eaid South~
ern Line.. II

Section 2. ~he right, ~rivilege and permission hereby
granted. shall be exercised and enjoyed. subject to the follow.
ing condi ti ons..
la) ~hat no cars or locomotives shall be permitted at
a~ time to stand upon the streets occupied by said tracks exoept
during the time aotually employed in switching. and that said
tracks ~lal1 at all times be used eo as to obstruot the use of
said street by vehicles and passengers as little as possible con-
sistent with the use for whiCh said tra~k is to be constructed.

{b) That said grantee, its successors and assigns.
shall construct all necessary flumes, or culvert15 fo.r the pas--
eage of water wherever and Whenever necessary. and that all
such flumes or cu.lverts shall be dODstructed in aocordance with
the plans and specifications thereof aPl1roved by the City Engineer
of the City of Vernon..

40) ~hat said grantee, its successors or assigns,
wi~l pave and re-pave portions of said streets occupied b,y said
tracks and far a distance of two {2) feet on each side thereof,
with the same materials end under the same specifications and in
the same' mannor as such streets are now or may hereafter be paved
or re-paved, and that all such work shall be done under the instruct-
ions and to the ~eo1ficatione of the Board of Trustees of the City
of Vernon. and said roadbed shall at all times be kept in the of-
ficial grade of the City of Vernon.
\d) ~hat any neglect or refusal cn the part of tne
grantee. its successors or assigns) to observe or oomply with any of
the terms and conditions of this ordinance contained. shall effect
a forfeiture of the right, privilege or per.mission hereby granted,
and the said City by its Board of Trustees. may thereupon declare
such right and privilege forfeited. and may exclude from any further
use of the streets occupied by said track and granted hereby made
shall thereupon become and remain null, void and of no effect.
Ie) That the City of Vernon eXl1ressly reserves the
right to sewer. re-pave or re-Sewer said streets across which right
to construct said tracks is hereby granted, and to lay water and
other pipe- therein. such 'WOrk to be done so as to injure said
railroad as little as possible.
If) That no obstructions. whether its cars or rolling
stock or item of aqy kind. Wh atsoever. shall by the said Railway
Company for a period longer than three (3) suocessive minutes at any
time, obstruct, hinder or de~ay traffic from passing along and in
the space of six \6) feet on ei ther aide of the center linea of said
streets, and at all times when said tracks are in use, the Railway
Company shall keep at its own expense. a flagman or signalman thereat,
for the purpose of indicating. and who shall indicate to the public
the fact that said tracks are in use, and who shall do all such
things as are necessary and proper to protect the public from danger
or injury by reason of such use.
19) 'i'here being no news.paper of general circulation
published and circulated in the City of Vernon, the Clerk ie hereby
directed to certify to the passage of this Ordinance ann caUBe the
same to be 110sted in three of the most l1Ublic 111aces in the City of
Vernon, to wit: The northwest. corner of 37th Street, Santa Fe Avenue,
and the northwest corner of 38th Street and Santa Fe Avenue, and at
the entrance to the City Hall of said City. located at 4305 santa Fe
Avenue. and said Ordinance shall be in full force and effect thirty
days from and after the date of posting.
