AN ORDINANCE OF THE CITY OF VERNON A1mNDING
THE TITLE OF ORDINANCE NO. 299 OF THE CITY
OF VERNON ENTITLED "AN ORDINANCE OF THE CITY
OF VERNON REGULATING THE ~~ING AND REFILLING
OF EXCAVATIONS IN THE ~~KING OF FILLS IN
PUBLIC STREETS, ALLEYS, SIDEWALKS AND OTHER
PUBLIC PLACES IN SAID CITY" AND AMENDING
CERTAIN SECTIONS IN SAID ORDINANCE NO. 299
AND ADDING CERTAIN SECTIONS TO SAID ORDINANCE
NO. 29~ AND REPEALING ORDINANCE NO. 539 ENTITLED
"AN ORDINANCE OF THE CITY OF VERNON REG1JLATING
EXCAVA'llIONS IN PUBLIC STREETS AND PUBLIC PLACES
IN THE CITY OF VERNON, AND PROVIDING FOR THE
GRANTING OF PERMITS FOR Trm EXCAVATION, CONSTRDC-
TION~ OPERATION AND ~~INTENANCE OF TUNNELS AND
OTHE STRUCT1:JRES IN OR 1.mDER THE SURF'ACE OF'
PUBLIC STREETS AND PUBLIC PLACES AND PROVIDING
PENALTIES FOR THE VIOLATION OF TftIS ORDINANCEtI.
The Council of the City of Vernon do ordain as follows:
Section 1: That Ordinance No. 299 entitled "An
ordinance of the City of Vernon regulating the making and refilling
of excavations in the making of fills in public streets, alleys,
sidewalks and other public places in said City" be amended by amend-
ing the title thereof to read as follows: t'An Ordinance of the City
of Vernon regulating excavations and regulating the installation,
construction, repair, maintenance and/or removal of any tank, pipe,
conduit, duct, tunnel, viaduct, or other structure, on, upon, over
or under the surface of any public street or sidewalk or public
place in the City of Vernon, and providing for the issuance of per-
mits for the same, and providing penalties for the violation of this
Ordinance. If
Section 2: That Section 1 of Ordinance No. 299 be
amended to read as follows:
"Section 1: No person, firm or corporation
shall make, install, repair, maintain or remove any tank,
pipe, conduit, duct, tunnel, viaduct, or other structure, on,
upon, over or under the surface of any public street or side-
walk or public place, and no person shall make excavations in
or under the surface of any public street, sidewalk or public
place for the installation, repair or removal of any tank,
pipe, conduit, duct, tunnel, viaduct, or other structure,
or for any other purpose, without first obtaining a permit
therefor from the Council of the City of Vernon, and without
making, with the City Treasurer, a deposit covering the
cost of inspection and of restoring such public street, alley,
sidewalk or other public place to its original condition.
Said deposit shall cover all incidental expenses in connection
therewith as hereinafter provided."
Section 3: That Section 2. of said Ordinance No. 299
be amended to read as follows:
"Section 2. Any person, firm or corporation
desiring a permit to make, construct, erect, install, repair,
maintain or remove any tank, pipe, conduit, duct, tunnel,
viaduct, or other structure, on, upon, over or under the Sl~-
face of any public street or sidewalk or public place, or to
make excavations in or under the surface of any public street,
sidewalk or public place for the installation, repair or
removal of any tank, pipe, conduit, duct, tunnel, viaduct, or
other structure, or for any other purpose, shall make a written
application to the Council of the City of Vernon therefor, and
shall file said application in duplicate with the City Clerk of
the City of Vernon; said written application shall state and
contain, or have attached thereto:
(a) The name, residence or business address
of applicant;
(b) In detail, the purpose, location and
area of each excavation intended to be made and used;
(c) And have attached thereto a plat, in
duplicate, drawn to scale showing (l) the location
of each proposed excavation, (2) the dimensions
thereof, (3) a detailed drawing of any structure
proposed to be erected, constructed, maintained or

removed, (4) such other details as may be re-
quired by the Council of the City of Vernon to
be shown upon said plat. No plat shall be required
when excavations are to be made for (l) service
connections, (2) location of trouble in conduits or
pipes, or (3) making repairs thereto.
The applicant must show, for the purposes men-
tioned in the application, legal authority to occupy and use
the public street, sidewalk or public place wherein the ex-
cavation and/or structure is proposed to be made or constructed.
In an application for excavation for or con-
struction of a duct, tunnel, viaduct or other structure, it
shall be necessary to include the necessary surveying to estab-
lish lines and levels in conformity with the approved plan to
be filed with the City Clerk. No permit shall be issued, and
no work shall be allowed to be done until such lines and levels
have been established and indicated at the site of the work."
Section 4: That Section 3 of Ordinance No. 299 be
amended to read as follows:
"Section 3: It shall be unlawful for any
person, firm or corporation to make or cause to be made any
excavation, or to install or maintain, or to permit to be
installed or maintained any tank, pipe, conduit, duct, pole,
tunnel, sidewalk or other structure, in, on or under the
surface of any public street, alley, sidewalk or any other
public pla.ce at any location other than that approved by the
Board of Trustees of the City of Vernono"
Section 5: That Section 17 of Ordinance No. 299 be
amended to read as follows:
"Section 17: For the p1.:trpose of this Ordinance

the following words and phrases are defined: (a) 'public
street' shall mean and include a public street, public
easement, public right-of-way, public highway, public alley
or public road within the City of Vernon; (b) 'public place'
shall mean and include a public place, public square, public
park, public playground, public court, public building and
the grounds thereof, and all public grounds and places owned
or maintained by the City of Vernon.
Wherever in this Ordinance the word 'board'
or the words 'Board of Trustees' are used they shall be deemed
to mean the Council of the City of Vernon."
Section 6: That Section l8 of Ordinance No. 299 be
amended to read as follows:
"Section 18: Any person, firm or corporation
violating any of the terms or provisions of this Ordinance
shall be guilty of misdemeanor, and shall be subject to a fine
of not to exceed Three Hundred Dollars (~300.00) or imprison-
ment, or both."
Section 7: That a new Section 19 be added to said
Ordinance Noo 299 reading as follows:
"Section 19: All ordinances and parts of
ordinances in conflict with this ordinance are hereby repealed."
Section 8: That Ordinance No. 539 entitled "An
Ordinance of the City of Vernon regulating excavations in public
streets and public places in the City of Vernon, and providing for
the granting of permits for the excavation, construction, operation
and maintenance of tunnels and other structures in or under the surface
of public streets and public places, and providing penalties for the
viola.tion of this Ordinance" be and the same is hereby repealed.
Section 9: There is no newspaper printed and published

within said City of Vernon. The Clerk shall certify to the passage
and adoption of this Ordinance and to its approval by the Mayor, and
thereupon said Ordinance shall be posted by or under the direction
of the City Clerk in three public places in said City of Vernon, to
wit: on the bulletin board in the lobby of the City Hall of the
City of Vernon, 4305 Santa Fe Avenue, at the Northwest corner of
38th street and Santa Fe Avenue, and at the Northwest corner of 37th
street and Santa Fe Avenue. Said Ordinance shall be posted at least
two (2) weeks, whereupon said Ordinance shall take effect.
PASSED AND ADOPTED by the Council of the City of Vernon,
California, at a regular meeting of said Council held on the 15th
day of July, 1941.
