COUNCIL OF 'rEE CI'.e~'{ OF' VEHNON DOES ORDAIN AS FOLLOWS:
SECTION 1:
It shall be unlawful for any person, fir!!l or corporation,
either as owner, agent, lessee, employee, or otherwise, to dig,
excavate, separate, screen, or dredge for or remove any sand,
gravel, earth, rook, stone, or other minerals or substances
from any private property, within the corporate limits of the
City of Vernon, below the official grade of the nearest street
abutting upon said premises; or cause or allow to be dug, ex-
cavated, separated, screened, dredged, or removed, any sand,
gravel, earth, rock, stone, m:1.nerals, or other substances from
any private property within the corporate limits of the City
of Vernon below the official grade of t he nearest street abutting
upon said premises, without first securing a permit therefor
issued in the manner and upon the conditions hereinafter set
forth, except when and so far as may be necessar;;{ for the
erection, construction, and altel~ation of a building thereon,
pursuant to a building permit issued under the provisions of
such Ordinance of the City of Vernon regulating same, and
provided further that nothing contained in this section shall
be construed to prohibit or apply to ordinary and tlsua1 d lng

the planting" care and maintenance of trees, shrub, grass, or
other plants, or t he making, care and maintenance of alleys,
courts, or other bona fide improvements upon private property
within the corporate limits of the sa id City of Vernon.

SECTION 2:
Said application must be accompanied by an undertaking
with good and sufficient sureties to be approved by the City
Counc il of the City of Vernon which \.mdertakil1f~ s hall be
conditioned upon the payment in full to said City of Vernon,
not exceeding the amount of the undertaking, of the cost of'
keeping an",)r excavation made in connection VJitb. said proposed
vrork refilled concurrently as said VJork progresses in the
manner hereinafter provided; upon the conclLwion or cessation
or abandomrrent, said undertaking must be made to irmre directly
to the City of Vernon to the extent of the amount of money
to reimburse the Ci t;;r for any money expended in making such
refill not exceeding the amoLnt of said undertaking, and upon
the payment of the sum. of $25.00 which stun is hereby fixed
and declaX'ed to be the foe for the iSEJUance of this permit.
SECTION 3:
Upon the issuance of said permit the ap~licant must
direct and maintain a sufficient fence around said excavation
so as to protect the public from injury due to said excavation.
SECTION 4:
When said application is filed and fee paid toget"el"
with said undeX'taking and said undertaking has been approved
by the City Council sald City Council shall issue a permit to
the appllcant to do and carl'Y on the proposed work specified
in said application.
Provided, however, that said permit so issued shall in
no case authorize or sanction the making, causing or permitting
of any excavation in cO',",Lnection with said work tho. t shall
cause injury to any property adjoining said excavation and the
slope of said excavation shall at all times be maintained at
least on a ratio of 1-1/2 feet. horizontially to 1 foot
vertically for the protection of the persons en~loyed in
making said excavation; and further the issuing of said permit

dimensions hereinabove specified, to-wit, 250 feet in length
and 200 feet in width, it shall be unlawful fOI' any person,

There being no newspaper printed and circulated in
the City of Vernon, the City Clerk of said City is hereby

directed to certify to the passage and adoption of this

Ordinance by a vote of twe-t\dr'ds of a 11 the members of the
City Council of the City of' Vernon, and post, or cause to be
posted, in the said city, in three of the most public places
in sa:'Ld City, to-wit; the nOl'tiwast corner of 38th Street and
Santa Fe Avenue; and on the northwest corner of 37th Street
and Santa J.:'e Avenue; and on the bulletin board of the lobby
of the City Hall of the City of Vernon, located at 4305
