Definitions. As used in this ordinance, the follow- :tng words and phrases shall mean: "Black-out Signallf: A fluctuating or undLIlating signal of varying pitch for a period of tv'lO minutes duration sounded on a siren or sirens. "All-clear Signal": A continuous signal of two minutes duration at a steady pitch sounded on such siren or sirens. "Black-out Structure": Any area so enclosed that any illumination maintained or ex:tsting therein is not visible from any point outside such enclosure. SECTION II. Any person who, at any time subsequent to a black-out signal or warning by a dul:l author'ized person and prim' to the all-clear' signal next thereafter, effects or maintains any illumination or permits any illwnination under his control to be effected or maintained at any place withln the C:tty of Vernon save witb.in a black-out structure, shall be guilty of a misdemeanor. The provisions of this Section shall not apply in the following cases: (A) Illumination maintained by the armed forces of the United States in the course of duty, together with all vehicles with United States Government credentials indicatlnG the necessJ.ty of emergency movement. (c) Illu.-rnination maintained pursuant to permission granted by the Chief of Police of the City of Vernono Tr~ Chief of Police is hereby authorized to grant such permission when, and only when, he finds such permission necessary for the preservation of the public safety or the maintenance of peace or order, or when he has been specifically authorized to grant such permission by an officer of the United States Army, Navy or Marine Corps while acting within the scope of his authority, or when he is specifically authorized by the City Council of the City of Vernon. (D) All authorized emergency vehicles as defined in Sections 44 and 44.1 of the Vehicle Code of the State of California. (E) All vehicles being operated by members of the California State Guard while actually on duty. SECTION III. The Chief of Police is hereby authorized and directed to cause the sounding. of a black-out signal and of an all-clear signal when, and only when, the district in which the City of Vernon is located is notified so to do by the Air Force Inter- ceptor Com...'11and. SECTION Dl. Any person who shall operate a siren or other audible device in such a manner as to simulate a black-out signal or an all-clear signal, except upon order of the Chief of Police of the City of Vernon, sD~ll be guilty of a misdemeanor. Cl ~ 30 :r ., Z .. ... g j: .. biZ !::J ~:r 1 SECTION V. 2 Any illumination contrary to the provisions of 3 this ordinance constitutes a public nuisance and the same 4 rnay be summarily abated by any peace officer, highway patrolman 5 or fireman. Any structure may be entered by any peace officer, 6 highway patrolman or fireman, using reasonable force if necessary, for the purpose of abating such nuisance by extinguishing such 7 8 illumination. 9 SECTION VI. 10 Any person who, at any time subsequent to a black-out signal or warning by a duly authorized person and prior to the 11 12 all-clear signal next thereafter, is operating any motor vehicle, 13 shall forthwith bring such vehicle as far as possible to the 14 side of the street, road or highway off the main traveled portion thereof, and the operator of such motor vehicle, and the 15 16 operator of any street car, shall bring such motOl' vehicle or 17 street car to a stop clear of any crossing, intersection, fire 18 house, fire plug, hospital or other emergency depot or area, 19 and during said period of black~t shall extinguish all lights 20 therein or thereon, and such motor vehicle or street car shall 21 remain so situated during the period of black-out, unless directed 22 or ordered to move by a peace officer, highway patrolman or 23 fireman. 24 SECTION VII. 25 The provisions of every ordinance in the City and 26 27 every adrninistrative order made pursuant thereto, requiring any illumination to be maintained in conflict with this ordinance, 28 shall be deemed suspended during the period between any black-out signal and the next succeeding all-clear signalo During the 31 period of suspension of illQ~ination, all persons, firms or 32 corporations responsible, shall be charged with the duty of, and (3) 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 .<( " - 26 a Z ~o:: >- 0 o ~ ~ 0; 27 - it.J N (/)>-z'" <(Ill (/)~ ~ ~ u z ""<0::.. . 28 OUo","":.: bI .1- > 0 0:: U>I-""~<( ii: <(o~Q. 29 ~~>>-Illz :::E1-!:/'oO OoUgl- .(.? 30 :r III Z ... g j: biZ !::J 31 ~J: 32 shall furnish adequate guard service around any excavation or other place dangerous to the public in. lieu of lights, lanterns or other safety devices. SECTION VIII. Any person who shall violate any provision of this ordinance shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine of not exceeding Three Hundred ($300.00) Dollars or by imprisor.L.>nent in the City Jail or in the County Jail not exceedingtrn>ee months, or' by both such fine and imprisonment. SECTION IX. This ordinance is required for the irnuediate pre- servation of th,e public peace" health and safety, and the following is the statement of facts constituting such urgency: The United States is at Vla1'" and this city is :in great fmd continuing danger of air and other attack by the enemy. SECfr'ION X. If any provisjon of this ordinance or the application thereof to any person or circUTnstances is held invalid, such invalidity shall not affect other provisions or applications of this ordinance which can be given effect without the invalid provision ol" application, and to this end the provislons of this ordinance are decla~ed to be severable. SEC~:'ION XI. The City Clerk shall certify to the passage and adopt5..on of this ordinance and shall cuase the same to be posted in three (3) of the most conspicuou.s places within the City, to-wl t: the northeast co:r'ner of 38th Street and Sante Pe Avenue; and the northwest corner of 37th Street and Santa :t.e (4) 1 Avenue;' and on the bulletin boa:r'd in the lobby of the City 2 Hall of the City of Vernon, located at 4305 Sa.nta Fe Avenue 3 in said..
