ORDINANCE NO. 592
AN ORDINANCE OF THE CITY OF VERNON REGULATING THE USE AND
OCCUPANCY OF THE CITY STREETS OF SAID CITY.
THE CITY COUNCIL OF THE CITY OF VERNON DOES ORDAIN AS FOLLOWS:

Section 1.
It shall be unlaWlful for any person, firm
6 or corporation to make any excavation in or under the surface of
7 any public. street of the city of Vernon for the installation,
8 repair, or removal of any pipe or conduit without first obtain-
9 ing from the City Council of the City of Vernon a written cer-
10 tificate that such person, firm or corporation is entitled to
11 make such excavation, and making a deposit to cover costs of
12 inspection and of restoring such street to its original condi-
13 tion, together with the incidental expenses in connection
14 therewi the

Section 2. Before receiving such certificate, the
16 applicant must make a written application showing the name and
17 address of the applicant, the location and approximate area of
18 the proposed excavation, and the purpose for which the excava-
19 tion is to be made and used, together with a map showing such
20 location.

Section 3. The applicant upon the filing of the appli-
22 cation must show legal authority to occupy and use the public
23 streets.

Section 4. A public service corporation with legal

The City Council of the City of Vernon

1 to time affecting the location, size and depth of each excava-
2 tion in or under the streets of the City of Vernon, so as to
3 reduce the damage that may be caused to the public streets of
4 said City, and all excavations shall be subject to the direction
5 of the Superintendent of Streets, or other officers in control
6 thereof.

Section 6. No pipe or fittings used in the convey-
8 ing of water shall be laid in or under the public streets of
9 the city of Vernon which are manufactured from poor material
10 that may injure the surface of said streets, and all pipes and
11 fittings used in the transportation of whater shall be of a
12 character at least the equivalent to the pipe and fittings usad
13 by the City of Vernon in the operation of its .municipal water
15
14 system.
Section 7. Persons or corporations are permitted to
16 maintain a general deposit of $2500.00 in lieu of special depos-
17 its, for each excavation,with the City C]e rk of the City of
18 Vernon.

Section 8. Notwithstanding anything to the contrary
herein, any utility using the surface of the streets of the City
of Vernon, or any portion of the streets under the surface may
proceed without a permit or notice to the City or the Superin-
tendent of Streets, to make any emergency repairs as may be
necessary to safeguard persons or property within the City,
but notice and application for permit Shall be filed with the
City Clerk at the earliest practicable time after the comple-
tion of said emergency work.
Section 9. When, in the opinion of the City Council,
any portion of pipe or fittings beneath the street becomes untit
for the use intended, or is a menace to .the safety of the street
pavement or other improvements in or under the streets, the

1 person, firm or corporation owning or operating the utility
2 using said street shall upon notice reconstruct such mains or
3 portions thereof under the direction of the Superintendent
4 of Streets or other officer in control thereof. Any recon-
5 struction as to location, size and depth of such excavation
6 shall be designated by the ~uperintendent of Streets or other
7 officer in control thereof.

Section lO. All excavations made in the public
streets of the City of Vernon shall be safeguarded during
construction or reconstruction so as to protect the trench or
other excavation in the street at the cost and expense of the
person making such excavationo
Section ll.
Any person, fir., association or
corporation violating this ordinance, or any provision thereof,
shall be deemed guilty of a misdemeanor, and upon conviction,
shall be fined by a fine not exceeding $300.00, or by imprison-
ment not exceeding ninety (90) days, or by hoth such fine and
imprisonment.
Section 12. That the City Clerk of the City of Vernon
shall certify to the passage of this Ordinance, and shall cause
the same to be posted in three of the most conspicuous places
in the City of Vernon, to-wit: at the northwest corner of 38th St.,
and Santa Fe Avenue, the northwest corner of 37th Street and Santa
Fe Avenue, and the Bulletin Board in the lobby of the City Hall
of the City of Vernon, located at 4305 Santa Fe Avenue, in said
City; that this ordinance shall be in full force and effect
from and after thir,ty days from the date of posting.
ADOPTED AND APPROVED, this 4th day of December , 1945
