A CORPORATION AND ITS SUCCESSORS AND ASSIGNS. A FRANCHISE TO CONSTRUCT. MAINTAIN AND OPERATE TWO (2) SPUR TRACKS ACROSS AND UPON SOTO STREET IN THE CITY OF VERNON. TEE CITY COlmCIL OF THE CITY OF VERNON DOES ORDAIN AS FOLLOYffi: Seotion 1: Tha.b a franohise be and the same is hereby granted to I,os Angeles Junotion Rej.lway C01llpap...y. a oorpore.tion, its suocessors e.nd assigns, for a term of fifty (50) years, to lay, construot, maintain, use and operate two (2) railroad spur traoks upon and across Soto Street, in the City ot Vernon, County of Los Angeles, State of California, located alone respective center lines desoribed as follows: Traok No.1: Beginning at the point of interseotion of the easterly line of Soto Street and a line drawn parallel with and distant northerly 340.00 feet from the northerly line of Lot 16 of the 500 Acre Traot of the Los An~les Fruit Land Association; thence along the westerly pro- longation of said parallel line, 80.00 feet to the westerly line of said Soto Street. Traok No.2: Beginning at the point of intersec.tion of the easterly line of Soto Street and a line drawn parallel with and distant southerly 331.00 feet from the northerly line of Lot 16 of the 500 Acre Tract 01' the Los Angeles Fruit Land Assooiation.; 'l:;hence along the westerly pro- longation of s~id parallel line, 80.00 feet, to the westerly Une of said Sota Street. Section 2: That said spur tra.oks which may be laid and operated under this franohise shall be used for the transportation of freight only and not as any part of a main line; and shall be used solely for the purpose of reoeipt 8rl.d delivery of freight to and from conneotinG warehouses, manu- factories am other business industri"s and enterprises .wi th the me:i.n line of oonneccing railroad oomp8.ny or companies. Seotion 4: The right~ privilege and permission hereby granted shall be exeroised and enjoyed subjeot to the following conditions: (a) Tha.t no oars or loeomo.Uves shall be permitted at a.ny time to stand upon the street oooupied by s!\id spur tra.oks exoept during the time aotual1y employed in switohing; and tha.t said spur tracks shall at all times be used so as not to obstruct the use of said street by vehicles or pedestrians more than is neQessar,y, consistent with the uses for which said spur traoks are to be construoted. (b) That the said Grantee. its successors and assigns, shall oonstruct and maintain all flumes and culverts for passage of storJll _ters under said spur traoks whenever or wherever directed to do by the City Council of the City of Vernon, said construotion to be in aocordance with plans and speci- fications therefor approved by the City Engineer. Whenever a public storm water drain will have been con- structed in the ~nediate vioinity of said spur traoks, t}~ Grantee shall, if so directed by the City, remove any or all flumes and culverts theretofore construoted and replace same with standard oatoh basins oonneoting with said storm drain, said replaoement to be in aooordanoe wi~~ plans and speoifioations therefor approved by said City Engineer. I- w Z !: :J 31 ~I: 32 (d) That the said Grantee. its suocessors and assigns, shall, at its own oost and expense. repair, maintain, safeguard and support said spur traoks across or along the trench or other excavation in said street, during construotion or reconstruotion of sub-surface structures of any kind or desoription, the installation of ~ioh i8 being done under authority of City of Vernon. (e) That the said Grantee. its successors and assigns, shall at its own oost and expense, install, construct, maintain and operate all warning signs, bells, lights, traffio signals, electric track cirouits and/or any other safety device and appurtenanoes for the protection or oonvenience of vehioles and pedestrians in said street. whioh, at any time, by reason of the exeroise of the rights and privileges granted herein. mAy be ordered installed by any Public Body havin& the authority to order such installation, construoti9n, maintenance and operation. (f) That any neglect, failure or refusal on the part of the Grantee, its suocessors and assigns, to observe and/or oonply with any of the terms or oonditions herein oontained shall effect a forfeiture of the right, privilege and permission hereby granted, and the City, by its City Council, may there- upon declare such rights and privileges forfeited; and may exclude said grantee, its suocessors and assigns from any further use of said street oooupied by said spur traoks, and the grant hereby Jll9.de shall thereupon beoome and remAin null, void and of no effeot. Section 5a That the City of Vernon, in granting the right, privileges and permission herein contained, expressly reserves the right to grade, pave, lllllcadamize or regrade, repave and remaoadamize the street along and across which the said spur tracks are to be oonstruoted, and to construot and recon- struct subsurface structures of any and all kinds under said spur traoks. Seotion 6: That said spur traoks shall be operated andmaint"l.ined sub- ject to such other regulations and conditions as may be presoribed from time to time by the COlmoil of the City of Vernon. Section 7: That the City Clerk of the City of Vernon shall certify to the passage of this Ordinanoe, and shall cause the same to be posted in three of the most oonspiouous plaoes in the City of Vernon, to-wit. at the north- west corner of 38th street and Santa Fe Avenue) at the northwest corner of 37th Street and Santa Fe Avenue,; and on the bulletin board in the lobby ot the City Hall of the City of Vernon. looated at 4305 Santa Fe Avenue. in said City,; that this Ordinance shall be in full foroe and effect from and after thirty (30) days from the date of posting. B. Leonie, Inc., under authority of reservation of such right retained by the latter in the deed of conveyance of Soto Street to the City of Vernon. Since these ~ur track crossings will eventually be connected with respective drill tracks of the Los Angeles Junction Railway Company, it was suggested that it would be to the best interest of the City that a Franchise be granted to the latter, thus avoiding any divided responsibility as to their future maint- enance. J. B. Leonis, Inc., has agreed to such a program and I therefore submit herewith, for your approval, a proposed Ordinal ce No. 604 which would grant to the Los Angeles Junction Railway Company the right to maintain and operate two spur tracks across Soto Street on center line locations described as follows: Track No. 1 - Beginning at the point of intersection of the easterly line of Soto Street and a line drawn parallel with and perpendicularly distant northerly' 340.00 feet from the northerly line of Lot 10 of the 500 Acre Tract of the Los Angeles Fruit Land Association: thence along the westerly prolongation of said parallel line, 80.00 feet, to the westerly line of said Soto Street.
