ORDINANCE NO, 631
AN ORDINANCE OF THE CITY OF VERNON AMENDING THE LEGAL DESCRIP-
TION IN ORDINANCE NO. 624 OF THE CITY OF VERNON.
THE CITY COUNCIL OF THE CITY OF VERNON DOES ORDAIN AS FOLLOWS:
Section 1. Whereas, the City Engineer's office
has called to the attention of the City Council an error in
the legal description as set forth in Ordinance No. 624,
Section 2. Now, therefore, the City Council amends
the legal description as set forth in Section 1 of Ordinance
No. 624 to read as follows:
Beginning at a point in the southerly line of
said Vernon Avenue (40 ft. wide) , N. 88° 271 25" E.,
3.207 feet from the northeasterly corner of Lot 2,
Tract No. 3347, as shown on map recorded in Book 36,
page 84, of Maps, Records of said County; thence
northeasterly, and northerly on a curve concave to
the northwest having radius of 262.042 feet and with
center bearing N. 73° 481 38" W., from said point
of beginning, a distance of 34.520 feet, more or
less, to end of said curve in a point which bears
S. 81° 211 30" E., from center thereof; thence N.
8° 381 30" E., 6.629 feet, to intersection with the
northerly line of said Vernon Avenue.
Section 3. That the City Clerk of the City of Vernon
shall certify to the passage of this Ordinance, and shall cause
same to be posted in three of the most conspicuous places in
the City of Vernon, to -wit: at the northwest corner of 38th
Street and Santa Fe Avenue; at the northwest corner of 37th
Street and Santa Fe Avenue; and on the bulletin board in the
lobby of the City Hall of the City of Vernon, located at 4305
Santa Fe Avenue, in said City; thA this Ordinance shall be in
full force and effect from and after thirty (30) days from the
date of posting.

O R D E R
The Atchison, Topeka and Santa Fe Railway Company is
authorized to construct one spur track at grade across Vernon
Avenue, in the City of Vernon, Los Angeles County, at the
location described in the application, to be identified as a
portion of Crossing No. 2H -0.9. Applicant shall bear the entire
construction and maintenance expense. Construction shall be
equal or superior to Standard No. 2 of General Order No. 72,
without superelevation, and of a width to conform to the por-
tion of the street now graded, with tops of rails flush with
roadway and with grades of approach not exceeding two per cent.
Protection shall be by the existing Standard N;i. 1 crossing
sign, Standard No. 3 wigwag (General Order No. 75 -B), and
human flagman.
Within thirty (30) days after completion pursuant to
this order, applicant shall so advise the Commission in writing.
This authorization shall become void if rot exercised within

one year, unless time be extended, or if above conditions are
not complied with. Authorization may be revoked or modified
if public convenience, necessity, or safety so require.
The effective date of this order shall be twenty (20)

Referring to Ordinance No. 624, (An Ordinance Of
The City Of Vernon Granting A Franchise To John B. Leonis,
And His Successors And Assigns, A Franchise To Construct,
Maintain And Operate One (1) Spur Track Across And Upon
Vernon Avenue In The City Of Vernon),, adopted and approved
by the City Council on October 4, 1949, it has been brought
to our attention that a typographical error exists in the
map reference in the description of the center line of the
spur track.
The fourth line of said description in the Ordi-
nance reads, "Tract No. 3347, as shown on map recorded in
Book 36 ". The fourth line snould read, "Tract No. 3347, as
shown on map recorded in Book 36 ".
It is recommended that the opinion of the City
Attorney be obtained as to the proper procedure to correct
the error in the Ordinance.

WHEREAS, the City of Vernon in and by Ordinance No. 624
of the City Council of the City of Vernon, California, adopted
and approved October 4, 1949, granted to John 13. Leonia, his suc-
cessors and assigns, a franchise for a terra of fifty years to lay,
construct, maintain, use and operate one railroad spur track upon
and across Vernon Avenue in the City of Vernon, County of Los
Angeles, State of California, in the location therein partioularly
described, which said franchise ordinance was thereafter amended
in respect of the legal description set forth in Section 1 thereof
pursuant to Ordinance No. 631 of the City Council of the City of
Vernon, adopted and approved May 2, 1950; and,

The application of The Atchison, Topeka and Santa Fe
Railway Company, a corporation, 121 East Sixth Street, Los
Angeles, California, respectfully shows:
1. That communications in regard to this application
are to be addressed to its attorneys, namely, Robert W. Walker
and John J, Balluff, 448 Santa Fe Building, Los Angeles 14,
California,.
2. That the applicant's principal place of business
in the State of California is in the City of Los Angeles, County
of Los Angeles.
3. That applicant is a corporation, duly organized
and existing under the laws of the State of Kansas, as is shown
by a certified copy of its articles of incorporation on file
with your Honorable Commission and is engaged in the business
of a common carrier of freight and passengers in the State of
California.
4. That application is made pursuant to the provisions
of Section 43 of the Public Utilities Act of the State of
California.
5. That applicant desires to construct, maintain and
mperate one spur track in the City of Vernon, County of Los Angeles,
State of California, at the location and in the manner shown upon
the map and profile of Division Engineer's Drawing No. L•4..17696,

dated March 27, 1950, hereto attached and by reference made a
part hereof. The proposed crossing of Vernon Avenue is shown in
red.
6. That said crossing is required for the purpose of
serving an industrial tract,
7. That under Ordinance No. 624 dated October 4, 1949,
as amended by Ordinance No. 631 dated May 2, 1950, the City of
Vernon granted a franchise to John B. Leonis authorizing him
to construct and maintain said crossing. By an assignment dated
June 30, 1950, said authorization or franchise was assigned by
John B. Leonia to applicant. Attached hereto and made a part
of this application are copies of said ordinances and said assign-
ment.
8. That Said crossing will be protected by two standard
No. 1 highway crossing signs and, in the opinion of the applicant,
the amount of use of said track will not justify or reasonably
require the installation of any further or additional safety
devices or the adoption of any other protective measures beyond
the requirements of reasonable speed regulations and the proper
signals of approaching engines or cars,
WHEREFORE, your applicant prays that your Honorable
Commission make an order authorizing the construction, operation
and maintenance of said track as aforesaid.
