Ordinance No. 637ORDINANCE NO. 6 AN ORDINANCE GRANTING TO THE CITY OF LOS ANGELES AND THE DEPARTMENT OF.WATER AND POWER OF THE CITY OF LOS ANGELES A.PERPETUAL RIGHT, EASEMENT AND FRANCHISE, PURSUANT TO THE,PROVISIONS OF THE GOVERNMENT CODE OF THE STATE.OFCALIFORNIA, CHAPTER 14, ARTICLE 1, SEC' TIONS.39700, 39701 AND 39702, TO CONSTRUCT, OPERATE AND MAINTAIN ELECTRIC .LIGHT AND POWER, TRANSMISSION LINES ALONG, OVER, ACROSS AND UPON CERTAIN PORTIONS OF BANDINI BOULEVARD SOTO STREET AND EAST 26TH STREET.WITHIN THE CITY OF VERNON. The City Council of the City of Vernon does ordain as follows: Section 1. Pursuant to the request of The City of Los Angeles, through its Department of Water and Power, presented to the City of Vernon in accordance with a written request of June 16, 1950, there is hereby granted, under and pursuant to the provisions of Chapter 14, Article 1, Sections 39700, 39701 and 39702 of the Government Code of the State of California, a perpetual right, easement and franchise to construct, reconstruct, enlarge, operate, maintain and repair electric light and power transmission lines with every necessary appurtenance along, over and upon those certain streets within the City limits of the City of Vernon, as follows: Bandini Boulevard, between the northerly right of way line of the Flood Control Channel of the Los Angeles River and a line parallel therewith and distant northerly at right angles 160 feet therefrom, the approximate center line location is shown and indicated in red on Department of Water and Power Drawing No. C -5639. Soto Street, between the northeasterly right of way line of the Flood Control Channel of the Los Angeles River and a line parallel therewith and distant southwesterly at right angles 160 feet therefrom, the approximate center line location is shown and indicated in red on Department of Water and Power Drawing No. C -5640. East 26th Street, between the easterly right of way line of the Flood Control Channel of the Los Angeles River and a line parallel therewith and distant westerly at right angles 100 feet therefrom, the approximate center line location is shown and indicated in red on Department of Water and Power Drawing No. C- 5641; upon the following terms and conditions, to -wit: First: That all work and construction thereon will be perk formed in a good workmanlike, safe and efficient manner, and that said line will and at all times be maintained during the life of this permit in first class condition and repair, and so as not to con- stitute a menace to life or property, and no pole or tower shall be located within the street. Second: That reasonable precautions, according to good engineering practice, be taken at all times dur- ing the existence of said line to safeguard lives and property in the vicinity thereof. Third: That this right is granted in accordance with Chapter 14, Article 1, Sections 39700, 39701 and 39702 of the Government Code of the State of California, and it is understood that The City 66f Los Angeles and the Department of Water and Power of said City will exercise the rights hereby granted in accordance with said Chapter 14, Article 1. Fourth: That this right does not include the right to supply electric light or power to any person or corporation of industry within the city limits of the City of Vernon. Section 2. That the City Council of the City of Vernon hereby finds, after receiving evidence upon the subject, that the route de- lineated upon the map attached to said request on file as aforesaid, is feasible and practicable, and is located so as to interfere as little as possible with the uses of said portions of said streets. Section 3. The right to so use said street within the City limits of the City of Vernon is granted with the understanding that said use shall be so carried as to interfere as little as is consistent with reasonable operation of said lines with the use of said property by the City of Vernon, its successors and assigns. Whenever the con- struction, maintenance or operation of said power line shall involve damaging or removing any property or fixtures of said City of Vernon, its successors or assigns, said property and /or fixtures shall be re placed in as good condition as they were before being damaged or remov- ed as aforesaid. Section 4. A copy of this ordinance duly certified by the City Clerk of the City of Vernon, California, and forwarded to The City of Los Angeles, shall constitute the right and permission granted to said The City of Los Angeles as contemplated herein. Section 5. The City Clerk shall certify to the passage of this ordinance by a unanimous vote, and there being no newspaper of general circulation published and circulated in the City of Vernon, the City Clerk is hereby directed to cause the same to be posted in three public places in the City of Vernon, to -wit: at the entrance of the City Hall, the Northwest corner of 37th Street and Santa Fe Avenue and the Northwest corner of 38th Street and Santa Fe Avenue, and said ordinance shall be in full force and effect thirty (30) days from and after the date of posting.
