Ordinance No. 646 ORDINANCE NO. t t.I. b AN ORDINANCE PROVIDING FOR THE ISSUANCE OF BONDS OF THl1; CITY OF VERNON, STATE OF CALIFORNIA, IN THE SUM OF TWO HUNDRED SIXTY THOUSAND DOLLARS ($260,000.00) FOR THE PUR}OSE OF liCQUIRING, CONSTRUCTING AND CONPLErrING A CERTAIN REVENUE-PRODUCING MUNICIP~~L IMPROVEMENT, TO-l-JIT: WATERWORKS FOR SUPPLYING SAID CPI'Y AND ITS INHABI1Ih.Nl1S WITH WATER, INCLG'DING THE ACQUISITION AND C01~STRUC'I'ION OF WATER MAINS, CONDUITS, WELLS, PUMPING PLANTS, Pill'IPS, TANKS, AND ALL OTHER WORKS NECESSARY 'rHEREFOR. WHEREAS, the City Council of the City of Vernon, California, at an adjourned regular meeting held June 25, 1946, by a vote of more than two-thirds of its members, duly passed and adopted a resolution determining that the public interest and necessity demand the acquisition, construction and completion of a certain revenue-producing municipal improvement, to-wit: waterworks for supplying said city and its inhabitants with water, including the acquisition and construction of water mains, conduits, wells, pumping plants, pumps, tanks, and all other works necessary therefor; and WHEREAS, said resolution was duly signed by the Mayor of said City, and duly attested by the City Clerk thereof, on the said 25th day of June, 1946, and entered in the Book of Resolutions of said City, and a minute of the passage and adoption thereof made on the minutes of the meeting at which the same was passed and adopted, and WHEREAS, on the 9th day of JUly, 1946, the City Council of the said city, at a regular adjourned meeting, by a two-thirds vote of its members, duly passed and adopted 1 ~ an ordinance calling a Special Election to be held in said city on the 30th day of July, 1946, for the purpose of sub- mitting to the qualified voters of said city, the proposition of incurring an indebtedness and issuing bonds of said city in the sum of Two Hundred Sixty Thousand Dollars ($260,000.00) for the purpose of the acquisition, construction and comple- tion of a certain revenue-producing municipal improvement, to-wi t: waterworks. for supplying said ci ty and its inhabi- tants with water, including the acquisition and construction of water mains, conduits, wells, pumping plants, pumps, tanks, and all other works necessary therefor, which said ordinance was approved by the Executive of said city, to-wit: the Mayor, thereof, on the 9th day of July, 1946, and was duly posted in said city on the 9th day of July, 1946, and for two succeeding weeks thereafter, in three public places in the City of Vernon, to-wit: at the entrance to the City Hall of the City of Vernon, 4305 Santa Fe Avenue; at the Northwest corner of 38th Street and Santa Fe .Avenue; and at the North- west corner of 37th Street and Santa Fe Avenue, and WHEREAS, said election was held on the 30th day of July, 1946, as provided for by said ordinance calling said election and by law for holding municipal elections in said city, and the proposition of incurring the bonded debt, hereinbefore mentioned, received more than two-thirds of the votes of the qualified electors of said city voting at said election, and WHEREAS, all and singular the provisions of the Act of the Legislature of the State of California, entitled "An Act Authorizing the Incurring of Indebtedness by Cities, Towns and Municipal Corporations for Municipal Improvements 2 .~ -.-/ and Regulating the Acquisition, Construction, or Completion thereof" which became a law February 25th, 1901, and the acts amenda- tory thereof and supplementary thereto, including the Government Code as amended, and the general laws of the State of Calif- ornia relating to cities of the sixth class and the laws and ordinances of the City of Vernon, have been fully complied with so as to authorize the issuing of said bonds; and WHEREAS, the public interest and necessity demand that all of said bonds be issued and sold at the earliest practicable date; NOW, THEREFORE, the City Council of the City of Vernon does ordain as follows: Section 1. That bonds of the said City of Vernon in the sum of Two Hundred Sixty Thousand Dollars ("1.;260,000.00) be issued in accordance w~th the provisions of the Act of the Legislature of the State of California, entitled, "An Act Authorizing the Incurring of Indebtedness by Cities, Towns and Municipal Corporations for Municipal Improvements and Regulating the Acquisition, Construction or Completion thereofll, which became a law February 25th, 1901, and all acts, or parts of acts, amendatory thereof or supplementary thereto, including the Government Code as amended, and in accordance with the laws of the State of California and the ordinances and laws of the said City of Vernon, for the purpose of acquiring, constructing and completing a certain revenue-producing municipal improvement, to-wit: waterworks for supplying said city and its inhabitants with water, including the acquisition and construction of water mains, conduits, wells, pumping plants, pumps, tanks, and all other works necessary therefor. That such bonds shall be two hundred sixty (260) in number and shall be designated "Wa terworks Bonds, Election 19L~6li; said bonds to be issued in 3 the denomination of One Thousand Dollars ($1,000.00) each, and the principal and interest thereof shall be payable in lawful money of the United States; that they shall be dated October 1, 1951, and bear interest at a rate not in excess of five (5) per uentum per annum, payable semi-annually on the first day of October and the first day of April of every year. UNITED STATES OF AHERICA, STATE OF CALIFORNIA COUNTY OF LOS ANGELES CITY OF VERNON WATE.'RWORKS BOND, ELECTION 1946. VERNON, CALIFORNIA, October 1, 1951. On the first day of October (year of maturity) the City of Vernon will pay to the bearer at the office of the City Treasurer of the City of Vernon, in the City of Vernon, State of California, or, at the option of the holder hereof, at the banking house of the National City Bank, in the City of New York, State of New York, the sum or One Thousand Dollars with interest thereon at the rate or ( ) per cent per annum, payable 5 semi-annually, on the first day of October, and the first day of April, of each year, at the office of the City Treasurer of the City of Vernon, in Vernon, State of California, or, at the option of the holder hereof, at the banking house of the National City Bank, in the City of New York, State of New York, upon the presentation and surrender of the interest coupons hereto attached. Principal and interest payable in lawful money of the United States of America. This bond is issued in pursuance of the provisions of an Act of the Legislature of the State of California entitled "An Act Authorizing the Incurring of Indebtedness by Cities, Towns and Municipal Corporations for Municipal Improvements, and Regulating the Acquisition, Construction or Completion thereof" which became a law February 25, 1901, and all Acts, or parts of Acts amendatory thereof or supplementary thereto, including the Government Code as amended. It is further certified that all requirements of the Constitution en.d the laws of the State of California and of all Ordinances of the said City of Vernon, have been fully complied with by the proper officers in the issuing of this bond; that this issue of bonds has been authorized by the vote of two- thirds of the duly qualified electors of said city voting on the question of such issue at a special election duly and regularly called and held in said city on the 30th day of July, 1946, and that the total amount of this issue, together with all other indebtedness of said city, does not exceed the limit prescribed by the Constitution and laws of the state of California; that before or at the time of incurring the indebt- edness evidenced hereby provision has been made for the collection of an annual tax sufficient to pay the interest on such indebtedness as it falls due and also provision to consti- tute a sinking fund for the payment of the principal thereof on or before maturity. 6 IN WITNESS WEEREOF, the said City of Vernon has caused this bond to be signed by the Executive of the said municipality, to-wit; The Mayor of said City, and also by the Treasurer of said City, and to be countersigned by the Clerk of said City, and the corporate seal of said city to be hereto affixed and the said City has also caused the coupons hereto attached to be numbered consecutively and signed by the Treasurer of said City of Vernon. Treasurer of the City of Vernon Section 2. That the Mayor of said City, and the Treasurer of said City are hereby authorized and directed to sign all of said bonds, and the City Clerk of said City is hereby authorized and directed to countersign said bonds and to affix the corporate seal of said City thereto, and the Treasurer of said City is hereby authorized and directed to sign the interest coupons of said bonds and said bonds shall be delivered by said City Clerk to the said City Treasurer in such amounts as the City Council of said City may from time to time determine; and said City Treasurer is hereby authorized and directed to sign all the interest coupons of said bonds by his lithographed or engraved signature. Section 3. That the proceeds of the sale of said bonds shall be placed in the Treasury of said City to the credit of' a fund to be known as "Waterworks Bonds, Election 1946, Fundl1, and shall be applied exclusively to the purpose mentioned in this Ordinance, to-wit: to the purpose of the acquisition, construction, and completion of a certain revenue-producing muni- cipal improvement, to-wit: waterworks for supplying said City and its inhabitan~s with water, including the acquisition and construction of water mains, conduits, wells, pumping plants, pumps, tanks, and all other works necessary therefor. Section 4. That for the purpose of securing and providing for the payment of the principal and interest of said bonds, there is hereby created a fund to be known as "Waterworks Bonds, Election 1946, Interest and Sinking Fundll; that all the money which, from time to time, shall be placed in said fund shall be and is hereby set apart exclusively for the purpose of 8 meeting all sums coming due for principal and interest on all the aforesaid bonds which may be issued under the proceedings hereinbefore recited. That for the purpose of paying the . principal and interest of said bonds, the City Council of said City shall, at the time of fixing the general tax levy, and in the manner for such general tax levy provided, levy and collect annually each year until such bonds are paid, or until there shall be a sum in the Treasury of said City set apart for that purpose, a tax sufficient to pay the interest on such bonded indebtedness as it falls due, and also to constitute a sinking fund for the payment of the principal thereof on or before maturity. Said tax shall be in addition to all other taxes levied for municipal purposes, and shall be collected at the same tLme and in the same manner as other municipal taxes are collected, and forthwith, as collected, shall be turned over to and paid into said "Waterworks Bonds, Election 1946, Interest and Sinking Fund It, and be used for no other purpose than the payment of said bonds and accruing interest. Section 5. The City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same to be posted in three public places in the City of Vernon, to- wit: at the entrance of the City Hall of the City of Vernon, 4305 Santa Fe Avenue; at the Northwest corner of 38th street and Santa Fe Avenue; and at the Northwest corner of 37th Street and Santa Fe Avenue, and. thereupon and thereafter the same shall be in full force and effect. Passed and adopted by the City Council of the City of Vernon, California, and approved by the Mayor of said City, this 16 day of ~~ , 1951.
