Ordinance No. 647 ~. t e e ~ ORDINANCE NO. t~.7 AN ORDINANCE PROVIDING FOR THE ISSUANCE OF BONDS OF THE CITY OF \~RNON, STATE OF CALIFORNIA, IN THE SUM OF ONE HUNDRED THOUSAND DOLLARS ($100,000.00) FOR THE PURPOSE OF ACQUIRING, CONSTRUCTING jU~D COMPLETING A CERTAIN MUNICIPAL IMPROV~ffiNT, NAMELY, A BUILDING FOR MUNICIPAL PURPOSES, TO-WIT: A FIRE ENGINE STATION HOUSE, INCLUDING THE ACCUISITION OF FURNISHINGS THEREFOR A.ND FIRE APPARi,TUS FOR THE PREVENTION AND EXTINGUISHMENT OF FIRES~ WHEREAS, the City Council of the City of Vernon, California, at an adjourned regular meeting held June 25, 1946, by a vote of more than two-thirds of its members, duly passed and adopted a resolution determining that the public interest and necessity demand the acquisition, construction and comple- tion of a certain municipal improvement, namely, a building for municipal purposes, to-wit: a fire engine station house, including the acquisition of furnishings therefor and fire apparatus for the prevention and extinguishment of fires, and WHEREAS, said resolution was duly signed by the Mayor of said City, and duly attested by the City Clerk thereof, on the said 25th day of June, 1946, and entered in the Book of Resolutions of said City, and a minute of the passage and adoption thereof made on the minutes of the meeting at which the same was passed and adopted, and WHEREAS, on the 9th day of July', 1946, the City Council of' the said city, at a regular adjourned meeting, by a two-thirds vote of its members, duly passed and adopted an ordinance calling a Special Election to be held in said 1 e e ci ty on the 30th day of July, 19~.6, for the purpose of sub- mitting to the qualified voters of said city, the proposition of incurring an indebtedness and issuing bonds of said city in the sum of One Hundred Thousand Dollars ($100,000.00) for the purpose of the acquisition, construction and completion of a certain municipal improvement, namely, a building for municipal purposes, to-wit: a fire engine station house, including the acquisition of f'urnishings therefor and fire apparatus for the prevention and extinguishment of f'ires, which said ordinance was approved by the Executive of' said city, to-wit: the I1ayor, thereof, on the 9th day of July, 1946, and was duly posted in said city on the 9th day of J'uly, 1946, and f'or two succeeding weeks thereafter, in three public places in the City of Vernon, to-wit: at the entrance to the City Hall of the City of Vernon, 4305 Santa Fe Avenue; at the Northwest corner of' 38th Street and Santa Fe Avenue; and at the North- west corner of 37th Street and Santa Fe Avenue, and WHEREAS, said election was held on the 30th day of' July, 1946, as provided for by said ordinance calling said election and by law for holding municipal elections in said city, and the proposition of incurring the bonded debt, hereinbefore mentioned, received more than two-thirds of' the votes of the qualif'ied electors of said city voting at said election, and WHEREAS, all and singular the provisions of the Act of the Legislature of the State of California, entitled "An Act Authorizing the Incurring of Indebtedness by Cities, Towns and Municipal Corporations for Municipal Improvements 2 e e and Regulating the Acquisition, Construction, or Completion thereoflT vlhich became a law February 25th, 1901, and the acts amendatory thereof and supplementary thereto, including the Government Code as amended, and the general laws of the State of Calif'ornia relating to cities of' the sixth class and the laws and ordinances of the City of Vernon, have been fully complied with so as to authorize the issuing of said bonds; and WHEREAS, the public interest and necessity demand that all of said bonds be issued and sold at the earliest practicable date; NOW, THEREFORE, the City Council of the City of Vernon does ordain as follows: Section 1. That bonds of the said City of' Vernon in the sum of One Hundred Thousand Dollars ($100,000.00) be issued in accordance with the provisions of the Act of the Legislature of the State of California, entitled, llAn Act Authorizing the Incurring of Indebtedness by Cities, Towns and Municipal Corporations for Municipal Improvements and Regulating the Acquisition, Construction or Completion thereof", which became a law February 25th, 1901, and all acts, or parts of acts, amendatory thereof or supplementary thereto, including the Government Code as amended, and in accordance with the laws of' the State of' California and the ordinances and laws of the said City of Vernon, for the purpose of acquiring, constructing and completing a certain municipal improvement, namely, a building f'or municipal purposes, to-wit: a f'ire engine station house, including the acquisition of furnishings therefor and fire apparatus for the prevention and extinguishment of fires. That such bonds shall be one hundred (100) in number and shall be designated "Fire Engine Station House Bonds, Election 194611; said bonds to be issued in the denomination of One 3 e e 4 '- e e Bonds numbers 67 to 69 Inclusive on October 1, 1974; Bonds numbers 70 to 72 Inclusive on October 1, 1975; Bonds numbers 73 to 75 Inclusive on n 1, 1976; Bonds numbers 76 to 78 Inclusive on II 1, 1977; Bonds numbers 79 to 81 Inclusive on n 1, 1978; Bonds numbers 82 to 84 Inclusive on II 1, 1979; Bonds numbers 85 to 87 Inclusive on " 1, 1980; Bonds numbers 88 to 90 Inclusive on n 1, 1981; Bonds numbers 91 to 93 Inclusive on II 1, 1982; Bonds numbers 94 to 96 Inclusive on II 1, 1983; Bonds numbers 97 to 100 Inclusive on II 1, 1984; And said bonds shall be substantially in the following form, to-wit: NO. UNITED STATES OF J~1ERICA, STATE OF CALIFORNIA COUNTY OF LOS ANGELES CITY OF VERNON FIRE ENGINE STATION HOUSE BOND, ELECTION 19L~. VERNON, CALIFORltiA, October 1, 1951. On the f'irst day of October (year of maturity) the City of Vernon will pay to the bearer at the off'ice of the City Treasurer of the City of Vernon, in the City of Vernon, state of California, or, at the option of the holder hereof', at the banking house of the National City Bank, in the City of New York, State of' New York, the sum of One Thousand Dollars with interest thereon at the rate of ( ) per cent per annum, payable semi-annually, on the first day of October, and the first day of April, of each year, at the office of the City Treasurer of the City of Vernon, in Vernon, State of California, or, at the option of the holder hereof', at the 5 e e banking house of the National City Bank, in the City of New York, State of New York, upon the presentation and surrender of' the interest coupons hereto attached. Principal and interest payable in lawful money of the United States of America. This bond is issued in pursuance of the provisions of an Act of the Legislature of the State of' Calif'ornia entitled "An Act Authorizing the Incurring of Indebtedness by Cities, Towns and Nunicipal Corporations for l1unicipal Improvements, and Regulating the Acquisition, Construction or Completion thereofll which beca..."ne a law February 25, 1901, and all Acts, or parts of Acts amendatory thereof or supplementary thereto, including the Government Code as amended. It is further certified that all requirements of' the Constitution and laws of the State of California and of' all Ordinances of the said City of Vernon, have been ~ully complied with by the proper officers in the issuing of this bond; that this issue of' bonds has been authorized by the vote of two- thirds of the duly qualif'ied electors of said city voting on the question of such issue at a special election duly and regularly called and held in said city on the 30th day of' July, 1946, and that the total amount of this issue, together with all other indebtedness of said city, does not exceed the limit prescribed by the Constitution and laws of the State of California; that before or at the time of incurring the indebt- edness evidenced hereby provision has been made f'or the collection of an annual tax sufficient to pay the interest on such indebtedness as it falls due and also provision to consti- tute a sinking f'und for the payment of the principal thereof on or before maturity. 6 e e IN WITNESS WHEREOF, the said City of' Vernon has caused this bond to be signed by the Executive of' the said municipality, to-wit: The Mayor of said City, and also by the Treasurer of' said City, and to be countersigned by the Clerk of' said City, and the corporate seal of said city to be hereto af'fixed and the said City has also caused the coupons hereto attached to be numbered consecutively and signed by the Treasurer of said City of' Vernon. That interest coupons shall be attached to each of said bonds representing each installment of' interest to accrue on said bonds up to the maturity thereof, which said interest coupons shall be substantially in the following form, to-wit: No. On the first day of (month of maturity) A. D. (year of maturity) the City of Vernon, California, promises to pay to the bearer, at the office of the Treasurer of the City of Vernon, in said City of' Vernon, State of California, or at the option of the holder hereof, at the banking house of the National City Bank, in the City of New York, State of New York, the sum of (amount of' interest) Dollars, in lawful money of the United States of America, the semi-annual interest due on Fire Engine 7 e e ~ I Station House Bond, Election 1946, No. (number of bond to which coupon is attached). Treasurer of the City of Vernon. Section 2. That the Mayor of said City, and the Treasurer of said City are ,hereby authorized and directed to sign all of said bonds, and the City Clerk of said City is hereby authorized and directed to countersign said bonds and to af'fix the corporate seal of said City thereto, and the Treasurer of said City is hereby authorized and directed to sign the interest coupons of said bonds and said bonds shall be delivered by said City Clerk to the said City Treasurer in such amounts as the City Council of said City may from time to time determine; and said City Treasurer is hereby authorized and directed to sign all the interest coupons of said bonds by his lithographed or engraved signature. Section 3. That the proceeds of the sale of said bonds shall be placed in the Treasury of said City to the credit of a fund to be known as llFire Engine Station House Bonds, Election 1946, Fundtt, and shall be applied exclusively to the purpose mentioned in this Ordinance, to-wit: to the purpose of the acquisition, construction and completion of' a certain municipal improvement, namely, a building f'or municipal purposes, to-wit: a f'ire engine station house, including the acquisition of furnishings therefor and fire apparatus for the prevention and extinguishment of fires. Section 4. That for the purpose of securing and providing for the payment of the principal and interest of' said bonds, there is hereby created a fund tobe known as "Fire Engine Station House Bonds, Election 1946, Interest and Sinking Fund"; that all the money which, from time to time, shall be placed in 8 __.. __----.J e e said fund shall be and is hereby set apart exclusively for the purpose of meeting all sums coming due for principal and interest on all the aforesaid bonds which may be issued under the proceedings hereinbefore recited. That for the purpose of paying the principal and interest of said bonds, the City Council of said City shall, at the time of fixing the general tax levy, and in the manner for such [;eneral tax levy provided, levy and collect annually each year until such bonds are paid, or until there shall be a sum in the Treasury of said City set apart for that purpose, a tax sufficient to pay the interest on such bonded indebtedness as it falls due, and also to constitute a sinking fund for the payment of the principal thereof' on or before maturity. Said tax shall be in addition to all other taxes levied for municipal purposes, and shall be collected at the same tL~e and in the same manner as other municipal taxes are collected, and forthwith, as collected, shall be turned over to and paid into said "Fire Engine Station House Bonds, Election 1946, Interest and Sinking Fund", and be used for no other purpose than the payment of said bonds and accruing interest. Section 5. The City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same to be posted in three pUblic places in the City of Vernon, to-wit: at the entrance of the City Hall of the City of Vernon, L~305 Santa Fe Avenue; at the Northwest corner of' 38th Street and Santa Fe Avenue; and at the Northwest corner of 37th Street and Santa Fe Avenue, and thereupon and thereafter the same shall be in full force and effect.
