ORDINANCE NO. 658

AN ORDINANCE OF THE CITY OF VERNON REGULATING AND LICENSING
3 RESTAURANTS AND OTHER PLACES WHERE FOOD AND DRINK IS SOLD OR
OFFERED FOR SALE, AND REPEALING ORDINANCE NO. 406 OF SAID CITY.

5 THE CITY COUNCIL OF THE CITY OF VERNON DOES ORDAIN AS FOLLOWS:

Section 1:
It shall be unlawful for any person, firm
or corporation owning, controlling, leasing, acting as agent for,
8

conducting, operating or managing any restaurant, hotel, cafe,
boarding house, or other public place in the City of Vernon,
where food or drink is sold or offered for sale, or given away,
10

to conduct or operate, or to cause or permit such restaurant,
hotel, cafe, boarding house or other public place where food or
13
14
drink is sold, or offered for sale, or given away, or to sell or
offer for sale, ?r cause or permit to be sold, or offer for sale,
or to give away, or to cause to be given away, any food or drink
15
16
therein, or therefrom, without first applying for and receiving
a permit from the City Council of the City of Vernon so to do, in
the manner hereinafter provided.

Section 2:
Every applicant for such permit shall file
20 with the City Council, a written application which shall state the
21 name and address of the applicant. Such application shall also
22 contain a description of the property by street and number, where~
23 in and whereon it is proposed to conduct such,place; and if the
24
place whereon said food or drink is sold has no street number,
25
then such description that shall enable the same to be easily
found and identified.
Section 3:
If, after investigating and considering such
application, it shall appear to the City Council that the state-
ments made therein are true, that said place is connected with a

sanitary sewer, and that the other existing sanitary conditions
in such place comply with the provisions of this Ordinance in
force at the time such application is considered, and conform to

1 all sanitary regulations then in effect in the said City of
2 Vernon, the said City Council shall grant the permit applied for,
3 provided, however, that such permit shall be granted only for a
4 period of one year, and shall be renewed each year as long as
5 said party remains in possession and upon the express conditions
6 that it shall be subject to suspension by said City Council, in
7 its discretion upon proof to the satisfaction of said City Council
8 of a violation by the holder thereof, its employee, servant, or
9 agent, or other person acting with the consent or under his
10 authority, of any provision of any ordinance of the City of Vernon,
11 at the address of such restaurant, hotel, cafe, boarding house,
12 or other public place, or other address as stated in the applica-
13 tion for said permit. Notice shall be served at least five (5)
14 days prior to the hearing.

Section 4:
Said permit, so granted, shall be displayed
16 in a conspicuous place in such restaurant, hotel, cafe, boarding
17 house, or other public place where food or drink is sold or
18 offered for sale.
Section 5:
It shall be unlawful for any person, firm
or corporation owning, controlling, leasing, acting as agent for,
conducting, operating, or managing any restaurant, hotel, cafe,
boarding house, or other public place in the City of Vernon, where
food or drink is sold or offered for sale, or given away, or for
any manager, agent, servant, or other employee or, in any such
place, to keep, sell, or offer for sale food or drink, to be
eaten or drunk, any deleterious, unwholesome, impure, unhealthy~
unclean, corrupted, or adulterated substance, or to keep or main-
tain, or cause or permit to be kept or maintained, any such place
in an unclean or unsanitary manner or condition; the floors and
walls, and all parts of such place shall be kept clean and free
from any accumulation of dirt, filth, grease or smoke, and such

place shall be constructed so as to conform with the following

regulations;

No water closets or urinal shall be kept or maintained in
such place, the entrance of which is less than ten (10) feet from
4

any place where any article of food is kept, stored or prepared.
No room in which is located a water closet or urinal, shall be
7
8
ventilated through any room in which any article of food or drink
is kept, stored, or prepared, all doors leading to any portion of
such place or any room thereof into a toilet room, shall be kept
9

securely fastened and shall be provided with a spring or weight
adjusted to keep all doors closed, 'except when persons are passing
12
into or out of such toilet room.

Section 6: It shall be the duty of the Chief of Police
14
of the City of Vernon, or his deputy, to, and they are, and each
of them are hereby empowered to enter any and all restaurants,
hotels, cafes, boarding houses, and other public places mentioned
in this Ordinance, to examine and inspect any food or drink in
such places and to ascertain whether the same is deleterious,

unwholesome, impure, unclean, unhealthy, corrupt or adulterated,
and to ascertain whether any such restaurant, hotel, cafe, board-

ing house, or other public eating place is kept and maintained in
an unclean or unsanitary manner or conditiono

Section 7:
All articles of food offered for sale shall

be kept covered in such manner as to prevent flies, or other
insects or vermin from being upon such food.
Section 8:
Every person, firm or corporation conducting
any such restaurant, hotel, cafe, boarding house, or other public

eating place where articles of food or drink are kept or served,

whether same is cooked on the premises or not, shall pay a license
to the City of Vernon computed as provided in section 25.01 of
Ordinance No. 598 of the City of Vernon; and it shall be unlawful

1 for any person, firm or corporation to engage in the business
2 of selling food or drink in the City of Vernon, without first
3 securing, in addition to the permit hereinabove stated, a license
4 so to do.

Section 9: It shall be unlawful for any person, firm
or corporation to refuse to allow the Health Officer or any Deputy
Health Officer of the City of Vernon, the Chief of Police or any
Police Offier, appointed by him, for that purpose, to enter any
9
portion of any such restaurant, hotel, cafe, boarding house, or
10
other public eating place where articles of food or drink are kept
11
or sold, or to interfere in any manner with the examination or
inspection by said Chief of Police, or his duly appointed deputy,
of any such place where any article of food or drink is sold or
offered for sale therein.
Section 10: Nothing in this ordinance shall be con-
strued to interfere with the powers and duties of any duly and
regularly appointed milk inspector, meat inspector, or any similar
inspector as are now, or may hereinafter be appointed by any
lawful authority of the State of California.
Section 11: Any person who shall purchase any restaur-
ant, hotel, cafe, boarding house, or other places mentioned in
this ordinance, for which a permit had been obtained and is in
force at the time of such sale, may conduct and operate such
place under such permit for a period of not more than thirty (30)
days from and after the date of such sale; provided, that such
purchaser shall during the said period of thirty (30) days apply
for and obtain a permit in the manner provided by this ordinance.
Section 12: Any person, firm or corporation violating
any of the provisions of this ordinance shall be deemed gui1tt
ofa misdemeanor, and upon conviction thereof shall be punishable
by a fine not exceeding Five Hundred Dollars ($500.00), or by

1 imprisonment in the City Jail of the City of Vernon or the
2 County Jail of the County of Los Angeles, at the discretion of
3 the committing magistrate for a period not exceeding six (6)
4 months, or by both such fine and imprisonment.
5 Every person, firm or corporation violating any of the
6 provisions of this ordinanoe shall be deeMed guilty of a separate
7 offense for eaoh day during whioh, or any portion of whioh such
8 violation continues, and shall be punishable therefor as herein
9 provided.

Seotion 13: Ordinance Noo 406 of the City of Vernon
11 is hereby repealed, but licenses granted under said Ordinance
12 No. 406 and unexpired as of the date of this Ordinance are not
13 hereby canceled but shall remain in force, unless terminated in
14 accordance with the provisions of this Ordinance No. 658.

Section 14: There being no newspaper printed, pub-
16 lished and circulated in the City of Vernon, the City Clerk is
17 hereby directed to certify to the passage of this Ordinance and
18 shall post same, or cause same to be posted, in three of the
19 most public places in the City of Vernon, to wit: Northwest
20 corner of 38th Street and Santa Fe Avenue, the northwest corner
21 of 37th Street and Santa Fe Avenue, and the bulletin board in
22 the lobby of the City Hall of the City of Vernon, located at
23 4305 Santa Fe Avenue, in said City; that this ordinance shall
24
be in full force and effect from and after thirty days frOM the
date of posting.
ADOPTED AND APPROVED this 21st day of April 1953.
