It is not practicable to vacate the portion of E. 4-5th Street easterly of St. Charles Street for the reasons that Byron Jackson Company do not own all of the abutting property and certain facilities of Vernon Light and Power are located in the area in question. Having been advised of this condition, Byron Jackson Company have revised their request to include only easterly end of E. 46th Street as described above. This is covered in letter from Byron Jackson Company to City of Vernon, dated July 8, 1955, original of which is attached hereto, in which they state they are agreeable to making a reasonable payment for the vacation and also agreeing to grant an easement to The Pacific Telephone and Telegraph Company to meet their requirements. Orieinal letter is enclosed herewith fram The Pacific T. and T. Co., dated July 18, 1955, addressed to City of Vernon statin~ their company will not object to the vacating of the porticn of E. L~6th Street in question provided the purchaser of said vacated portion will grant The Pacific T. and T. Co. an easement in the form attached hereto. The legal description of the proposed easement has been checked in this office and found to be correct to provide for existing facilities of the T. and T. Co. The portion of East 46th Street proposed to be vacated has for many years been fenced off from the remainaer of the street and has not been used as a public thoroughfare. Its vacation at this time will not in any manner cause inconvenience to or change the travel habits of the public. Under the circumstances, I see no objection to the vacating of the portion of East 46th Street as described above, and! therefore, I recommend that such vacation be approved.
