ORDINANCE NO. 693
AN ORDINANCE OF THE CITY OF VERNON REGULATING AND LICENSING
SECONDHAND METAL DEALERS AND JUNK DEALERS IN THE CITY OF
VERNON AND REPEALING ORDINANCE NO. 478.
THE CITY COUNCIL OF THE CITY OF VERNON DOES ORDAIN AS FOLLOWS:
SECTION 1:
That "secondhand metal dealer" shall mean
any person. firm or corporation. having a fixed place of business in the
City of Vernon and engaged in conducting. managing or carrying on the
business of selling and/or buying. at wholesale or retail. any secondhand
metal.
SECTION 2:
That "junk dealer" shall mean any person..
firm or corporation having a fixed place of business in the City of Vernon.
and engaged in conducting. managing or carrying on the business of buy-
ing. selling or otherwise dealing in. either at wholesale or retail. any
old rags. sacks. bottles, cans. papers. metal or other articles commonly
~Ylown as junk.
SECTION 3:
That "buy form" shall be the name of, and
shall mean the form or forms furnished by the Vernon Police Department
to any secondhand metal dealer or junk dealer for the purpose of recording
and furnishing by the said dealers to the police department of the required
information relative to purchases. pledges or consignments. of secondhand
metal or junk.
SECTION 4:
That it shall be unlawful for any person~ firm
or corporation to engage in conducting. managing or carrying on the
business of secondhand metal dealer or junk dealer without first applying
for and receiving a permit therefor. in writing. from the City Council of
the City of Vernon. in the manner hereinafter provided.
SECTION 5:
Any person. firm or corporation desiring to
obtain a permit to carryon the business of secondhand metal dealer or junk
dealer shall file an application in writing therefor, with the City Council of

the City of VernonJ specifying the street and number of the place at which
said business is proposed to be conducted or carried on. Said application
shall be signed by the applicant and contain the address of said applicant.
SECTION 6:
That no permit to carryon the business of
a secondhand metal dealer or junk dealer within the City of Vernon shall be
granted by the City Council to any person. firm or corporation who fails.
refuses or neglects to comply with the laws and ordinances relating to the
business for which said permit is sought. The City Clerk of the City of
Vernon shall not issue any license to any person. firm or corporation to
conduct or carryon the business of a secondhand metal dealer or junk
dealer until the City Council of the City of Vernon has authorized him to
issue a permit therefor. as provided :for in this ordinance.
SECTION 7:
That in the event any person, firm or cor-
poration holding a permit to conduct or carryon the business of a second-
hand metal dealer or junk dealer shall violate. or cause or permit to be
violated. any of the provisions in this ordinance. or any provision of any
other ordinance. or of any law relating to or regulating such business. or
shall conduct or carryon such business in an unlawful manner, or shall
cause or permit such business so to be conducted or carried on. it shall
be the duty of the Chief of Police to recommend to the City Council of the
City of Vernon the revocation of said permit. and the City Council of the
City of Vernon may, after hearing. revoke the permit issued for conduct-
ing or carrying on such business.
If the permit held by any person. firm
or corporation conducting or carrying on any business under the provisions
of this ordinance shall be revoked. no permit shall be granted to such
person, firm or corporation to conduct or carryon any such business within
six (6) months after such revocation. No permit shall be revoked until a
hearing thereon has been had by the City Council in the revocation of said
permit. notice of which hearing shall be given in writing and served at
least three (3) days prior to the date of hearing upon the holder of said
permit, or his manager, or agent. or person employed in the place of
business of said holder. This notice shall state the grounds of complaint

against the holder of said permit or against the business carried on by
said holder. and shall state the time and place where said hearing shall
be held. Said notice shall be served upon the holder of said permit by
delivering the same to such person or his manager, agent or any person in
charge of. or employed in the place of business of. said holder. If the
holder of the permit cannot be found. and service of said notice of hearing
cannot be made upon him in the manner herein provided. then a copy of
said notice shall be mailed. postage fully prepaid. addressed to said holder
of such permit at such place of business. or at the place of residence given
in the application for permit. at least three (3) days prior to the date of
said hearing.
SECTION 8:
That within forty-eight (48) hours after the
receipt of any secondhand metal or junk by purchase, consignment or pledge.
recipient shall cause to be mailed or delivered to the police department of
the City of Vernon a Buy Form written in the english language and completed
in every respect as indicated on said Buy Form.
SECTION 9:
That no person shall sell. alter. dispose of
or remove any articles required by the terms of this ordinance to be re-
ported to the police department in the above-described manner until released
by the police department of the City of Vernon.
SECTION 10:
That the provisions of Sections 8 and 9 of
this ordinance shall not apply to the purchase of articles from a business
licensed under the provisions of this ordinance. when seller has complied
with the provisions of this ordinance.
SECTION 11:
That Ordinance No. 478 of the City of Vernon
is hereby repealed. All ordinances or parts of ordinances in conflict here-
with are hereby repealed.
SECTION ~2:
Any person violating any of the provisions of
this ordinance shall be deemed guilty of a misdemeanor. and upon conviction
thereof shall be punishable by a fine of not more than $500.00. or by im-
prisonment for a period of not more than six (6) months in the County Jail
of the County of Los Angeles. or in the City Jail of the City of Vernon, as

SECTION 13:
There being no newspaper of general circula-
4 tion printed. published and circulated in the City of Vernon. the City Clerk
5 is hereby directed to certify to the passage of this Ordinance. and shall
6 post same. or cause same to be posted. in three of the most public places
in said City. to wit: The northwest corner of 38th Street and Santa Fe
Avenue; the northeast corner of Leonis Boulevard and Pacific Boulevard;
and on the bulletin board in the lobby of the City Hall of said City. located
at 4305 Santa Fe Avenue. all in the City of Vernon, Los Angeles County,
California.
This ordinance shall be in full force and effect thirty (30)
days from and after the date of posting.
