AN ORDINANCE OF THE CITY OF VERNON CONSENTING TO ABANDON-
3 MENT IN PLACE OF CERTAIN INDUSTRIAL LEAD TRACKS AND
APPURTENANCES.. REPEALING A PORTION OF ORDINANCE NO. 130
4 AND APPROVING AN AGREEMENT RELATING THERETO.

THE CITY COUNCIL OF THE CITY OF VERNON DOES ORDAIN AS FOLLOW
SECT ION 1:
The abandonment of certain industrial lead
8 tracks and appurtenances described in the Agreement related in Section 2
9 hereof is hereby approved.
SECTION 2:
The Mayor of the City of Vernon shall execute.
on behalf of the City of Vernon. and the City Clerk shall attest to such
signature. an agreement with Union Pacific Railroad Company in words and
figures as follows:
"THIS AGREEMENT # made and entered into this 20th day of
August. 1957. by and between the City of Vernon. a municipal corpora-
tion. hereinafter referred to as tCityt. and the LOS ANGELES &
SALT LAKE RAILROAD COMPANY. formerly San Pedro. Los Angeles
& Salt Lake Railroad Company. and its Lessee. UNION PACIFIC
RAILROAD COMPANY. corporations of the State of Utah. hereinafter
collectively referred to as 'Company';
WITNESSETH:
"For and in consideration of the mutual covenants. promises
and conditions contained herein and the release by City of Company
of all obligations arising out of Franchise Ordinance No. 130 as said
obligations attach to the property hereinafter described. the parties
agree as follows:
L Company hereby assigns all its right, title and interest
in and to those certain industrial lead tracks and appurtenances
located in and along 28th Street. formerly known as Joy Street. to
the City of Vernon; said tracks being more particularly described
as follows:

"Commencing at a point on the center line of 28th
Street 1280 feet more or less east of the easterly

line of Santa Fe Avenuel said point being Engineer
station 90 plus 00.8 of the Vernon industrial spur
owned by the Los Angeles and Salt Lake Railroad
Company and served by its lessee. Union Pacific
Railroad Company; thence west along center line of
28th Street 550 feet more or less to the easterly line
of the A. T. & S. F. R. Company's right of way at
Engineer station 95 plus 50 of said spur.
"2. City hereby relieves Company of any and all obligations arising
out of or contained in Franchise Ordinance No. 130 as said obligations
attach to the above described grant.
IN WITNESS WHEREOF, the parties hereto have
executed this agreement the day and year first above written. "
SECTION 3:
That portion of Ordinance No. 130 hereinabove

14 described in Section 2 is hereby repealed.
SECTION 4:
There being no newspaper printed, published
16 and circulated in the City of Vernonl the City Clerk is hereby directed to
17 certify to the passage of this Ordinance and shall post same, or cause same
18 to be posted. in three of the most public places in the City of Vernon. to wit:
19 The northwest corner of 38th Street and Santa Fe Avenue; the northeast
20 corner of Leonis Boulevard and Pacific Boulevard; and on the bulletin board
21 in the lobby of the City Hall of said City, located at 4305 Santa Fe Avenue.
22 all in the City of Vernon" Los Angeles County. California; that this ordinance
23 shall be in full force and effect thirty (30) days from and after the date of
24 posting.

Honorable Sirs:
Ordinance No. 130 of the City of Vernon,
dated June 16, 19l~, grants to San Pedro, Los Angeles
and Salt Lake Railroad Company, and to its successors
and assigns, a franchise for a period of fifty years
for an industrial lead track across various streets in
the City of Vernon, 1ncluding approximately five hundred
fifty feet in the easterly end of 28th Street (formerly
known as Joy Street).
The Railroad Company has no further use
for the track located in 28th Street and 1s willing to
abandon the franchise granted by Ordinance No. 130
insofar as that portion of the track is concerned. The
track in question is described as follows:
'Commencing at a point on the center line of
28th Street, 1280 feet more or less east of
the easterly line of Santa Fe Avenue, said
point being Engineer station 90 plus 00.8
of the Vernon industrial spur owned by the
Loa Angeles and Salt Lake Railroad Company
and serviced by its lessee, Union Pacific
Railroad Company; thence west along center
line of 28th Street 550 teet more or less to
the easterly line of the A.T~.F.R. Company's
right of way at engineer station 95 plus 50
of said spur.'
Enclosed you will find a map showing the
portion of the Vernon industrial spur track proposed to

be retired.

This company will abandon the track in
place, as is, relinguishing all right, title and interest
therein, to the City or Vernon, including rails, ties
and other track material.
