Ordinance No. 740 :1 II I, i[ I' 'I Ii I' ,I II 111 2\ ORDINANCE NO. 740 ~ .J AN ORDINANCE OF THE CITY OF VERNON FIXING THE RATES TO BE CHARGED FOR ELECTRICAL ENERGY DISTRIBUTED AND SUPPLIED BY THE SAID CITY O:F VERNON WITHIN 1'1'S BOUNDARIES. 1.1 '" ...J 6 THE CITY COUNCIL OF THE CITY OF' VERNON DOES ORDAIN 7 AS }'OLLOWS: 8 SECTION I 9 The said City Council hereby finds that the immediate 10 preservation of the public health and safety requires this 11 ordinance to be passed as an urgency measure and as such shall 12 take effect immediately upon the passage thereof by the City 13 Council. The following is a declaration of the facts con- 14 stituting the urgency. 151 The City of Vernon is the owner of a retail electrical 16 distribution system within its boundaries, which system has been 17 and now is operated by Southern California Edison Company pursuant 18 to a written agreement. Said agreement expires on December 31, 19 1961. Attempts to negotiate a further agreement with Southern 20 21 22 23 24 25 26 27 28 29 30 31 32 California Edison Company have been unsuccessful and by letter dated December 19, 1961, Southern California Edison Company informed the Mayor and City Council of the City of Vernon that I I I \ ! I i I I I I Said electrical distribution system and its orderly I operation are vital to the health and safety of the City of vernon,1 I I It is there- ! all previous offers of said company with respect to the operation of said electrical system were withdrawn, and that the most recent offer of the City of Vernon was unacceptable to Southern California Edison Company. It therefore appears that on, or shortly after, January 1, 1962, the City of Vernon will receive possession of said electrical distribution system. its inhabitants and the places of business therein. fore urgent and necessary that the rates to be charged and -1- 10 11 12 'I 'i I! il Ii II II I' .11 1. II Ii 2\1 'I; Iii vI I 1 I, I-:J; Ii 511 61 I 71 all 911 collected, and the terms, provisions, conditions, rules and regulations respecting the distribution of electrical energy be enacted and in effect on or before January 1, 1962. SECTION II The rates to be charged and collected, and the terms, provisions, conditions, rules and regulations respecting the distribution of electrical energy supplied by the City of Vernon on and after January 1, 1962, are hereby fixed as, and shall be those rates, terms, provisions, conditions, rules and regulations set forth in a certain document entitled "Tariff Schedules Applicable to Electric Service of Southern California Edison 13 December 27, 1961. Provided, however, that nothing contained in Compan~1 filed with the City Clerk of the City of Vernon on 14 15 16 17 18 19 20 21 22 23 241 I 25 26 27 28 29 30 31 32 this ordinance shall be deemed to incorporate herein by reference, or imply that all of said above-mentioned "Tariff Schedules Applicable to Electric Service of Southern California Edison Company" is hereby made a part of this ordinance, and the matters incorporated herein by reference are limited to rates charged for electrical energy and rules affecting customers and matters related, and provided further that any provision therein relating to the exercise of jurisdiction by the Public Utilities Commission of the State of California shall be deemed to refer to and mean the City Council of the City of Vernon. SECTION III The City Clerk of the City of Vernon is hereby directed to keep and maintain three (3) copies of the above-mentioned "Tariff Schedules Applicable to Electric Service of Southern California Edison Company" in the office of the City Clerk of the City of Vernon, and make said tariff schedules available on request for examination in said office.
