1 ORDINANCE NO. 763
2 AN ORDINANCE OF THE CITY OF VERNON, REPEALING ORDINANCE 412"
AND ESTABLISHING CONDITIONS AND REG ULA TIONS FOR THE ISSUANCE
3 OF A PERMIT FOR EXPLORATORY OIL AND GAS DRILLING.
4 WHEREAS.. the City Council of the City of Vernon finds it necessary
5 to establish regulations.. conditions.. and supervision prior to the issuance of a
6 permit for exploratory oil and gas drilling within the City limits to promote the
7 public health.. safety.. and general welfare in the City of Vernon;
8 NOW.. THEREFORE.. THE CITY COUNCIL OF THE CITY OF
9 VERNON DOES ORDAIN AS FOLLOWS:

SECTION 1:
DEFINITION.
11 An exploratory well is a hole drilled for the purpose of obtaining
12 information with no intent to produce or test produce oil" gas.. petroleum.. or
13 other hydrocarbon substances.
14 SECTION 2:
15 Before any exploratory well is drilled in any portion of the City of
16 Vernon a permit shall be required of the applicant.. to be issued by the City
17 Engineer of the City of Vernon. Before said permit may be issued.. it must

appear:
(a) That all laws of the City of Vernon pertaining to zoning.. sub-
division.. set-back lines.. fire.. building" and other laws.. rules.. and
regulations applicable to the property for which the permit is sought
have been complied with" and that the granting of said permit will
not result in a contravention of any law.. rule.. or regulation of the
City of Vernon.
(b) That a site plan has been submitted to the City Engineer with
the application for permit.. detailing the well location.. rig location.
pit locations.. and pipe storage locations.. and ingress and egress.
(c) That prior to the issuance of a permit.. the applicant will post
a bond in the amount of $2.. 000.00.. said bond indemnifying the City
of Vernon.. and insuring that upon abandonment of the exploratory
well.. the requirements of the City of Vernon restoring the site to
its original condition will be complied with.

(d) Prior to the issuance of the permit" the prospective applicant
will be required to furnish a certificate of public liability insurance"
naming the City of Vernon as a co..insured.
(e) Both the bond and public liability insurance set forth in sub-
paragraphs (c) and (d) above will be issued by a company qualified
to do business in the State of California. Said bond and said public
7 liability insurance policy must have the prior approval of the City
8 Attorney of the City of Vernon.. including but not limited to the
9 amount of the public liability insurance policy and the nature and
10 form of the contracts issued by the insurer.
11 SECTION 3:
12 The filing of any application shall be accompanied by the payment of
13 the sum of $200.00 for each proposed exploratory well.. which sum will be
14 deemed to defray the costs of investigations and inspections by the City of
15 Vernon. The payment of said application fee shall be payable to the City Clerk
16 of the City of Vernon.
17 SECTION 4:
18 After the applicantts request for a permit has been received by the
19 City Engineer" the City Engineer shall determine that all the laws, rules" and
20 regulations of the City of Vernon.. including but not limited to requirements of
21 other departments" have been complied with. Further" the City Engineer shall

determine that the applicant has complied with the engineering regulations for
exploratory oil and gas drilling.. and that all applications have been accompanie
by the appropriate filing fee. If the City Engineer is satisfied that the proposed
drilling described in the application for permit conforms to said requirements"
laws" and regulations.. he shall issue a permit to the applicant" conditioned
upon the applicant's continual complying with said appropriate laws.. rules" and
regulations.
SECTION 5:
The City Engineer of the City of Vernon is hereby designated as the
appropriate administrative authority for the promulgation of regulations for
exploratory oil and gas drilling. Said regulations may be adopted by the City

Engineer from time to time after appropriate hearings. Hearings shall be held
after posted notice as set forth below.. and at the time of said hearing interested
parties may appear and testify or otherwise present evidence opposing, introduc
ing.. or supporting proposed regulations for exploratory oil and gas drilling.
Said hearings shall be held.. and regulations may be adopted or repealed upon
the following conditions:
(a) The City Engineer shall cause a notice of hearing to be posted
at least seven (7) days prior to the hearing upon the adoption or
repealing of proposed regulations" said notice to be posted on the
bulletin board in the lobby of the City Hall of the City of Vernon..
located at 4305 Santa Fe Avenue.. Vernon~ California.
(b) Said notice shall specify the time and place of said hearings..
and shall be held in suitable quarters to allow a sufficient number of
the public as may be interested to attend said hearings.
(c) Said hearings may be adjourned from time to time by an open
oral announcement at the time and place of hearing.
(d) After the taking of testimony and the introduction of appropriate
evidence.. the City Engineer may then determine whether a regula-
tion shall be adopted.. amended.. modified.. or repealed.
(e) Any interested party aggrieved by the decision of the City
Engineer as set forth in paragraph (d) above may petition to the
City of Vernon.. requesting appropriate changes.. eliminations.. or
additions of regulations. The City Clerk.. upon receipt of said
petition shall set the matter upon the agenda of the next convenient
City Council meeting.. at which time the aggrieved party may appear
before the Council to be heard upon his petition. The City Council
shall then determine finally whether said regulation or regulations
shall be adopted, amended.. or repealed.. and may~ as they so
desire.. adopt or repeal a new and different regulation which may
promote the public health" safety~ and general welfare of the City
of Vernon.

1 SECTION 6:
2 The regulations for exploratory oil and gas drilling.. and other
3 appropriate City rules.. regulations.. and ordinances shall be complied with by
4 the applicant at all times after the receipt of the permit. If at any time during
5 the drilling of an exploratory well it shall be determined in good faith by the
6 City Engineer or other appropriate department heads that the laws.. rules.. and
7 regulations of the City of Vernon are not being complied with~ said City Enginee
8 or other appropriate department head may issue a cease and desist order to
9 the applicant by posting the same in a conspicuous place upon the property.. and
10 thereafter no further exploratory well drilling or other related activities shall
11 continue.

SECTION 7:
Every violation of this Ordinance is hereby declared to be a public

Any person.. firm.. or corporation violating any of the provisions

of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction
thereof shall be fined in an amount not exceeding $500.00.. or be imprisoned in
the County Jail of the County of Los Angeles.. or in the City Jail of the City of
Vernon.. as the committing magistrate may direct.. for not more than one
hundred eighty (180) days.. or by both such fine and imprisonment.. in the dis-
cretion of the Court. Each day such violation is committed or permitted to
continue shall constitute a separate offense and shall be punishable as such
hereunder.
SECTION 9:
Ordinance No. 412 is specifically repealed.. and any ordinance.. or
parts of ordinances.. in conflict herewith are hereby repealed.
SECTION 10:
There being no newspaper printed" published and circulated in the
City of Vernon.. the City Clerk is hereby directed to certify to the passage of
this Ordinance and shall post the same" or cause the same to be posted.. in
three of the most public places in the City of Vernon.. to wit: The northwest

1 corner of 38th Street and Santa Fe Avenue; the northeast corner of Leonis
2 Boulevard and Pacific Boulevard; and on the bulletin board in the lobby of the
3 City Hall of said City.. located at 4305 Santa Fe Avenue.. all in the City of Verno ..
4 Los Angeles County. California; that this Ordinance shall be in full force and
5 effect thirty (30) days from and after said date of posting.

for
EXPLORA TORY AND OIL AND GAS DRILLING
(ORDINANCE NO. 763)
1. State Regulations - The permittee's attention is directed to Division 3 of the
California Public Resources Code and to the Rules and Regulations of the
Resources Agency of California, OU and Gas Division. Duplicate copies of
all forms filed with the State (except forms relating to production) shall be
filed with the City. .
2. Site Plan - The well drilling site shall be developed in accordance with the
site plan submitted with the application for per mit and as approved by the
City Engineer.
3. Protection of Public - The well drilling site shall be fenced or attended at
all times to protect the public from the operations.
4. l,andscaping - The entire drilling site shall be adequately landscaped, except
for those portions occupied by any required structure, appurtenance or drive-
way, and all such landscaping shall be maintained in good condition at all
times. The site plan shall show the type and extent of such landscaping.
5. Drilling Prognosis - An acceptable drilling prognosis shall be submitted to
the City Engineer with the application for the drilling permit. This prognosis
shall detail (to the best of available knowledge):
a. Estimated total depth and approximate time to reach total depth.
b. Anticipated bottom-hole location.
c. Hole diameter.
d. Preliminary casing points and cementing plan.
e. Estimated pressures am the zones (depths) at which these pressures may
be expected.
f. The mud program to control these pressures.
6. Insurance - The amount of public liability insurance shall be two million dollars.
7. Tim~ Allotted for Te mporary Geological Exp_!9ratory H?~_e ~e:r:-~!! - Drilling
activities shall commence within sixty (60) Gays from the crate the permit 1s
issued. Once drilling activities have begun, they shall be pu.rsued dUigentlyto
completion. Thirty (30) day extensions may be granted upon request by the
City Engineer.
14. Abandonment - Before a permit will be issued, the prospective permittee shall

a. A loo-foot long cement plug, in the aquiclude at the base of the fresh
water aquifers.
b. A 25-foot long cement plug at the surface.

waiting on cement, Setting and testing of plugs sball be witne.sed by the City
Enginee1" .
After plugging, the drUling site sha.ll be restored to its orig1.nal condition
within :3 0 days.
15. Record!ni of Leases.. All mtneralleues shall be recorded with the Coonty
,Recorder. Upon the legal termination of any mlnerallease, a quit-claim deed
to the mineral interest shall be filed with the County Recorder.

9. &triace Cuing _ In conjunctiOD with the requirements of the State Oil and Gas
Dlv1aloo, the permittee will be required to set surface cuing through the fresh-
water aquifers and at least SO feet imo the underlying aquiclude. Surface casiIli
shall be cemented to the .unace with a satisfactory excess of cement. Tbe
bottom 100 feet shall be centralized at one-joint interyals. An additional 100
foot interval at a depth of approximately 500 feet shall be centralized. The ex-
act depth of this interyal wUl be determined by the City Engineer. Cementing
will be by the two-plug metbod using Halliburton, Byron Jack.80n, or equal,
equipment. One joint shall separate the cas1nl shoe from the plug landing -collar.
After cementing, the casing shall be hydrostatic tested to a surface pressure of
1000 pit.
Upon presenting evidence to the City Engineer of a satisfactory hydrostatic test,
the permittee will be allowed to drill-out of the surface casing, Depending on
casing diameter, and length of time during which the casing will be drilled
tb.rough, the City reseryes the right to require the installation of casing pro-
tectors on the drill pipe.
10. Blow-out preventers - A blow-out preyenter and choke assembly shall be used
When drilling 'below the surface casi~. The assembly shall consist c4. two
ram-type preventers, Cameron type QRC, or equal, series 900, with hydraulic
and manual operators, bottom preventer equipped with blank rams and top pre-
venter equipped with the correct pipe rams; and one Hydril type GK, or equal,
series 900 preventer. The kelly shall be equipped with a stop-cock; an internal
valve for the drill pipe available on the rig floor at all times. Blow-out drills
shall be conducted at least once per week..
11. Condition of Drilling Site - The drilling site and approaches shall be kept in a
Clean., neaf:'appearing condition, free from debris, other than necessary and
taddental drilling 8q:Jipment and supplies.
12. Liquid Wastes _ All drilling mud, oil, brine, or acids shall be retained in water-
tight containers from which they may be piped or hauled for termUlal disposal in
a dumping area specifically approved for such d1Bpoeal by the Los Angeles
Regional W_r pollution Control Board No.4.
13. Access to Site _ The City Engineer shall baye access to the site at all times until
the depth of2000 feet is reached, Below 2500 feet, the City Engineer will have
access to the site at reasonable times as required to witness tests required by
these regulations.

Herewith for your information are copies of Engineering Regul-
ations adopted in connection with Ordinance No. 763 for exploratory oil
and gas drilling and Ordinance No. 764 for oil and gas wells.
Prior to adoption the regulations were reviewed by the Western
Oil and Gas Association, Occidental Petroleum Corporation and Neaves
Petroleum Developments.
Neaves Petroleum Developments has advised that it will be
approximately a month before they make application for an exploratory
drilling permit.
