" !: ::l "1-<l:O"'.J.J ~ Z>..:I: <I: ~ 1lJ1-!:~U 0 31 U-u 0 . ~ ZU "z.. - 0 0 ~ > ~ ffi" 32 > 1 ORDINANCE NO. 764 2 AN ORDINANCE OF THE CITY OF VERNON , ESTABLISHING CONDITIONS AN REGULATIONS FOR THE ISSUANCE OF A PERMIT FOR OIL AND GAS WELLS 3 WITHIN THE CITY OF VERNON. 4 WHEREAS.. the City Council of the City of Vernon finds it necessar 5 to establish regulations.. conditions, and supervision prior to the issuance of a 6 permit for an oil and gas well to be located within the City of Vernon.. and to 7 promote the public health.. safety.. and general welfare in the City of Vernon; 8 NOW" THEREFORE" THE CITY COUNCIL OF THE CITY OF 9 VERNON DOES ORDAIN AS FOLLOWS: 10 SECTION 1: An oil and gas well shall mean any well or hole 11 already drilled.. being drilled.. or to be drilled into the surface of the earth 12 which is used or intended to be used in connection with coring.. or the drilling 13 for.. or the producing of petroleum.. natural gas, or other hydrocarbon 14 substances; or is used or intended to be used for the subsurface injection into 15 the earth of oil field waste.. gases.. water or liquid substances; including any 16 existing hole.. well" or casing which has not been abandoned" in accordance 17 with Ordinance No. 763 of the City of Vernon, except that oil and gas wells shal 18 not include an exploratory well as defined in Ordinance No. 763 of the City of 19 Vernon. 20 SECTION 2: Oil well drilling district shall mean a district 21 created by an ordinance of the City Council of the City of Vernon.. after receiv- 22 ing an appropriate application for the formation of an oil well drilling district.. 23 such request being in accordance with the procedures set forth herein. The 24 purpose of creating an oil well drilling district shall be for the promotion of a 25 safe" orderly.. and equitable extraction of oil.. gas" petroleum.. or other 26 hydrocarbon substances. 27 SECTION 3: Before any oil and gas well may be drilled" in any portion of the City of Vernon.. a permit shall be required of the applicant" to be issued by the City Engineer of the City of Vernon. (b) That all laws of the City of Vernon pertaining to zoning.. sub- division.. set-back lines~ fire~ building~ and other laws.. rules.. and regulations applicable to the property for which the permit is sought have been complied with.. and that the granting of said permit will not result in any contravention of any law" rule" or regulation of the City of Vernon. (c) That a site plan has been submitted to the City Engineer with the application for permit.. detailing the well location" rig location.. pit locations.. and pipe storage locations.. and ingress and egress. (d) That prior to the issuance of a permit, the applicant will post a bond in the amount of $2.. 000.00.. said bond indemnifying the City of Vernon.. and insuring that upon abandonment of the well" the requirements of the City of Vernon restoring the well site to its original condition will be complied with. (e) Prior to the iss uance of the permitll the prospective applicant will be required to furnish a certificate of public liability insurance.. naming the City of Vernon as a co-insured. (f) Both the bond and public liability insurance set forth in sub- paragraphs (d) and (e) above will be issued by a company qualified to do business in the State of California. Said Bond and said public I 22 23 24 25 26 27 liability insurance policy must have the prior approval of the City Attorney of the City of Vernon.. including but not limited to the amount of the public liability insurance policy and the nature and form of the contracts issued by the insurer. SECTION 4: The filing of any petition for an oil and gas drilling district shall be accompanied by the payment of the sum of $2.. 000.00 for each oil and gas drilling district.. which sum will be deemed to defray the costs of investigations and inspections by the City of Vernon. The payment of said application fee shall be payable to the City Clerk of the City of Vernon. SECTION 5: A petition to the City Council for the creation by ordinance of an oil drilling district shall contain a statement that the -2- IX) z ~ ~ '" 28 o ~~:: ><>z" "1 29 011I 0" ~ l'l ..a.Zz" z " o.ltffi~a::g ",o:g>zoD30 ~ .... .. .. !: ::l "1-<l:O"'.J.J ~ Z>..:I: <I: ~ 1lJ1-!:~U 0 31 u-u 0 . ~ Zu '" z .. _ 0 0 ~ > ~ ffi" 32 > 1 petitioner has the proprietary or contractual authority to drill for and produce 2 oil.. gas.. or other hydrocarbon substances under the surface of at least 75% of 3 the mineral interest to be included in said district; and that adequate protection 4 has been afforded the payment of royalties to parties not so granting the remain 5 ing mineral interest in said district. 6 The City Engineer may request the petitioner in writing to submit 7 for inspection copies of leases and contracts held by the petitioner in support of 8 such asserted proprietary or contractual authority. Further" the City Engineer 9 may request the petitioner.. at the petitionerts own expense.. to supply to the Cit 10 Engineer a preliminary title report from a recognized title insurance company.. 11 indicating the name or names of the parties holding a proprietary or contractual 12 interest sufficient to grant to the petitioner at least 75% of the mineral interest 13 to be included in said district. All such lease.. contracts.. and title reports 14 shall be subject to the approval of the City Attorney of the City of Vernon. 15 The district described in said petition shall normally be 40 acres or 16 more in area.. including all streets.. ways~ and alleys within the boundary there 17 of; and shall be substantially compact in area; and the boundaries thereof shall IS follow public streets.. ways.. or alleys so far as practicable. 19 20 21 22 23 24 25 26 27 SECTION 6: No petition for the establishment of an oil drillin district shall be filed with the City Council unless it has first been submitted to and reported on by the City Engineer and the City Attorney. Said report shall consider the propriety of the proposed boundaries of the district.. and the desirability of the drill site location. Said report shall be made by the City Engineer and the City Attorney within thirty {30} days after the receipt of said petition.. and upon a favorable report by the City Engineer and the City Attorney said petition shall then be placed upon the next convenient City Council agenda. A copy of said report shall accompany the petition. SECTION 7: After the petitioner's request for the creation of an oil drilling district" by ordinance" has been acted upon favorably by the City Council.. the petitioner may then request a permit to drill one or more oil and gas wells. Further.. the City Engineer 3 shall determine that the applicant has complied with the engineering regulations 4 for oil and gas wells.. and that all applications have been accompanied by the 5 filing fee of $200. 00 for each well. If the City Engineer is satisfied that the 6 proposed drilling described in the application for permit conforms to said 7 requirements.. laws.. and regulations.. he shall issue a permit to the applicant.. 8 conditioned upon the applicant's continual complying with said appropriate laws.. 9 rules.. and regulations. 10 SECTION 8: The City Engineer of the City of Vernon is here- 11 by designated as the appropriate administrative authority for the promulgation 12 of regulations for oil and gas wells. Said regulations may be adopted by the 13 City Engineer from time to time after appropriate hearings. Hearings shall 14 be held after posted notice as set forth below.. and at the time of said hearing 15 interested parties may appear and testify or otherwise present evidence.. oppos 16 ing.. introducing.. or supporting proposed engineering regulations for oil and 17 gas wells. Said hearing shall be held and regulations may be adopted or repeal 18 ed upon the following conditions: 19 20 21 22 23 24 25 26 27 (a) The City Engineer shall cause a notice of hearing to be posted at least seven (7) days prior to the hearing upon the adoption or repealing of proposed engineering regulations.. said notice to be posted on the bulletin board in the lobby of the City Hall of the City of Vernon.. located at 4305 Santa Fe Avenue.. Vernon.. California. (b) Said notice shall specify the time and place of said hearings.. and shall be held in suitable quarters to allow a sufficient number of the public as may be interested to attend said hearings. (c) Said hearings may be adjourned from time to time by an open oral announcement at the time and place of hearing. (d) After the taking of testimony and the introduction of appropriat evidence.. the City Engineer may then determine whether a regula- tion shall be adopted" amended" modified" or repealed. The City Clerk.. upon receipt of said petition shall set the matter upon the agenda of the next convenient City Council meeting.. at which time the aggrieved party may appear before the Council to be heard upon his petition. The City Council shall then determine finally whether said regula- tion or regulations shall be adopted.. amended.. or repealed.. and may.. as they so desire.. adopt or repeal a new and different regula.. tion which may promote the public health.. safety" and general wel- fare of the City of Vernon. SECTION 9: If the City Council of the City of Vernon shall 13 determine that a petition for the creation of an oil drilling district by ordinance 14 shall comprise of an area of less then forty (40) acres, including all streets, 15 ways.. and alleys within the boundaries thereof.. the City Council may.. in its 16 discretion, nevertheless allow the creation of such an oil drilling district where 17 it appears that sufficient geological.. economic.. or geographical reasons would IS allow the creation of a smaller oil drilling district and would not prove a 19 detriment to public health.. safety.. and general welfare in the City of Vernon. 20 A request for such an oil drilling district must contain sufficient geological.. 21 economic.. and geographical information to advise the City Council of the City 22 of Vernon of the necessity of the creation of a smaller district. 23 24 25 26 27 SECTION 10: The regulations for oil and gas wells.. and other appropriate City rules, regulations, and ordinances shall be complied with by the applicant at all times after the receipt of the permit. If at any time during the drilling of oil and gas wells it shall be determined in good faith by the City Engineer or other appropriate department heads that the laws.. rules.. and regulations of the City of Vernon are not complied with.. said City Engineer or other appropriate departme nt head may issue a cease and desist order to the applicant by posting the same in a conspicuous place upon the property.. and thereafter no further oil and gas wells shall be drilled. Z .. - 00; > ~ ~ .. 32 > 1 declared to be a public nuisance. 2 SECTION 12: Any person.. firm.. or corporation violating 3 any of the provisions of this Ordinance shall be deemed guilty of a misdemeano 4 and upon conviction thereof shall be fined in an amount not exceeding $500.00.. 5 or be imprisoned in the County Jail of the County of Los Angeles" or in the City 6 Jail of the City of Vernon.. as the committing magistrate may direct" for not 7 more than one hundred eighty (180) days" or by both such fine and imprisonment 8 in the discretion of the Court. Each day such violation is committed or per- 9 mitted to continue shall constitute a separate offense and shall be punishable as 10 such hereunder. 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 SECTION 13: Any ordinance establishing an oil drilling district as defined in this Ordinance" and any permit granted pursuant to this Ordinance shall become null and void one (I) year after the effective date thereo unless oil drilling operations are commenced and diligently prosecuted within such one (1) year period; provided" however" that prior to the expiration thereof the City Engineer may extend the termination date for an additional period not to exceed one (1) year.. if written application is filed with the City Engineer setting forth the reasons for such extension and the City Engineer determines that a good and reasonable cause exists therefor. Similarly.. the City Engineer may extend the termination date for two consecutive additional periods" not to exceed one (1) year each.. for those districts which are part of a group undergoing development from one or more common controlled drilling sites.. provided that drilling operations have been diligently prosecuted from the common drilling sites during the previous extension period. Further, the ordinance creating the oil drilling district and the permit granted pursuant to this Ordinance shall be null and void one (1) year after all wells in the district have been abandoned as required by law. SECTION 14: There being no newspaper printed.. published and circulated in the City of Vernon.. the City Clerk is hereby directed to certif to the passage of this Ordinance and shall post same.. or cause same to be posted.. in three of the most public places in the City of Vernon.. to wit: the northwest corner of 38th Street and Santa Fe Avenue; the northeast corner of -6- 1 Leonis Boulevard and Pacific Boulevard; and on the bulletin board in the lobby 2 of the City Hall of said City.. located at 4305 Santa Fe Avenue.. all in the City of 3 Vernon.. Los Angeles County..
