Ordinance No. 792 .1 ORDINANCE NO. 792 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF VERNON, REGULATING TRAVEL, STOPPING, STANDING, AND PARKING OF VEHICLES ANDlEDESTRIANS 3 ON THE PUBLIC STREETS AND HIGHWAYS OF THE CITY OF VERNON. 4 THE CITY COUNCIL OF THE CITY OF VERNON DOES ORDAIN AS FOLLOWS: SECTION 1. The following words and phrases when used 5 6 in this Ordinance shall, for the purpose of this Ordinance, have 7 the meanings construed as set forth herein, unless it is apparent 8 from the context that a different meaning is intended. (a) Traffic 9 Engineer means the Traffic Engineer of the City of Vernon or his 10 duly authorized representative or representatives. (b) Police 11 officer is every officer of the Police Department of the City of 12 Vernon. (c) All other words and phrases shall be the same as 13 defined in the Vehicle Code of the state of California. 14 SECTION 2: This Ordinance as adopted by the City of 15 Vernon may be known as the ltTraffic Ordinance of the City of 16 Vernon. " 17 SECTION 3: It shall be the duty of the Police Department 18 with such aid as may be rendered by other members of appropriate 19 departments of the City of Vernon, including but not limited to 20 the Traffic Engineering and street Department, to enforce the 21 street traffic regulations of this City, and of all of the state 22 vehicle laws applicable to street traffic in this City, to make 23 arrests for traffic violations, to investigate accidents, and to 24 cooperate with the Traffic Engineer and other officers of the 25 City in the administration of the traffic laws and in developing way 26 and means to improve traffic conditions, and to carry out those 27 duties specifically imposed upon said said Police Department, and 28 such other departments of the City as may be appropriate, by this 29 Ordinance and any other ordinances of the City of Vernon. 30 SECT10N 4: The Traffic Engineer of the City of Vernon 31 shall exercise the powers and duties with respect to traffic as 32 I I 1. I' .1 provided in this Ordinance. It shall be the general duty of the 2 Traffic Engineer to determine the installation and proper timing 3 and maintenance of traffic control devices, to conduct engineering 4 analysis of traffic accidents, and to devise remedial measures, 5 to conduct engineering investigation of traffic conditions, to 6 plan the operation of traffic on the streets and highways of this 71 City, to cooperate with other City officials in the development 8 of ways and means to improve traffic conditions and to carry out 9 the additional powers and duties imposed by ordinances of this 10 City. 11 SECTION 5: It shall be the duty of the officers of the 12 Police Department or such officers as are assigned by the Chief 13 of Police to enforce all street traffic laws of this City, and all 14 of the state vehicle laws applicable to street traffic in the City 15 of Vernon. 16 Officers of the Police Department or such officers as 17 are assigned by the Chief of Police are hereby authorized to 18 direct all traffic by voice and/or signal in conformance with 19 traffic laws, provided that, in the event of a fire or other 20 emergency, or to expedite traffic or to safeguard pedestrians, 21 officers of the Police Department may direct traffic as conditions 22 may require, notwithstanding the provisions of this Ordinance or 23 other traffic laws. 24 SECTION 6: It is a misdemeanor subject to fine and 25 imprisonment as set forth in this Ordinance, for any person to do 26 any act forbidden, or fail to perform any act required in this 27 Ordinance. 28 SECTION 7: No person shall willfully fail or refuse to 29 comply with any lawful order or direction of a police officer 30 pursuant to the provisions of this Ordinance, or other applicable 31 state law. 32 SECTION 8: The driver of an authorized emergency 2. .1 vehicle, when responding to an emergency call or when in pursuit 2 of an actual suspected violator of the law, or when responding to 3 but not upon returning from a fire alarm, may exercise the privi- 4 leges set forth in this section, but subject to the provisions 5 stated herein. Such driver of an authorized emergency vehicle 6 may proceed as follows: (a) Park, or stand, irrespective of the 7 provisions of this Act; (b) proceed past a red or stop signal or 8 stop sign, but only after slowing down as may be necessary for 9 safe operation; (c) exceed the prima facie speed limit or any 10 posted speed limit so long as he does not endanger life or pro- 11 perty; (d) disregard regulations governing direction of movement 12 or turning in specified directions. 13 The foregoing provisions shall not relieve the driver 14 of an authorized emergency vehicle from the duty to drive with due 15' regard for the safety of all persons. 16 SECTION 9: The Traffic Engineer shall place and maintain 17 traffic control signs, signals and devices when, as deemed neces- 18 sary, to make effective the provisions of this Ordinance and to 19 make effective the provisions pertaining to the purpose and intent 20 of this Ordinance and may place and maintain such additional traf- 211 fic control devices as he may deem necessary to regulate traffic 22 pursuant to this Ordinance or under State law or to guide or warn 23 traffic. 24 25 SECTION lO: All traffic control signs, signals and devices shall conform to the specifications approved by the State of California. All signs and signals required hereunder for a 261 27 particular purpose shall, so far as practicable, be uniform as to 28 type and location throughout the City. All traffic control devices so erected and not inconsistent with the provisions of State law 29 30 31 32 or this Ordinance shall be official control devices. SECTION ll: The driver of any vehicle and the motorman of any streetcar and all pedestrians shall obey the instructions 3. .1 of any official control device applicable thereto, placed in 2 accordance with this Ordinance unless otherwise directed by a 3 Police Officer, subject to the exceptions granted to a driver of 4 an authorized emergency vehicle in this ordinance. 51 SECTION l2: Whenever traffic is controlled by traffic 6 control signals exhibiting the words "Gou, tfcautiontt, or tfStoplf, 7 or exhibiting different colored lights successively one at a time, 8 or with arrows, the same shall be complied with by all drivers of 9 vehicles and pedestrians in accordance with requirements set forth 10 in the Vehicle Code of the state of California. In the event that IIi a traffic control signal, device, or sign may not be specified by I 12 the state of California, the same shall be obeyed in accordance 13 with its obvious legend. 14 SECTION 13: No person without lawful authority shall 15 attempt to or in fact, alter, deface, injure, knock down, or re- 16 move any official traffic control device or signal or any in- 17 scription, shield, or insignia thereon, or any other part thereof. 18 SECTION l4: The Traffic Engineer is hereby authorized 19 to establish the following: (a) To designate and maintain by 20 appropriate devices, marks, or lines upon the surface of the road- 21 way, crosswalks at intersections where in his opinion there is 22 particular need to regulate pedestrians crossing the roadway, and 23 at such other places as he may deem necessary; (b) to establish 241 safety zones of such kind and character and at such places as he 25 may deem necessary for the protection of pedestrians; (c) to mark 26 traffic lanes upon the roadway of any street or highway where 27 alignment of traffic is necessary; (d) to regulate the timing of 28 traffic signals so as to permit the movement of traffic in an 29 orderly and safe manner at speeds slightly at variance from speeds 30 otherwise applicable pursuant to this Ordinance or state law, and 31 shall erect appropriate signs giving notice thereof; (e) to place 32 curb markings or post signs regulating stopping, standing, or 4. .1 parking, utilizing such signs or coloring as is set forth in the 2 Vehicle Code of the state of California, to install signs or marks 31 restricting or limiting stopping, standing, or parking, for the 4 purpose of loading or unloading, for the purpose of setting forth 5 passenger loading zones, for the purpose of establishing bus 6 zones, and for limiting the length of time for which any vehicle 7 may park within the City of Vernon. The foregoing shall be 8 complied with in the event that signs have been erected limiting, 9 restricting, or otherwise defining such stopping, standing, or 10 parking, and such signs are in place giving notice thereof; 11 (f) when upon the basis of engineering and traffic investigation 12 it is determined that certain speed regulations shall be applicable 13 upon specified streets or in certain areas, the Traffic Engineer 14 shall post the maximum speed limits required or allowed on such 15 street or streets, or portion thereof, in which event it shall be 16 prima facie unlawful for any person to drive a vehicle at a speed 17 in excess of any speed so posted or declared. 18 SECTION l5: Prior to the Traffic Engineer establishing 19 markings, orders, rules, or regulations as set forth in Section l4 20 above or any subdivision thereof, the Traffic Engineer shall first 21 advise the Chief of Police of the City of Vernon of hismtention 22 to so determine speed limits, standing, stopping, parking, or other 23 regulations, and his further intention to mark curbs or post signs 24 in accordance with such determination. Such notice shall be given 25 to the Chief of Police at least seven (7) days prior to such 26 marking, posting, or other regulations. In the event that the 27 Chief of Police shall determine that such marking, posting, or 28 other regulations may resu~t in d~fficu~t~es of enforcement, he 291 shall communicate such concern to the Traffic Engineer, in writing, 30 and forward a copy of the same to the City Clerk of the City of 31 Vernon. Upon receipt of such notice, the Traffic Engineer shall 32 withhold any further action and the City Clerk of the City 5. 6 7 8 9 10 111 12 13 14 151 16 17 18 19 20 21 .1 of Vernon shall notice such communication on the agenda for the 2 next regular City Council meeting of the City of Vernon. There- :3 upon and thereafter the City Council of the City of Vernon shall 4 be the final determining body to decide whether such marking or I 51 posting or other regulation shall proceed. The City Council of the City of Vernon may adopt, reject, or conditionally adopt or reject or modify any recommendation of the Traffic Engineer or the Chief of Police of the City of Vernon as the same may be presented to the City Council of the City of Vernon. SECTION l6: Where any crosswalk, safety zone, street alignments, speed variance, curb markings, posted signs, signs pertaining to stopping, standing, or parking, or signs pertaining to speed limits have been erected or installed pursuant to state law, this Ordinance or any other applicable laws, rules, ordinances or regulations of the City of Vernon, the same shall be obeyed as set forth herein, and it shall be unlawful for the operator of any vehicle or for any pedestrian to fail or refuse to keep or operate such vehicle or to walk or stand as a pedestrian in violation of this Ordinance or any other applicable laws, rules or regulations, or ordinances of the City of Vernon or the state of California. 22 upon or in view of any public street or highway any unauthorized SECTION 17: No person shall place,maintain, or display 23 sign, signal, marking, or device which purports to be or is an 24 imitation of or resembles an official traffic control device or 25 railroad sign or signal) or which attempts to direct the movement 26 of traffic, or which hides from view or interferes with the 27 effectiveness of any official traffic control device or any 28 railroad sign or signal. This Section shall not be deemed to 29 prohibit the erection upon private property adjacent to streets 30 or highways of signs giving useful directional information and of 31 a type that cannot be mistaken for official signs. 32 SECTION l8: In addition to the powers and duties granted 6. 7 8 9 10 111 12 13 14 .1 to the Traffic Engineer as set forth above, the Traffic Engineer 2 is authorized to place within the public street or right-of-way 3 the following: (a) Markers, buttons, or signs within or adjacent 4 5 61 to intersections indicating the course to be traveled by vehicles turning at such intersections; (b) turn signs indicating a restriction on turning right, left, or making a u-turn. Such signs may prohibit such turns between certain hours of any day and permit at other hours, in which event the same shall be plainly indicated on the signs or they may be removed when such turns are permitted; (c) signs regulating the control of pedestrians exhibiting the words nWalktt or "Wait" or ttDon't Walktt; Cd) signs indicating and designating anyone-way street or one-way alley. Signs indicating such direction of lawful movement shall be 15 opposite direction is prohibited; (e) To place and maintain a placed at every intersection where movement of traffic in the 16 stopsign or stopsigns on each and every street intersecting a 17 through street or intersecting that portion thereof waere parti- 18 cular hazard may exist, and the Traffic Engineer shall determine 19 whether vehicles shall stop at one or more entrances to any such 20 stop intersection, and shall erect a stopsign at every such place 211 where a stop is required; (f) install or temporarily post re- 22 strictions on parking, standing, stopping, or the right to 23 continue with through traffic or a limitation on the otherwise 24 posted speed limit where, in the opinion of the Traffic Engineer, 25 the same is necessary for the benefit of public health, welfare, 26 and safety because of unusual occurrences, public, or private works 27 or construction, or such other factor or hazard as may require 28( 29 such posting. SECTION 19: The violation or failure to observe and 30 comply with the markings or signs as set forth in Section 18 above 31 shall constitute a misdemeanor. 32 SECTION 20: No person shall stand, stop, or park a 7. .1 vehicle, except when necessary to avoid conflict with other 2 traffic, or in compliance with law or the directions of a police 3 officer or traffic control device in any of the following places: 4 (a) On a sidewalk; (b) in front of a public or private driveway; 5 (c) within an intersection; (d) on a crosswalk; (e) within twenty 6 (20) feet of a crosswalk at an intersection; (f) within thirty (30) 7 feet upon the approach to any flashing beacon, stop sign, or 8 traffic control signal located at the side of a roadway; (g) along- 9 side or opposite any street excavation or obstruction when 10 stopping, standing, or parking woulddbstruct traffic; (h) on a 11 roadway side of any vehicle stopped or parked at the edge of a 12 curb or street; (i) at any place where official signs or curb 13 marking prohibits stopping; (j) wherever such stopping, standing, 14 or parking may be prohibited by this Ordinance, other ordinances, 15 rules, or regulations of the City of Vernon, or any statutes or 16 laws of the state of California. 17 18 19 20 SECTION 2l: Members of the Police Department are hereby authorized to remove a vehicle from a street or highway to any garage maintained by the City of Vernon or to any other public garage or place of safety under the following circumstances: 211 22 23 24 25 26 27 28 29 30 31 32 (a) When any vehicle is left unattended upon any bridge, viaduct, or causeway where such vehicle constitutes an obstruction to traffic; (b) when a vehicle upon a highway or street is so disabled as to constitute an obstruction to traffic and the person or persons in charge of such vehicle are by reason of physical injury or otherwise incapacitated to such an extent as to be unable to provide for the custody or removal of said vehicle; (c) when any vehicle is left unattended upon a street and is parked il- legally as defined by the provisions of this Ordinance or by other laws, rules and regulations; provided that signs giving notice that such vehicle may be removed, are erected or placed by the Traffic Engineer at least twenty-four (24) hours prior to such 8. .1 removal. 2 In the event that such vehicle is removed pursuant to 3 this Section, notice shall be given as provided for in Section 22 4 following, and further the garageman's lien provided for in 5 Section 23 following will attach to said vehicle or vehicles. 6 SECTION 22: Whenever an officer removes a vehicle 7 pursuant to the authority granted in Section 21 above and who 8 knows or is able to ascertain from the vehicle registration or 10 address of the registered owner of said vehicle, such officer 9 the records of the Department of Motor vehicles, the name and 11 shall immediately give or cause to be given notice to said owner 12 of the fact of such removal, the reasons therefor, and the place 13 to which such vehicle has been removed. In the event that any 14 such vehicle is stored in a public garage, a copy of such notice 15 shall be given to the proprietor of such garage. 16 17 181 19 20 211 22 23 24 25 SECTION 23: Whenever any vehicle has been removed to a garage under the provisions of the preceding sections hereof, the keeper of such garage shall have a lien dependent upon possession for his compensation for towage and for caring for and keeping safe such vehicle for a period not exceeding ninety (90) days and, if said vehicle is not recovered by the owner within said ninety (90) days or the owner is unknown, the keeper of said garagemay satisfy his lien in the manner provided by the Vehicle Code and the Civil Code of the State of California. SECTION 24: Whenever in this Ordinance powers, rights, i 26, or duties are set forth authorizing the Traffic Engineer of the I 27 City of Vernon to set speed limits, place official signs or curb 28 marking or prohibit stopping, standing, or parking, or do any 29 other acts which may aggrieve any property owner or occupant of 30 property within the City of Vernon, it shall be the duty of the 31 Traffic Engineer to, insofar as is practicable, advise affected 32 property owners or occupants, being those adjacent to the street 9. il I I .11 or highway where such regulation will take effect, either personall , 2 by correspondnece or by posting, of the proposed change or changes 3 in existing rules and regulations. Any person or persons who may 4 be aggrieved by the proposed regulations, posting of official 5 signs or curb markings proposed by the Traffic Engineer may com- 6 municate such dissatisfaction to the City Council of the City of 7 Vernon. Upon receipt of said notice the City Clerk shall place 8 such notice upon the agenda for the next regular meeting of the 9 City Council of the City of Vernon. The notice shall provide 10 the following: (a) The name and mailing address of the party 11 12 13 14 15 16 17 18 19 201 21 22 23 24 25 26 I 27 28 29 30 protesting the actions of the Traffic Engineer; (b) a method of identification of the area for which the objection is made; (c) a method of identifying the action or actions of the Traffic Engineer to which the objection is filed; (d) a brief summary in non- technical language of the points or contentions made by the party protesting the actions of the Traffic Engineer which will be suf- ficient to inform any interested person of the grounds for which the objection is made. The City Council shall, at theDext regular Council meeting, take under submission the objection or objections and shall be the final determining body as to whether the actions of the Traffic Engineer shall be approved, denied, or modified. At the time and place of said regular City Council meeting, any interested person or persons may be heard, either supporting or objecting to the actions of the Traffic Engineer. SECTION 25: This Ordinance is hereby enacted pursuant to authority granted to municipalities, in the discretion pursuant to various sections of the Vehicle Code of the state of California, and other laws, statutes, and provisions of the State of California SECTION 26: All resolutions, rules, and regula tions of 31 the City of Vernon in conflict with this Ordinance or any portion 32 thereof which may be in conflict with this Ordinance are hereby repealed. lO. .1 SECTION 27: If any sub-section, sentence, clause, 2 phrase, or portion of this Ordinance is for any reason held to be 3 invalid or unconstitutional, by the decision of any court of com- 4 petent jurisdiction, such decision shall not affect the validity 51 of the remaining portion or portions of this Ordinance. 6 SECTION 28: Every violation of this Ordinance is hereby 7 declared to be a public nuisance. 8 SECTION 29: Any person, firm or corporation violating 9 any of the provisions of this Ordinance shall be deemed guilty of 10 a misdemeanor, and upon conviction thereof shall be fined in an 1111 amount not exceeding five hundred dollars ($500.00), or be impri- 12 soned in the county jail of the County of Los Angeles, or the city 13 jail of the City of Vernon, as the committing magistrate may direct, 14 for not more than six (6) months, or by both such fine and impri- 15 sonment, in the discretion of the court. Each day such violation 16 is committed, or permitted to continue, shall constitute a separate 17 offense and shall be punishable as such hereunder. 18 SECTION 30: There being no newspaper printed, published 19 and circulated in the City of Vernon, the City Clerk is hereby 20 directed to certify to the passage of this Ordinance and shall 21 post the same, or cause the same to be posted, in three of the most 22 public places in the City of Vernon, to wit: The northwest corner 23 of 38th street and Santa Fe Avenue; the northeast corner of Leonis 24 Boulevard and Pacific Boulevard; and on the bulletin board in the 25 lobby of the City Hall of said City, located at 4305 Santa Fe 26 Avenue, all in the City of Vernon, County of Los Angeles, California 27 That this Ordinance shall be in full force and effect thirty (30) 28 days from and after the final passage of the same. 29 30 31 32 I I I ADOPTED and APPROVED this 16th day of April 1968. ~.~ F.~mer, City Clerk ll. .1 2 3 4 STATE OF CALIFORNIA ) ) COUNTY OF LOS ANGELES ) ss. ) CITY OF VERNON ) 5 I, ]'.
