THE CITY COUNCIL OF THE CITY OF VERNON DOES ORDAIN AS FOLLOWS:
SECTION 1: Purposes. The declared purposes of this

Ordinance are to provide for the preparation and carrying out of
plans for the protection of persons and property within this City
in the event of a disaster, and to provide for the coordination of
the Civil Defense and Disaster functions of this City with all
other public agencies and affected private persons, corporations,
11 and organizations. Any expenditures made in connection with such
12 civil defense and disaster activities, including mutual aid
13 activities, shall be deemed conclusively to be for the direct
14 protection and benefit of the inhabitants and property of the City
15 of Vernon.

SECTION 2: Definitions.
A. ttCivil Defensetf as used in this Ordinance shall mean
18 the preparation for and carrying out of all emergency functions,
19 other than functions for which military forces are primarily
20 responsible, to prevent, minimize, and repair injury and damage
21 resulting from disasters. It shall not include, nor does any
23 labor contr0versy.

SECTION 3- Civil Defense and Disaster Council Membership.
29 The Vernon Civil Defense and Disaster Council is hereby created
30 and shall consist of the following:

A. The Mayor, who shall be chairman.
B. The director of civil defense and disaster, who shall

1 be vice chairman.
2 C. The assistant director, appointed by the Mayor, with
:3 the advice and consent of the City Council who, under the super-
4 vision of the director, shall develop civil defense and disaster
5 plans and organize the civil defense and disaster program of this
6 City, and shall have such other duties as may be assigned by the
7 director.
S D. Such deputy civil defense directors and chiefs of
9 emergency services as are provided for in the current civil defense
10 and disaster emergency operations plan of the City and as confirmed
11 by the director.
12 E. Such representatives of civic, business, labor,
13 veterans, professional or other organizations having an official
14 group or organization civil defense and disaster responsibility,
15 as may be appointed by the Mayor with the advice and consent of the
16 City Council.
17 SECTION 4: Civil Defense and Disaster Council. Powers
18 and Duties. It shall be the duty of the Vernon civil defense and
19 disaster council, and it is hereby empowered, to review and recom-
20 mend for adoption by the City Council, civil defense and disaster
21 and mutual aid plans and agreements and such ordinances and
22 resolutions and rules and regulations as are necessary to implement
23 such plans and agreements. The civil defense and disaster council
24 shall meet upon call of the chairman or in his absence from the
25 City, or inability to call such meeting, upon the call of the vice
26 cha irman.
27 SECTION 5: Director of Civil Defense and Disaster.
28 Powers and duties. There is hereby created the office of director
29 of civil defense and disaster. The Mayor shall designate the
30 director of civil defense and disaster, and in the absence of such
31 designation, the Mayor shall be the director of civil defense and
32 disaster.

The director is hereby empowered:
A. To request the City Council to proclaim the existence
:3 or threatened existence of a disaster or an emergency and the
4 termination thereof, if the City Council is in session, or to issue
:1 such proclamation if the City Council is not in session, subject
to confirmation by the City Council at the earliest practicable tim ;

B. To request the Governor to proclaim a state of disast r
or a state of extreme emergency when in the opinion of the director I
the resources of the area or region are inadequate to cope with the

11 C. To control and direct the effort of the civil defense
12 and disaster organization of this City for the accomplishment of
13 the purposes of this Ordinance;

SECTION 6- Director of Civil Defense and Disaster.
22 Emergency Powers. In the event of the proclamation of a disaster
23 or emergency as herein provided, or the proclamation of a state of
24 disaster or a state of extreme emergency by the Governor or the
25 Director of the California Disaster Office, the director is hereby
26 empowered:

A. To make and issuertiLes and regulations on matters
28 reasonably related to the protection of life and property as affecte
29 by such disaster; provided, however, such rules and regulations must

30 be confirmed at the earliest practicable time by the City Council;
B. To obtain vital supplies, equipment and such other
32 properties found lacking and needed for the protection of the life a d

1 property of the people and bind the City for the fair value there-
2 of, and if required immediately, to commandeer the same for public
3 use;
4 C. To require emergency services of any City officer or
5 employee and, in the event of the proclamation of a state of
6 disaster or a state of extreme emergency by the Governor in the
7 region in which this City is located, to command the aid of as many
S citizens of this community as he thinks necessary in the execution
9 of his duties; such persons to be entitled to all privileges,
10 benefits, and immunities as are provided by state law for registere
11 civil defense and disaster service volunteers;
12 D. To requisition necessary personnel or material of any
13 City department or agency;
14 E. To execute all of his ordinary power in the event
15 that the director of civil defense and disaster be the Mayor, and
16 all of the special powers conferred upon him by this Ordinance or
17 by resolution or approved plan adopted pursuant thereto, all powers
18 conferred upon him by any statute, agreement approved by the City
19 Council, or by any other awful authority, and in conformity with
20 Section 38791 of the Government Code, to exercise complete authorit
21 over the City and to exercise all police power vested in the City
22 by the Constitution and general laws.
23 SECTION 7: Civil Defense and Disaster Organization.
24 All officers and employees of this City, together with those
25 volunteer forces enrolled to aid them during a disaster, and all
26 groups, organizations and persons who may by agreement or operation
27 of law, including persons pressed into service under the provisions
28 of Section 6 C of this Ordinance, be charged with duties incident
29 to the protection of life and property in this City during such
30 disaster, shall constitute the civil defense and disaster organiza-
31 tion of the City of Vernon.
32 SECTION 8: Organization, Duties and Functions. The

1 organization, duties and functions of the Vernon civil defense and
2 disaster organization (City emergency organization), its relation-
3 ship with the American National Red Cross, and the order of emer-
4 gency succession to the position of director of civil defense and
5 disaster shall be as set forth in the current civil defense and
6 disaster emergency operations plan of the City. Insofar as possible,

the form of organization, titles and terminology shall conform to
the recommendations of the civil defense and disaster agencies of
Federal Government and the State of California.
SECTION 9: Punishment of Violations. It shall be a mis-
11 demeanor, punishable by a fine of not to exceed $500.00, or by
12 imprisonment for not to exceed six months, or both, for any person
13 during a disaster:

A. Wilfully to obstruct, hinder or delay any member of
15 the civil defense and disaster organization in the enforcement of
16 any lawful rule or regulation issued pursuant to this Ordinance, or
17 in the performance of any duty imposed upon him by virtue of this
18 Ordinance;

B. To do any act forbidden by any lawful rules or
20 regulations issued pursuant to this Ordinance, if such act is of
21 such a nature as to give or be likely to give assistance to the
22 enemy, or to imperil the lives or property of inhabitants of this
23 City, or to prevent, hinder or delay the defense or protection
24 thereof;

C. To wear, carry or display, without authority, any
26 means of identification specified by the civil defense and disaster
27 agency of the State.

SECTION lO: Repeal of Conflicting Ordinances. Ordinance
29 No. 641 and any other ordinances or parts of ordinances in conflict
30 with this Ordinance are hereby repealed. Provided that it is the
31 intent of the City Council in enacting this Ordinance that it shall
32 be considered a revision and continuation of Ordinance No. 641

1 repealed by this Ordinance, and the status of volunteers shall not
2 be affected by such repeal; nor shall civil defense and disaster
31 mutual aid plans and agreements, rules and regulations, or resoluti ns
4 adopted pursuant to such repealed ordinance be affected by such
5 repeal until amended, modified, or superseded as provided in this
6 Ordinance.

SECTION ll: There being no newpaper printed, published,
8 and circulated within the City of Vernon, the City Clerk is hereby
9 directed to certify to the passage of this Ordinance, and shall
10\ post the same, or cause the same to be posted, in three of the
11 most public places in the City of Vernon, to wit: The northwest
12 corner of 38th street and Santa Fe Avenue; the northeast corner
13 of Leonis Boulevard and Pacific Boulevard; and on the bulletin
14 board in the lobby of the City Hall of said City, located at 4305
15 Santa Fe Avenue, all in the City of Vernon, County of Los Angeles,
16 california. That this Ordinance shall be in full force and effect
17 thirty (30) days from and after the final passage of the same.

SECTION 12: Severability. If any provision of this
19 Ordinance or the application thereof to any person or circumstances
20 is held invalid, such invalidity shall not affect dher provisions
21 or applications of the Ordinance which can be given effect without
22 the invalid provision or application, and to this end the provision
23 of this Ordinance are declared to be severable.
