2 AN ORDINANCE OF THE CITY OF VERNON ESTABLISHING REQUIREMENTS FOR
PROVIDING OFF-STREET PARKING FOR AUTOMOBILES, THEIR CIRCULATION
3 AND ACCESS, AND ESTABLISHING REQUIREMENTS FOR OFF-STREET SPACE
FOR LOADING AND UNLOADING TRUCKS, FOR THEIR MANEUVERING AND
4 ACCESS FROM AND TO THE PUBLIC STREETS.

SECTION 1: GENERAL PROVISIONS.
1.1 TITLE. This Ordinance shall be known as the "Off-
7 Street Parking and Loading Ordinancett.

l.2 PURPOSE. The purpose of this Ordinance is to protect
9 and promote the health, safety, and general welfare of the public
10 in the City by establishing requirements for providing off-street
11 parking for automobiles, their circulation and access, and estab-
12 lishing requirements for off-street space for loading and un-
13 loading trucks, for their maneuvering and access from and to the
14 public streets. It is the intent of this Ordinance to encourage
15 development and provision of loading spaces in such a manner that
16 maneuvering of vehicles on the public streets will be reduced to
17 a minimum.

1.3 LICENSES OR PERMITS. No City official, officer, or
19 employee, or anyone acting on behalf of such person, shall issue
20 any license or permit for any improvements contrary to, or in
21 violation of, the provisions of this Ordinance.

l.4 PLOT PLAN. Whenever construction or alteration of
23 buildings or changes in use affect the requirements for automobile
24 parking or truck parking, loading, and maneuvering, or both, a
25 plot plan clearly showing such required parking, loading, and
26 maneuvering areas in their relationship to buildings or uses to
27 be served shall be required. Parking, loading, and maneuvering
28 plot plans shall not be required for minor remodeling, painting,
29 repair, electrical and mechanical work, and similar undertakings
30 which do not affect or increase parking, loading, and maneuvering
31 space as required by this Ordinance. When parking, loading, and
32 maneuvering facilities are developed or altered without modifica-

1 tions to or construction of buildings or structures, separate
2 plans shall be required. All such plot plans and such separate
:3 plans shall be submitted to the Building Department to insure
4 compliance with this ordinance. Prior to issuance of any permit
5 or license, approval of the plot plan by the Traffic Engineering
6 and street Department shall be required if the proposal involves
7 street frontage improvements or alterations of existing public
8 facilities such as, but not limited to, driveways, sidewalks,
9 curbs and gutters.

l.5 INTERPRETATION. The provisions of this Ordinance
11 shall be held to be minimum requirements for the promotion of
12 the public health, safety, comfort, convenience, and general
13 welfare, and shall not be deemed or construed to repeal, amend,
14 modify, alter, or change any other rules, regulations, or ordin-
15 ances, or any part or parts thereof, except as hereinafter
16 specifically provided. Any requests for variance or exceptions
17 shall be presented to the City Council as provided in Section 4.

SECTION 2: AUTOMOBILE PARKING.
2.1 GENERAL PARKING REQUIREMENTS. Adequate off-street
20 parking space shall be provided for each industrial, commercial
21 or business enterprise, development or property, or for each
22 building, to accommodate all vehicles of the officers, employees,
23 vendors, salesmen, visitors, and other persons normally transact-
24 ing business at such enterprise or building.

2.2 SPECIFIC MINIMUM PARKING REQUIREMENTS. To meet the
26 intent of the above general requirements, the following minimum
27 parking space requirements for certain uses and buildings are
28 declared to be as follows:

2.3 OTHER USES. When such use has no similar listed use
One (1) space for each classroom.
24 for comparison and determination of parking requirements, the
25 required number of parking spaces shall be determined on the basis
26 of the type of use, number of employees, customers, vendors,
27 officers, and other factors which influence demand for parking
29
28 space.
2.4 CHANGES IN USE. When the use of property is changed
30 to one requiring a larger number of spaces, the minimum parking
31 spaces as required by this Ordinance shall be provided and main-
32 tained thereafter.

1 2.5 EXISTING BUILDINGS. Off-street parking spaces being
2 maintained in connection with any existing buildings shall be
3 maintained so long as said building remains or an equivalent
4 substitute number of spaces shall be provided and maintained so
5 long as the building remains. However, this Ordinance shall not
6 require the maintenance of more spaces than is required for new
7 buildings of the same use. Off-street parking spaces for addition
8 to existing buildings shall be provided at the same ratio as
9 required for new buildings of the same use.
10 2.6 MULTIPLE USES. Whenever a property contains several
11 uses each having specific parking requirements that are different
12 from each other, the number of parking spaces required shall be
13 the sum of the requirements of the various uses.
14 2.7 FRACTIONAL REQUIREMENTS. When the application of thes
15 requirements results in a fraction, any fractional requirement
16 less than one-half (i) may be disregarded and any fraction one-
17 half (i) or larger shall be construed as requiring one full park-
18 ing space.
19 2.8 DIMENSIONS. The minimum dimensions of a required
20 parking space shall be a width of eight and one-half (8i) feet
21 and a length of nineteen (19) feet, without any obstructions
22 within such space.
23 2.9 LOCATION. Required parking facilities shall be locate
24 on the same parcel or lot as the use or occupancy for which the
25 parking is being provided; or such required parking facilities
26 may be provided on a separate parcel or lot, but under the same
27 ownership as the parcel or lot on which the use or occupancy
28 requires parking, provided such separate parcel isw.ithin one
29 thousand (1000) feet from the main building or use measured as
30 walking distance from such building to the main entrance of the
31 parking facility; or such required parking facilities may be
32 provided on a separate parcel under different ownership, provided

such separate parcel is within one thousand (1000) feet from the
main building or use measured as walking distance from such

building to the main entrance of the parking facility, and pro-
vided evidence is filed with the City of Vernon limiting the use
of such parcel for parking purposes in connection with that
particular use or occupancy so long as such use exists.

2.l0 PAVING. All parking spaces,maneuvering areas, turn-
around areas, and driveways shall be maintained with a hard
durable surface kept clear and properly drained.
2.11 MARKINGS. All required parking spaces shall be
11 clearly and adequately marked with permanent, durable, and easily
12 distinquishable materials. All one-way drives, entrances, and
13 exits shall be clearly and permanently marked. Such signs and
14 markings shall be maintained and shall be visible to drivers of
15 vehicles using the parking facility.

2.12 BARRIERS. Where parking areas adjoin a public street
17 or streets, a suitable physical barrier not less than thirty (30)
18 inches in height shall be established along such full frontage,
19 except at driveways, walkways, or other openings where such are
20 necessary.

2.13 ACCESS. Easily accessible and adequate ingress and
23 Maneuvering and turn-around areas shall be provided. Parking
24 facilities shall have access and circulation provided in such a
25 way that all vehicles using the parking facility may enter or leave
26 the public street in a front-forward manner without backing or
27 maneuvering upon the public right-of-way. Driveways for one-way
28 aisles into and out of parking facilities shall be a minimum of
29 ten (10) feet in width and a maximum of twenty (20) feet in width.
30 Driveways for two-way aisles into and out of parking facilities
31 shall be a minimum of twenty (20) feet in width and a maximum of
32 thirty (30) feet in width. No driveways, or portions thereof,

1 shall be permitted within any curb return, or within forty (40)
2 feet thereof, at public street intersections. Not more than one
3 two-way driveway nor more than two one-way driveways shall be
4 permitted for facilities having spaces for less than fifty (50)
5 automobiles; twice that number of driveways may be permitted for
6 parkingfucilities having spaces for fifty (50) or more aumomobiles.
7 2.14 MAINTENANCE. Parking areas, driveways, maneuvering
8 aisles, ramps, turning areas, and similar areas required by this
9 Ordinance shall be kept free and clear of obstructions at all
10 times. Such required parking facilities shall be used exclusively
11 for parking of vehicles and shall not in any way be reduced or
12 encroached upon by other uses. This requirement shall be a
13 continuing obligation and it shall be unlawful to discontinue such
14 use without providing alternate areas to meet the requirements set
15 forth in this Ordinance.
16 SECTION 3: TRUCK PARKING, LOADING, AND MANEUVERING.
17 3.1 PARKING AND LOADING SPACE REQUIRED. All commercial,
18 industrial, warehouse, storage, institutional, and other buildings
19 or uses requiring the recapt or distribution of goods, materials,
20 merchandise or supplies by truck shall be provided with adequate
21 parking space for all such trucks which are owned, leased, rented,
22 or otherwise retained on the premises and shall also be provided
23 with off-street loading space to accommodate trucks being loaded,
24 unloaded, or waiting to load or unload. A loading space is
25 defined as an area twenty (20) feet wide by sixty-five (65) feet
26 long. When more than one loading space is provided, the additional
27 loading spaces may be fourteen (l4) feet wide and sixty-five (65)
28 feet long each.
29 3.2 ACCESS. Easily accessible and adequate ingress and
30 egress shall be provided to all truck parking and loading facilitie .
31 The width of access driveways shall be adequate to accommodate all
32 vehicles normally using the loading facilities but shall be no

1 wider than necessary to permit maneuvering of such vehicles
2 without undue interference with other vehicular or pedestrian
:3 traffic. No driveways or portions thereof shall be permitted
4 within any portion of any curb return nor closer than seventy-
5 five (75) feet from the point of tangency of any curb return.
6 3.3 CHANGES IN USE. When the property is enlarged or
7 increased in capacity by adding floor area or storage area or
8 when the use of property is changed to one needing a larger number
9 of loading spaces, such additional spaces shall meet the require-
10 ments of this Ordinance.
11 3.4 PAVING. All loading spaces shall be paved with a hard
12. durable surface material and shall be adequately drained.
13 3.5 BARRIERS. Where loading areas adjoin a public street
14 or streets, a suitable barrier not less than thirty (30) inches
15 in height shall be established and maintained along the full
16 frontage except at driveways, walkways, or other openings where
17 such are necessary.
18 3.6 MAINTENANCE. Truck parking and loading areas shall be
19 kept clear and free of obstructions in order to accomplish the
20 purpose intended by this Ordinance.
21 SECTION 4: VARIANCE OR EXCEPTION. Whenever the City Coun-
22 cil of the City of Vernon shall find upon the basis of reliable
23 evidence, information or opinion placed before it that the ex-
24 pedient, safe, and economical movement of vehicular and pedestrian
25 traffic over the public street system of the City will not be
26 adversely affected or, in the alternative, will be well served
27 thereby, the said City Council may, in its discretion and subject
28 to such conditions and limitations as it may see fit to impose,
29 relieve a person from one or more of the requirements of this
30 Ordinance. All requests of persons seeking the allowance of a
31 variance or exception from the requirements of this Ordinance
32 shall be presented to the City Council by the Building Department

1 with its written recommendations for allowance or rejection and
2 for the terms, conditions, and limitations, if any, which the
3 Building Department recommends be imposed upon such permit if
4 granted by the City Council. The Building Department shall,
5 prior to making its recommendations, solicit and include therein
6 the written recommendations of the Traffic Engineering and street
7 Department and of other departments of the City which may be
8 affected by the request for a variance or exception from the
9 requirements of this Ordinance. Any person seeking a variance
10, or exception from the requirements of this Ordinance, which
11 variance or exception has been refused or granted subject to
12 conditions or limitations, pursuant to the foregoing provisions
13 of this Section, may re.uest a hearing before the City Council
14 for the purpose of obtaining a new or different decision with
15 respect to said request for a variance or exception. Such re-
16 quest for a hearing must state the following:
17 1. The name and mailing address of the person for
18 the purposes of the requested hearing.
19 2. An identification of the previous dec~sion of
20 the City Council, if any.
21 3. The specific ruling which the petitioner requests
22 be made by the City Council.
23 4. A brief summary in non-technical language of the
24 points or contentions being made by petitioner at the
25 requested hearing, which summary shall be sufficient to
26 inform any interested person who may wish to meet or
27 refute the petitioner's presentation at the hearing.
28 The City Council shall set a time and place for a hearing on such
29 request, provided it shall comply with the foregoing requirements,
30 which hearing shall take place not more than thirty days after
31 receipt of the request, and upon not less than ten days' written
32 notice from the City Clerk, mailed to the petitioner by United

1 states mail, postage prepaid, to the address shown on the request
2 for hearing. In the event that the request for hearing does not
3 comply with the foregoing requirements, no hearing shall be set
4 and the City Clerk shall advise the petitioner of the City Council's
5 finding and that no hearing shall be set until such requirements
6 are met. Such latter notice shall be mailed by the City Clerk to
7 the petitioner by United States mail, postage prepaid, to the
8 address shown on the request for hearing, and if no adequate
9 address is shown thereon, the City Clerk shall make a reasonable
10 effort to locate an address for the petitioner, to which the notice
11 may be mailed and, failing to find such address, no notice shall
12. be sent.
13 SECTION 5: VALIDITY. Should any section, subsection,
14 clause or provision of this Ordinance for any reason be held to be
15 invalid or unconstitutional, such invalidity or unconstitutionality
16 shall not affect the validity or constitutionality of the remaining
17 portions of this Ordinance; it being hereby expressly declared
18 that this Ordinance and each section, subsection, sentence, clause,
19 and phrase hereof wouid have been prepared, proposed, approved, and
20 adopted irrespective of the fact that anyone or more sections,
21 subsections, sentences, clauses, or phrases be declared invalid or
22 unconstitutional.
23 SECTION 6: PUBLIC NUISANCE. Every violation of this
24 Ordinance is hereby declared to be a public nuisance.
25 SECTION 7: VIOLATIONS. Any person, fir~, or corporation
26 violating any of the provisions of this Ordinance shall be deemed
27 guilty of a misdemeanor, and upon conviction thereof shall be
28 fined in an amount not exceeding Three Hundred Dollars ($300.00),
29 or be imprisoned in the County Jail of the County of Los Angeles,
30 or the City Jail of the City of Vernon, as the committing magistrate
31 may direct, for not more than ninety (90) days, or by both such
32 fine and imprisonment, in the discretion of the Court. Each day

1 such violation is committed or permitted to continue, shall con-
2 stitute a separate offense and shall be punishable as such here-
3 under.

SECTION 8: REPEAL. Section 20 of Ordinance No. 752,
5 except subsections (3) and (4) thereof, and all ordinances in
6 conflict herewith are hereby repealed.

SECTION 9: PUBLICATION. There being no newspaper printed,
8 published and circulated in the City of Vernon, the City Clerk is
9 hereby directed to certify to the passage of this Ordinance and
10 shall post the same, or cause the same to be posted, in three of
11 the most public places in the City of Vernon, to wit: The north-
12 west corner of 38th Street and Santa Fe Avenue; the northeast
13 corner of Leonis Boulevard and Pacific Boulevard; and on the
14 bulletin board in the lobby of the City Hall of said City, located
15 at 4305 Santa Fe Avenue, all in the City of Vernon, County of Los
16 Angeles, California; that this Ordinance shall be in full force and
17 effect thirty (30) days from and after the date of said posting.
