ORDINANCE NO. Sa( ~
AN ORDINANCE OF THE CITY OF VERNON REGULATING TRAVEL, STOPPING,
STANDING, AND PARKING OF VEHICLES AND PEDESTRIANS ON THE PUBLIC
STREETS AND HIGHWAYS OF THE CITY OF VERNON, INCORPORATING CERTAIN
PROVISIONS OF THE CALIFORNIA VEHICLE CODE AND REPEALING ORDINANCE

THE CITY COUNCIL OF THE CITY OF VERNON DOES ORDAIN AS FOLLOWS:
SECTION 1: The following words and phrases when used in
7 this Ordinance shall, for the purpose of this Ordinance, have the
8 meaning construed as set forth herein, unless it is apparent from
9 the context that a different meaning is intended.
10 (a) Traffic Engineer means the Traffic Engineer of
the City of Vernon or his duly authorized representative
11 or representatives. In the event that at any time there
shall not be a Traffic Engineer of the City of Vernon,
12 then the same shall be deemed to be the Director of Public
Works of the City of Vernon.

(b) Police Officer is every Officer of the Police
14 Department of the City of Vernon.
15 (c) All other words and phrases shall be the same as
defined in the Vehicle Code of the State of California.

SECTION 2: This Ordinance as adopted by the City of
18 Vernon may be known as the "Traffic Ordinance of the City of
20
19 Vernon" .
SECTION 3: This Ordinance is hereby enacted pursuant to
21 authority granted to municipalities, in the discretion pursuant
22 to various sections of the Vehicle Code of the State of
23 California, and other laws, statutes, and provisions of the State
24 of California.

SECTION 4: Ordinance No. 792 and all other ordinances,
26 resolutions, rules, and regulations of the City of Vernon in
27 conflict with this Ordinance, or any portion thereof, which may
28 be in conflict with this Ordinance are hereby repealed.

SECTION 5: If any sub-section, sentence, clause,
30 phrases, or portion of this Ordinance is for any reason held to
31 be invalid or unconstitutional, by the decision of any court of
32 competent jurisdiction, such decision shall not affect the

.1 validity of the remaining portion or portions of this Ordinance.
2 SECTION 6: The Traffic Engineer of the City of Vernon sha 1
3 exercise the powers and duties with respect to traffic as pro-
4 vided in this Ordinance. It shall be the general duty of the
5 Traffic Engineer to determine the installation and proper timing
6 and maintenance of traffic control devises, to conduct engineer-
7 ing analysis of traffic accidents, and to devise remedial
8 measures, to conduct engineering investigation of traffic condi-
9 tions, to plan the operation of traffic on the streets and high-
10 ways of this City, to cooperate with other City Officials in the
11 development of ways and means to improve traffic conditions and
12 to carry out the additional powers and duties imposed by Ordi-
13 nances of this City.
14 SECTION 7: The Traffic Engineer shall place and maintain
15 traffic control signs, signals, and devices when, as deemed
16 necessary, to make effective the provisions of this Ordinance and
17 to make effective the provisions pertaining to the purpose and
18 intent of this Ordinance and may place and maintain such addi-
19 tional traffic control devices as he may deem necessary to regu-
20 late traffic pursuant to this Ordinance or under State law or to
21 guide or warn traffic.
22 SECTION 8: All traffic control signs, signals and devices
23 shall conform to the specifications approved by the State of
24 California. All signs and signals required hereunder for a
25 particular purpose shall, so far as practicable, be uniform as to
26 type and location throughout the City. All traffic control
27 devices so erected and not inconsistent with the provisions of
28 State law or this Ordinance shall be official control devices.
29 SECTION 9: The Traffic Engineer is hereby authorized to
30 establ~s~ t~e f9llowing:
31 (a) To designate and maintain by appropriate devices,
32 marks, or l~nes upon the service of the roadway, crosswalks at

.1 intersections where in his opinion there is particular need
2 to regulate pedestrians crossing the roadway, and at such other
3 places as he may deem necessary.
4 (b) To establish safety zones of such kind and character
5 and at such places as he may deem necessary for the protection
6 of pedestrians.
7 (c) To mark traffic lanes upon the roadway of any street
8 or highway where alignment of traffic is necessary.
9 (d) To regulate the timing of traffic signals so as to
10 ' permit the movement of traffic in an orderly and safe manner at
11 speeds slightly at variance from speeds otherwise applicable
12 pursuant to this Ordinance or state law, and shall erect appro-
13 priate signs giving notice thereof.
14 (e) To place curb markings or post signs regulating
15 stopping, standing, or parking, utilizing such signs or coloring
16 as is set forth in the Vehicle Code of the state of California,
17 to install signs or marks restricting or limiting stopping,
18 standing, or parking, for purpose of loading or unloading, for
19 the purpose of setting forth passenger loading zones, for the
20 purpose of establishing bus zones, and for limiting the length
21 of time for which any vehicle may park within the City of
22 Vernon. The foregoing shall be complied with in the event that
23 signs have been erected limiting, restricting, or otherwise
24 defining such stopping, standing, or parking, and such signs are
25 in place giving notice thereof.
26 (f) When upon the basis of engineering and traffic
27 investigation it is determined that certain speed regulations
28 shall be applicable upon specified streets or in certain areas,
29 the Traffic Engineer shall post the maximum speed limits
30 required or allowed on such street or streets, or portion
31 thereof.
32 SECTION 10: Prior to the Traffic Engineer establishing

markings, orders, rules, or regulations as set forth in Section
9 above or in any sub-division thereof, the Traffic Engineer
shall first advise the Chief of Police of the City of Vernon of
his intention to so determine speed limits, standing, stopping,
parking, or other regulations, and his further intention to mark
curbs or post signs in accordance with such determination. Such
notice shall be given to the Chief of Police atleast seven (7)
days prior to such marking, posting, or other regulations. In
the event that the Chief of Police shall determine that such
marking, posting, or other regulation may result in difficulties
of enforcement, he shall communicate such concern to the Traffic
Engineer, in writing, and forward a copy of the same to the City
Clerk of the City of Vernon. Upon receipt of such notice, the
Traffic Engineer shall withhold any further action and the City
Clerk of the City of Vernon shall notice such communication on the
agenda for the next regular City Council meeting of the City of
Vernon. Thereupon and thereafter the City Council of the City of
Vernon shall be the final determining body to decide whether such
marking or posting or other regulation shall proceed. The City
Council of the City of Vernon may adopt, reject or conditionally
adopt or reject or modify any recommendation of the Traffic
Engineer or the Chief of Police of the City of Vernon as the
same may be presented to the City Council of the City of Vernon.
SECTION 11: In addition to the powers and duties granted
to the Traffic Engineer as set forth above, the Traffic Engineer
is authorized to place within the public street or right-of-way
the following:
(a) Markers, buttons, or signs within or adjacent to
intersections indicating the course to be traveled by vehicles
turning at such intersections.
(b) Turn signs indicating a restriction on turning right,
left, or making a U-Turn. Such signs may prohibit such turns

.1 between certain hours or any day and permit at other hours, in
2 which event the same shall be plainly indicated on the signs or
3 they may be removed when such turns are permitted.
4 (c) Signs regulating the control of pedestrians exhibit-
5 ing the words t1Walk" or "Wait" or "Don't Walk".
6 (d) Signs indicating and designating anyone-way street
7 or one-way alley. Signs indicating such direction of lawful
8 movement shall be placed at every intersection where movement of
9 traffic in the opposite direction is prohibited.
10 (e) To place and maintain a stop sign or stop signs on
11 each and every street intersecting a through street or inter-
12 secting that portion thereof where particular hazard may exist,
13 and the Traffic Engineer shall determine whether vehicles shall
14 stop at one or more entrances to any such stop intersection,
15 and shall erect a stop sign at every sich place where a stop is
16 required.
17 (f) Install or temporarily post restrictions on parking,
18 standing, stopping or the right to continue with through traffic
19 or a limitation on the otherwise posted speed limit where, in the
20 opinion of the Traffic Engineer, the same is necessary for the
21 benefit of public health, welfare, and safety because of unusual
22 occurrences, public, or private works or construction, or such
23 other factor or hazard as may require such posting.
24 SECTION 12: Whenever in this Ordinance, power, rights,
25 or duties are set forth authorizing the Traffic Engineer of the
26 City of Vernon to set speed limits, place official signs or curb
27 marking or prohibit stopping, standing, or parking, or do any
28 other act which may aggrieve any property owner or occupant of
29 property within the City of Vernon, it shall be the duty of the
30 Traffic Engineer to, insofar as is practicable, advise affected
31 property owners or occupants, being those adjacent to the street
32 or highway where such regulation will take effect, either

.1 personally, by correspondence or by posting, of the proposed
2 change or changes in existing rules and regulations. Any person
3 or persons who may be aggrieved by the proposed regulations,
4 posting of official signs or curb marking proposed by the Traffic
5 Engineer may communicate such dissat~sfaction to the City Council
6 of the City of Vernon. Upon receipt of said notice the City
7 Clerk shall place such notice upon the agenda for the next
8 regular meeting of the City Council of the City of Vernon. The
9 notice shall provide the following:
10 (a) The name and mailing address of the party protesting
11 the actions of the Traffic Engineer.
12 (b) A method of identifying the action or actions of the
13 Traffic Engineer to which the objection is filed.
14 (c) A method of identification of the area for which the
15 objection is made.
16 (d) A brief summary in non-technical language of the
17 points or contentions made by the party protesting the actions
18 of the Traffic Engineer which will be sufficient to inform any
19 interested person of the grounds for which the objection is
20 made. The City Council shall, at the next regular council
21 meeting, take under submission the objection or objections and
22 shall be the final determining body as to whether the actions
23 of the Traffic Engineer shall be approved, denied, modified or
24 investigated further. At the time and place of said regular
25 City Council meeting, any interested person or persons may be
26 heard, either supporting or objecting to the actions of the
27 Traffic Engineer.
28 SECTION 13: It shall be the duty of the Police Departmen
29 with such aid as may be rendered by other members of appropriate
30 departments of the City of Vernon, including but not limited to
31 the Traffic Engineering and Street Department, to enforce the
32 street regulations of this City, and of all of the state Vehicle

.1 laws applicable to street traffic in this City, to make arrest
2 and/or issue citations for traffic violations, to investigate
3 accidents, and to cooperate with the Traffic Engineer and other
4 officers of the City in the administration of the traffic laws
5 and in developing ways and means to improve traffic conditions,
6 and to carry out those duties specifically imposed upon said
7 Police Department, and such other departments of the City as may
8 be appropriate, by this Ordinance and any other Ordinance of the
9 City of Vernon.
10 SECTION 14: It shall be the duty of the officers of the
11 Police Department or such officers as are assigned by the Chief
12 of Police to enforce all street traffic laws of this City, and al
13 of the State Vehicle laws applicable to street traffic in the
14 City of Vernon. Officers of the Police Department or such
15 officers as are assigned by the Chief of Police are hereby
16 authorized to direct all traffic by voice or signal in con-
17 formance with traffic laws, provided that, in the event of a
18 fire or other emergency, or to expedite traffic or to safeguard
19 pedestrians, officers of the Police Department may direct traffic
20 as conditions may require, notwithstanding the provisions of this
21 Ordinance or other traffic laws.
22 SECTION 15: The driverof any vehicle, and all pedestrian
23 shall obey the instructions of any official control device
24 applicable thereto, placed in accordance with this Ordinance
25 unless otherwise directed by a police officer.
26 SECTION 16: No person shall stop, park or leave standing
27 any vehicle whether attended or unattended, except when necessary
28 to avoid conflict with other traffic or in compliance with the
29 direction of a police officer or official traffic control device,
30 in any of the following places:
31 (a) At any curb along any street in the City of Vernon
32 where the same has been painted red.

.1 (b) Where signs have been erected giving notice of no
2 parking and/or no standing.
3 SECTION 17: No person shall stop, park or leave standing
4 any vehicle whether attended or unattended, except when necessary
5 to avoid conflict with other traffic or in compliance with the
6 direction of a police officer or official traffic control device,
7 for a period of time longer than specified, in any of the follow-
8 ing places:
9 (a) At any curb painted yellow for not longer than
10 thirty (30) minutes for the purpose of loading or unloading
11 materials.
12 (b) At any curb painted white for not more than five (5)
13 minutes while in the process of loading or unloading passengers.
14 (c) At any curb painted green for a period of time not
15 longer than that specified by the time limitation stenceled on
16 the curb.
17 (d) At any location where official signs have been
18 erected giving notice of loading and/or unloading only, the
19 maximum time permitted for such loading and/or unloading shall be
20 thirty (30) minutes.
21 (e) At any location where official signs have been erect
22 ed giving notice of any specified time limitations.
23 SECTION 18: By authority of Section 22652 of the
24 Vehicle Code of the State of California, any police officer, as
25 defined in Section 22651 of said Code, may remove or cause to
26 be removed a vehicle parked on any public street, highway or
27 alley in the City of Vernon, when:
28 (a) Said vehicle is parked or left standing thereon
29 for seventy-two (72) or more consecutive hours.
30 (b) When a vehicle is illegally parked in violation of
31 I an ordinance of this City forbidding standing or parking and the
32 use of the street, highway or alley or a portion thereof is

.1 necessary for the cleaning, repair or construction of the street,
2 highway or alley or for the installation of underground utilities,
3 and signs giving notice that such vehicle may be removed are
4 erected or placed at least twenty-four (24) hours prior to the
5 removal.
6 (c) Where the use of the street, highway or alley or any
7 portion thereof is authorized for a purpose other than the normal
8 flow of traffic; or for the movement of equipment, articles or
9 structures of unusual size; and the parking of such vehicle
10 would prohibit or interfere with such use or movement and signs
11 giving notice that such vehicle may be removed, are erected or
12 placed at least twenty-four (24) hours prior to the removal.
13 (d) Where any vehicle is parked or left standing in
14 violation of any resolution or ordinance passed by the City of
15 Vernon prohibiting such parking and have authorized the removal by
16 ordinance and signs have been erected or posted at least twenty-
17 four (24) hours prior to the removal.
18 SECTION 19: Whenever an officer removes a vehicle
19 pursuant to the authority granted in Section 18 above and who
20 knows or is able to ascertain from the vehicle registration or the
21 records of the Department of Motor Vehicles, the name and address
22 of the registered owner of said vehicle, such officer shall
23 immediately give or cause to be given notice to said owner of the
24 fact of such removal, the reasons therefor, and the place to which
25 such vehicle has been removed. In the event that any such vehicle
26 is stored in a public garage, a copy of such notice shall be given
27 to the proprietor of such garage.
28 SECTION 20: The violation for failure to comply with
29 the markings or signs as set forth in this Ordinance shall con-
30 stitute a traffic infraction. Any person, firm or corporation
31 violating any of the provisions of this Ordinance shall be deemed
32 guilty of a traffic infraction, and upon conviction thereof shall

.1 be punished upon a first conviction by a fine not exceeding fifty
2 dollars ($50.00), and for a second conviction within a period of
3 one (1) year by a fine of not exceeding one hundred dollars
4 ($100.00), and for a third or any subsequent conviction within
5 a period of one (1) year by a fine of not exceeding two hundred
6 fifty dollars ($250.00).

SECTION 21: There being no newspaper of general circula-
8 tion printed, published and circulated in the City of Vernon, the
9 City Clerk is hereby directed to certify to the passage of this
10 Ordinance and shall post the same, or cause the, same to be posted,
11 in three of the most public places in said City, to wit: The
12 northwest corner of 38th Street and Santa Fe Avenue, the northeast
13 corner of Leonis Boulevard and Pacific Boulevard, and on the
14 bulletin board in the lobby of the City Hall of said city, located
15 at 4305 Santa Fe Avenue, all in the City of Vernon, Los Angeles
16 County, California. That this Ordinance shall be in full force
17 and effect thirty (30) days from and after the final adoption of
18 this Ordinance.
