2 .AN ORDINANCE OF THE CITY OF V,ERNON RJ~GULATING TH:E DESIGN, CON-
STRUCTION, INSTALLATION, QUALITY OF' MATERIALS, LOCATION, OPERATION,
3 AND MAINTENANCE OF HEATING, VENTILATING, COMFORT COOLING, REFRIGERA
TION SYSTEMS, INCINERATORS, AND MISCELLANEOUS HEAT-PRODUCING
4 APPLICANCES, ON PREMISES WITHIN THE CITY OF VERNON, AND ADOPTING
BY REFERENCE THE UNIFORM BUILDING CODE, VOLUMEn, UNIFORM MECHANI-
5 CAL CODE, 1970 EDITION.
6 THE CITY COUNCIL OF THE CITY OF' VERNON DOES ORDAIN AS FOLLOWS:

SECTION 1: The Uniform Building Code - Volume II -
8 Uniform Mechanical Code - 1970 edition, published jointly by the
9 International Association of Plumbing and Mechanical Officials,
10 and the International Conference of Building Officials, except as
11 may be amended by Ordinance is hereby adopted as the Mechanical
12 Code of the City of vernon, and may be cited as such.

SECTION 2: Said Uniform Mechanical Code shall be
14 amended and added thereto as follows:
15 Section l05 shall be amended by substituting the word
16 "may" for "shall" in the first line of the third paragraph.

Section 202 is amended by deleting the second para-
graph.
Section 203 shall be deleted in its entirety and the
following shall be substituted therefor:
"Section 203. Whenever the Building Official shall
find upon the basis of reliable evidence, information or
opinion placed before him that the public health, safety,
and welfare will not be adversely affected or, in the alter-
native, will be well served thereby, he may, in his discre-
tion and subject to such conditions and limitations as he
may see fit to impose, relieve an applicant for a mechanical
permit from one or more of the requirements of this Code,
and, without limiting the foregoing, may authorize the

substitution of materials, types of construction, and safety
equipment or devices. All requests seeking the allowance
32 of a variance or exception from the requirements of this

Code shall be presented to the Chief of the Fire Department
for recommendations for allowance or rejection and for the
terms, conditions, and limitations, if any, which said Fire
Chief recommend be imposed upon such permit, if granted.
The Building Official shall, prior to his making his findings,
solicit and include therein the recommendations of other
departments of the City, which may be affected by the
request for a variance or exception from the requirements of
this Code.
"Any applicant for a building permit seeking a variance
or exception from the requirements of this Code, which
variance or exception has been denied or granted subject to
conditions or limitations, pursuant to the foregoing pro-
visions of this Section, may request a hearing before the
City Council for the purpose of obtaining a new or different
decision with respect to said request for a variance or
exception. Such request for a hearing must state the
following:
"1. The name and mailing address of the applicant
for the purposes of the requested hearing.
"2. A method of identification of the application or
applications involved, and the previous decision of the
Building Official or of the City Council, if any, with
respect to each such application.
tt3. The specific ruling which the applicant requests
be made by the City Council with respect to each such
application.
"4. A brief summary in non-technical language of the
points or contentions to be made by applicant at the re-
quested hearing, which summary shall be sufficient to inform
any interested person who may wish to meet or refute
applicant's presentation at the hearing.
"The City Council shall set a time and place for a
hearing on such application, provided it shall comply with
the foregoing requirements, which hearing shall take place
not more than thirty days after receipt of the applicant's
request. In the event that the request for hearing does

.1 not comply with the foregoing requirements, no hearing shall
2 be set and the City Clerk shall advise the applicant of the
3 City Council's findings and that no hearing shall be set
4 until such requirements are met. Such latter notice shall
5 be mailed by the City Clerk to the applicant by United states
6 mail, postage prepaid, to the address shown on the request
7 for hearing, and if no adequate address is shown thereon,
8 the City Clerk shall make a reasonable effort to locate

an address for the applicant, to which the notice may be
10 mailed, and failing to find such address, no notice shall
11 be sent.1t
12 Section 30l shall be amended by adding:
13 "9. Minor work specifically exempted by the Superin-
14 tendent of Building when, in his discretion, the work
15 presents a negligible hazard."
16 Section 302(c) shall be amended by deleting the words
17 "upon receipt of the total fees" in the third line, and substi-
18 tuting therefor:
19 "When the fees specified in Section 304 have been paid.1t
20 Section 304 shall be deleted in its entirety and the
21 following substituted therefor:
22 1tSection 304. Any person desiring a permit required
23 by this Code shall pay a fee as set forth by resolution of
24 the City Council."
25 Section 806(a) is amended by adding subdivision 3
26 to read as follows:
27 "3. With clearance from automatic fire sprinkler
28 heads as specified in th& Uniform Building Code Standard
29 38-1."
30 Section l518(a) is amended by adding the following
31 words between "or" and Ita" in the third line: ttless than 100
32 pounds of".

2 (d) to read as follows:
"(d) Refrigerant Diffuser. Systems containing lOO
pounds or more of a Group 2 refrigerant shall be equipped
with an approved Fire Department Diffuser as specified in
the Fire Prevention Code. The discharge system shall be
designed and constructed as required by Section l518(a)
except that the discharge pipe from the emergency control
box shall connect to the Fire Department diffuser. In this
case, the emergency control box required by subsection (c)
above shall be provided with a permanent label on the out-
side cover reading: 'FOR FIRE DEPARTMENT USE ONLY', and
the name of the refrigerant in the system."
SECTION 3: If any section, sentence, clause, phrase,
15 or portion of this Ordinance is for any reason held to be invalid
16 or unconstitutional by the decision of any court of competent
17 jurisdiction, such decision shall not affect the validity of the
18 remaining portion or portions of this Ordinance.

SECTION 4- Every violation of this Ordinance is hereby
declared to be a public nuisance.
SECTION 5: Any person, firm or corporation violating
any of the provisions of this Ordinance shall be deemed guilty
of a misdemeanor, and upon conviction thereof shall be fined in
an amount not exceeding $300.00, or be imprisoned in the county
jail of the County of Los Angeles, or the city jail of the City
of Vernon, as the committing magistrate may direct, for not
28 in the discretion of the court. Each day such violation is com-

30 offense and shall be punishable as such hereunder.
SECTION 6: There being no newspaper printed, published
32 and circulated in the City of Vernon, the City Clerk is hereby

.1 directed to certify to the passage of this Ordinance and shall
2 post the same, or cause the same to be posted in three of the
3 most public places in the City of Vernon, to wit: The northwest
4 corner of 38th street and Santa Fe Avenue, the northeast corner
5 of Leonis Boulevard and Pacific Boulevard, and on the bulletin
6 board in the lobby of the City Hall of said City, located at
7 4305 Santa Fe Avenue, all in the City of Vernon, County of Los
8 Angeles, California; that this Ordinance shall be in full force

9 1 and effect thirty (30) days from and after the final passage
10 I of the same.
