1 ORDINANCE NO. 823
2 AN ORDINANCE OF THE CITY OF VERNON REGULATING THE SPEED ON
CERTAIN STREETS WITHIN THE CITY OF VERNON.

4 THE CITY COUNCIL OF THE CITY OF VERNON DOES ORDAIN AS FOLLOWS:

SECTION I: Pursuant to Government Code Section 36937, the
6 City Council hereby determines that the prima facie speed
7 limit set forth in the Vehicle Code of the State of California
8 is inappropriate on Bandini Boulevard and a portion of 37th
9 street between the Atchison, Topeka & Santa Fe harbor line
10 tracks east of Santa Fe Avenue and Atlantic Boulevard, and,
11 in fact, constitutes a danger to the general public since
12 said roadways have recently been reconstructed to present the
13 appearance of a high speed roadway.

SECTION 2: The City Council of the City of Vernon hereby
15 determines that for the immediate preservation of the public
16 peace and safety, this Ordinance should take effect immediately,
17 and the City Council of the City of Vernon does hereby declare
18 that said Ordinance shall take effect immediately.

SECTION 3: It is hereby determined, upon the basis of an
20 engineering and traffic investigation, that the speed permitted
21 by state law upon said streets is less than is necessary for
22 safe operation of vehicles thereon by reason of widely spaced
23 intersections and the width of said streets, and it is hereby
24 declared that the prima facie speed limit on said streets
25 shall be forty-five (45) miles per hour.

SECTION 4: The Traffic Engineer of the City of Vernon is
27 hereby directed to post appropriate signs giving notice of
28 said maximum speed limit and upon the posting of said signs,
29 this Ordinance shall be effective.

SECTION 5: In case any clause is for any reason held to be
31 invalid or unconstitutional, by the decision of any court of
32 competent jurisdiction, such decision shall not affect the

1 validity of the remaining portion or portions of this ordinance.
SECTION 6: Every violation of this Ordinance by propelling
a vehicle in excess of the speed limit provided for herein is
hereby declared to be a public nuisance.
SECTION 7: Any person, firm or corporation violating any
of the provisions of this Ordinance shall be deemed guilty of a
misdemeanor and upon conviction thereof, shall be fined in an
amount not exceeding five Hundred ($500.00) Dollars, or be im-
prisoned in the county jail of the County of Los Angeles or
the City jail of the City of Vernon as the committing Magistrate
may direct, for not more than six (6) months, or by both such
fine and imprisonment in the discretion of the Court.
SECTION 8: Pursuant to the findings of the City Council of
the City of Vernon, the city Clerk is hereby directed to certify
to the passage of this Ordinance, and the same shall be effective
immediately after the final passage of the same.
