ORDINANCE NO. 827
AN ORDINANCE OF THE CITY OF VERNON, ADOPTING THE CODE OF THE
CITY OF VERNON, CALIFORNIA, 1959, TOGETHER WITH SUCH AMEND~ffiNTS
AS ~AY HAVE BEEN MADE THROUGH NOVEMBER 17, 1970.
WHEREAS, the City Council of the City of Vernon finds it
necessary to codify certain existing Ordinances of the City of
Vernon, and
WHEREAS, the City Council of the City of Vernon desires
to adopt "The Code of the City of Vernon, California, 1959",
together with amendments thereto through November 17, 1970, and
WHEREAS, the City Council of the City of Vernon does not
intend to repeal Ordinances not included therein,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF VERNON
DOES ORDAIN AS FOLLOWS:
SECTION 1: There is hereby adopted by the City Council
15 of the City of Vernon that certain Code entitled "The Code of the
16 City of Vernon, California, 1959", as such Code has been amended
17 through November 17, 1970, containing certain Ordinances of a
18 general and permanent nature as compiled, consolidated, codified,
19 and indexed in Chapters 1 to 25, both inclusive, of which Code,
20 as amended, not less than three copies have been and are now
21 filed in the Office of the City Clerk of the City of Vernon, and
22 which Code is hereby referred to and adopted by reference as if
23 set forth in full in this Ordinance.

SECTION 2: Ordinances of the City of Vernon which are
26 and effect unless the same have been repealed by the adoption of
27 Ordinances codified in the Code referred to herein.

SECTION 3: Any repeal of an Ordinance provided for in
29 this Ordinance shall not affect any offense or act committed or
30 done, or any penalty or forfeiture incurred, or any contract or
31 right established before the date that this Ordinance shall be in
32 full force and effect.

1 Nor shall it affect any prosecution, suit, or proceeding
2 pending, or any judgment rendered prior to said date; nor shall
3 such repeal affect any Ordinance or Resolution promising or

guaranteeing the payment of money for the City, or authorizing
the issue of ~y bonds of the City or ~y evidence of the City's
indebtedness or any contract or obligation assumed by the City;
nor shall it affect any tax levy; nor shall it affect ~y right
8 or franchise conferred by Ordinance or Resolution of the City
9 Council on any person or corporation; nor shall it affect any
10 Ordinance adopted for purposes which have been consummated; nor
11 shall it affect any Ordinance which is temporary, although general
12 in effect, or special, although permanent in effect; nor shall it
13 affect any Ordinance relating to the salaries of the City officers
14 or employees; nor shall it affect any Ordinance annexing territory
15 to the City; nor shall it affect any Ordinance naming, renaming,
16 opening, accepting, or vacating streets or alleys in the City;
17 nor shall it affect any Ordinance relating to zoning; nor shall
18 it affect any Ordinance relating to the fixing of electrical rates
19 for distribution of electrical energy within the City of Vernon;
20 nor shall it affect any Ordinance adopted on final reading and
21 passage after November 17, 1970; nor shall it affect any of the
22 following Ordinances or amendments thereto:
23 Ordinance No. 235, relative to the Health Department;
Ordinance No. 488, relative to the light and power fund;
24 The Fire Prevention Code of the City of Vernon.

SECTION 4: Whenever in the Code adopted by this Ordinance
26 or in any other Ordinance of the City, any act is prohibited or
27 is made or declared to be unlawful or in offense, or the duty of
28 any act is required, or the failure to do any act as declared to
29 be unlawful or a misdemeanor, where no specific penalty is provide
30 therefor, the violation of any such provision of such Code, or any
31 other Ordinance of the City, shall be punished by a fine not
32 exceeding Five Hundred Dollars ($500.00), or imprisonment for a

,1 term not exceeding six (6) months, or by both such fine and
2 imprisonment. Each day such violation is committed or permitted
3 to continue shall .constitute a separate offense and shall be
4 punishable as such. Imprisonment may be in the County Jail of
5 the County of Los Angeles, or the City Jail of the City of
6 Vernon, as the committing magistrate may direct.
7 An exception to the foregoing is a violation of any of
8 the provisions set forth in Chapter 16 of the Code referred to
9 above. A violation for a failure to comply with the provisions
10 of Chapter 16 or any portion thereof shall constitute a traffic
11 infraction. Any person violating any of the provisions of said
12 Chapter shall be deemed guilty of a traffic infraction, and upon
13 conviction thereof shall be punished upon a first conviction by a
14 fine not exceeding Fifty Dollars ($50.00), and for a second
15 conviction within a period of one (1) year by a fine not exceeding
16 One Hundred Dollars ($100.00), and for a thirdor any subsequent
17 conviction within a period of one (1) year by a fine not exceeding
18 Two Hundred, Fifty Dollars ($250.00).

SECTION 5: It is hereby declared to be the intention of
20 the City Council of the City of Vernon that the sections, para-
21 graphs, sentences, clauses, and phrases of this Ordinance, and
22 the Code hereby adopted, are severable, and if any phrase, clause,
23 sentence, paragraph, or section of this Ordinance, or the Code
24 hereby adopted, shall be declared unconstitutional or otherwise
25 invalid by the valid judgment or decree of a court of competent
26 jurisdiction, such unconstitutionality or invalidity shall not
27 affect any of the remaining phrases, clauses, sentences, para-
28 graphs, or sections of this Ordinance or the Code hereby adopted.

SECTION 6: There being no newspaper printed, published,
30 or circulated in the City of Vernon, the City Clerk is hereby
31 directed to certify to the passage of this Ordinance, and shall
32 post the same or cause the same to be posted, in three of the

,1 most public places in the City of Vernon, to wit: The northwest
2 corner of 38th Street and Santa Fe Avenue; the northeast corner
3 of Leonis Boulevard and Pacific Boulevard; and on the bulletin
4 board in the lobby of the City Hall of said City, located at 4305
5 Santa Fe Avenue, all in the City of Vernon, County of Los Angeles,
6 State of California; that this Ordinance shall be in full force
7 and effect thirty (30) days from and after the date of said
8 posting.
