Ordinance No. 828 1 ORDINANCE NO" 828 2 AN ORDINANCE OF THE CITY OF VERNON, FIXING CERTAIN RATES TO BE CHARGED FOR ELECTRICAL ENERGY DISTRIBUTED AND SUPPLIED BY SAID 3 CITY OF VERNON, WITHIN ITS BOUNDARIES" 4 THE CITY COUNCIL OF THE CITY OF VEm~ON DOES ORDAIN AS FOLLOWS: 5 SECTION 1: The rates to be charged and collected and 6 the terms, provisions, and conditions respecting the distribu- 7 tion of electrical energy supplied by the City of Vernon for 8 certain classes of service rendered on and after the effective 9 date of this Ordinance, shall be those rates, terms, provisions, 10 and conditions as set forth in Southern California Edison 11 Company Advice Letter No. 360-E, dated July 6, 1971, to the 12 Public Utilities Commission of the State of California, applicable 13 to the following schedules: 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 Schedule No" A-1 Schedule Noo A-7 Schedule No" A-8 Schedule No" D-1 Schedule Noo DH Schedule Noo LS-1 Schedule Noo LS-2 Schedule No" OL-1 Schedule Noo P-1 Schedule No. PA-1 Schedule No" PA-2 Schedule No. TC-1 General Service Sheet No. 4234-E Sheet No. 4240-E Sheet No" 4241-E Sheet No. 4242-E General Service General Service - Large Domestic Service Domestic Service, Multi-family Accommodation Sheet No. 4248-E Lighting-Street and Highway Utility-Owned System Sheet Noo 4250-E Lighting-Street and Highway Customer-Owned Installation Sheet No" 4251-E Outdoor Area Lighting Service Sheet No. 4252-E Power-General Connected Load Basis Sheet No. 4253-E Power-Agricultural and Pumping Connected Load Basis Sheet No" 4254-E Power-Agricultural and Pumping Demand Basis Traffic Control Service Sheet No" 4255-E Sheet No" 4256-E SECTION 2: Rate Schedule No. S - Standby, Sheet No" 31 3598-E, as adopted by Ordinance No" 806, shall remain in effect" 32 Special conditions of Rate Schedule No" A-8 - General L 1 Service - Large, Sheet No. 3229-E as adopted by Ordinance No. 2 806 shall remain in effect. Special Conditions of Rate 3 Schedule No. A-7 - General Service, Sheet No. 4l71-E, Rate 4 Schedule Noo LS-2 - Lighting - Street and Highway Customer- 5 Owned Installation, Sheet No. 4183-E, and Rate Schedule No. PA-1, 6 Power-Agricultural and Pumping Connected Load Basis, Sheet No. 7 4187-E, as adopted by Ordinance No. 816, shall remain in effect. 8 SECTION 3: The rules and regulations respecting the 9 distribution of electrical energy supplied by the City of Vernon 10 shall be those rules and regulations of the Southern California 11 Edison Company applicable to electrical service in the City of 12 Vernon, as adopted by Ordinance No. 806, or any resolution 13 adopted pursuant thereto shall remain in full force and effect, 14 except Rule No.2, Description of Service, Sheet No. 4257-E, whic 15 will be in effect as of the date of enactment of this Ordinance. 16 SECTION 4: Any provision of the rules and regulations 17 of the Southern California Edison Company relating to the 18 exercise of jurisdiction by the Public Utilities Commission of 19 the State of California shall be deemed to refer to and mean the 20 City Council of the City of Vernon. 21 SECTION 5: Ordinance No. 749 of the City of Vernon is 22 hereby deemed to still remain in full force and effect, and not 23 to have been repealed by this Ordinance of the City of Vernon, 24 and the allowance or credit given pursuant to Ordinance No. 749, 25 or any resolution adopted pursuant thereto shall remain in full 26 force and effect, and shall be applicable to all the rates as 27 set forth in this Ordinance. 28 SECTION 6: Any other Ordinance or portion thereof in 29 conflict with this Ordinance is hereby repealed, excepting 30 Ordinances Nos. 749, 806, and 816, the latter t'\:vo of which are 31 partially repealed as set forth in Section 2 above. 32 2. ,1 SECTION 7: The City Clerk of the City of Vernon is 2 hereby directed to keep and maintain three (3) copies of the 3 above mentioned rate schedules and rules and regulations 4 applicable to electric service in the City of Vernon in the 5 office of the City Clerk of the City of Vernon, and make such 6 tariff schedules available on request for examination in said 7 office. 8 SECTION 8: There being no newspaper printed, published 9 or circulated in the City of Vernon, the City Clerk is hereby 10 direc'ted to certify to the passage of -this Ordinance and shall 11 post the same, or cause the same to be posted, in three (3) 12 of the most public places in the City of Vernon, to wit: The 13 northwest corner of 38th Street and Santa Fe Avenue; the 14 northeast corner of Leonis Boulevard and Pacific Boulevard; and 15 on the bulletin board in the lobby of the City Hall of said 16 City, located at 4305 Santa Fe Avenue, all in the City of Vernon, 17 County of Los Angeles, State of California; that this Ordinance 18 shall be in full force and effect thirty (30) days from and after 19 the final passage of the same. 20 21 1971. 22 23 24 25 26 27 28 29 30 31 32 ADOPTED and APPROVED this 20th day of July , ( c . --.f. /. ./1,.#" ._-/" R.J. ~Furlong,"l"iayor ."l~ ,/ i ATTE T: ')~ C~ty C er 3. 1 2 STATE OF CALIFORNIA ) ) ss. Hendricks, Consulting Electrical Engineer and, in view of the apparent lack of specific direction by the Federal Government, this letter shall constitute a preliminary opinion regarding placing into effect the above Ordinance. The President's directive, pursuant to the Economic Stabilization Act of 1970, apparently applies to Cities since the directive is directed to each individual business firm or other entity. The freezing pertains to each person engaged in the business of selling or providing commodities or services. I would believe that the sale of electricity is a service and would come under the Presidential order. Accordingly, while the Ordinance may become final, it would be my advice that the new rates not be placed in effect during the ninety day period of the Presidential order, or until such time as an interpretation is received from the Federal Government authorizing the new rates.
