Ordinance No. 834 1 ORDINANCE NO. 834 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF VERNON, AUTHORIZING AN AMENDMENT OF THE CONTRACT BETWEEN T HE CITY OF VERNON AND THE 3 BOARD OF ADMINISTRATION OF THE CALIFORNIA PUBLIC EMPLOYEES' RETIRE- MENT SYSTEM. 4 5 THE CITY COUNCIL OF THE CITY OF VERNON DOES ORDAIN AS FOLLOWS: 6 SECTION l: That an amendment to the Contract between the 7 City Council of the City of Vernon and the Board of Administration, 8 California Public Employees' Retirement System is hereby author- 9 ized, a copy of said amendment being attached hereto marked 10 Exhibit "A", and by such reference made a part hereof as though 11 herein set out in full. 12 SECTION 2: The Mayor of the City of Vernon is hereby 13 authorized, empowered, and directed to execute said amendment for 14 and on behalf of said City of Vernon. 15 SECTION 3: This Ordinance and the Amendment referred to 16 in SECTION 1 shall take effect October l, 1972. 17 SECTION 4: There being no newspaper printed, published, or 18 circulated in the City of Vernon, the City Clerk is hereby directed 19 to certify to the passage of this Ordinance and shall post the 20 same, or cause the same to be posted, in three of the most public 21 places in the City of Vernon, to wit: the northwest corner of 22 23 24 25 26 27 28 29 30 31 32 38th Street and Santa Fe Avenue; the northeast corner of Leonis Boulevard and Pacific Boulevard; and on the bulletin board in the lobby of the City Hall of said City, located at 4305 Santa Fe Avenue, all in the City of Vernon, County of Los Angeles, State of California. OF VERNON, hereinafter re- ferred to as Public Agency having entered into a contract under date of October 23, 1948, effective November 1, 1948, and as anlended effective April 1, 1956, October 1, 1960, and July 1, 1966, &"1d as provided by Chapter 170, Statutes of 1971, ,..hich provides for participation of Public Agency in sai.d System, Board. and Public Agency hereby agree as follows: A. Paragraphs 1 through 10 are hereby stricken from Baid contract as executed effective November 1, 1948, and are hereby replaced by the follovdng para- graphs numbered 1 through 10 inclusive: . 1. All words and terms used herein which are defined in the Public Employ- ees' Retirement Law shall have the meaning as defined therein unless othervTise specifically provided. lfNormal retirement agell shall mean age 60 for miscellaneous members and age 55 for local safety members. 2. Public Agency shall participate in the Public Employees' Retirement System from and after November 1, 1948, making its employees as here- inafter provided, members of said system subject to all provisions of the Public Employees' Retirement Law except such as apply only on election of a contracting agency and are not provided for herein and to all arrlendments to said Law hereafter enacted except such as by express provision thereof apply only on the election of contracting agencies. 3. Employees of Public Agency in the follovri..ng classes shall become mem- bers of said Retirement Systeln except such in each such class as are excluded by law ?r this agreement: a. Local firemen (herein referred to as local safety members); b. local'policemen (herein referred to as local safety members); c. Employees other than local firemen and local policemen (herein referred to as miscellaneous members). The follov'ling employees shall be excluded from membership in said H.etirement System: NO ADDITIONAL EXCLUSIONS ... rea ?O2-l 4. The fraction of final compensation to be provided for each year of credited prior and current service as a miscellaneous member upon retirement at normal retirement age shall be 1/50 and shall be applied as provided in Section 21251.13 of said Retirement Law. 5. The fraction of final compensation to be provided for each year of credited prior and current service as a local safety member shall be determined in accordance with Section 21252.1 of said Retirement Law. 6. Contributions for miscellaneous and local safety members shall be subject to Sections 20603 and 20602 respectively of said Retirement Law. 7. The following additional prOVlSlons of the Public Employeesl Retire- ment Law which apply only upon election of a contracting agency shall apply to the Public Agency and its employees: a. Section 21380-7 (providing for allowances for survivors of mem- bers covered under the program upon death before retirement). b. Section 21251.3 (providing for jncreases in allo\1ances payable for time commencing on April 1, 1956, to persons retired prior to April 1, 1956). c. Section 21251.6 (providing for increases in allowances payable for time co~mencing on July 1, 1966 to persons retired prior to January 1, 1962). d. Section 21264.1 and Section 21264 (providD1g upon death of a local miscellaneous and/or local safety member 1'1ho retired for servlce or disability for the continuation of one-.half the retirement allowance to certain survivors). 8. Public Agency shall contribute to said Hetirement System as follovlS: a. \^lith respect to miscellaneous members, the public agency shall contribute the follovling percentages of" monthly salaries earned as miscellaneous members of said System: (1) 0.20 percent until June 30, 2000 on account of the liability for prior servlce benefits. (2) 10.39 percent on account of the liability for current service benefits. (3) 1.39 percent on account of the liability for the 1959 Survivor program. b. vlith respect to local safety members, the public agenc:t shall contribute the follovdng percentages of monthly salaries earned as local safety members of said System: M. ,.,. 1'02-2 (1) 0.272 percent until June 30, 2000 on account of the liability for prior service benefits. (2) 12.722 percent on account of the liability for current service benefits. (3) 0.159 percent on account of the liability for the 1959 Sur- vivor program. c. A reasonable amount per annum, as fixed by Board to cover the costs of administering said System as it affects the employees of Public Agency, not including the costs of special valuations or the periodical investigations and valuation required by law, provided that said amount shall be determined on the basis of the number of employees of Public Agency who are reported as members on a payroll designated by the System covering one month of each year, or with respect to the first year of participation, on the effective date of said participation. d. A reasonable amount as fixed by the Board, payable in one install- ment as the occasions arise, to cover costs of special valuations on accolmt of employees of Public Agency, and costs of the period- ical investigation and valuation required by law. 9. Contributions required of Public Agency and its employees shall be subject to adjustment by Board on account of amendments to the Public Employees' Retirement Law, and on account of experience under the Retirement System, as determined by the periodical investigation and valuation required by said Hetirement LaYlo 10. Contributions required of Public Agency and its employees shall be paid by Public Agency to the Retirement System withLt1 thirty days after the end of the period to ...hich said contributions refer. If more or less than the correct amount of contribution is paid for any period, proper adjustment shall be w~de in connection with subsequent remttances or adjustment on account of errors in contributions re- quired of any employee way be wade by direct cash payments between the employee ~1d Board.
