Ordinance No. 835 16 17 18 19 I 2011 2111 22 23 I 24; 251 261 I 271 II I i I [ \ I I Ii ORDINANCE NO. 835 2 AN ORDINANCE OF THE CITY OF VERNON ADOPTING A UNIFORM FIRE CODE PRESCRIBING REGULATIONS GOVERNING CONDITIONS HAZARDOUS TO LIFE AND PROPERTY FROM FIRE OR EXPLOSION, AND ESTABLISHING A BUREAU OF FIRE 4 PREVENTION AND PROVIDING OFFICERS THEREFOR AND DEFINING THEIR POWERS AND DUTIES 3 5 6 7 8 9 10 11 THE CITY COUNCIL OF THE CITY OF VERNON DOES ORDAIN AS FOLLOWS: SECTION 1: ADOPTION OF UNIFORM FIRE CODE There is hereby adopted by the City of Vernon for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion, that certain Code known as the Uniform Fire Code recommended by the Western Fire Chiefs Association and the International Conference of Building 12' Officials being particularly the 1971 edition thereof and the whole 13 thereof, save and except such portions as are hereinafter deleted, 14 modified or amended by Section 4 of this Ordinance of which Code IS not less than three (3) copies have been and are now filed in the office of the Clerk of the City of Vernon and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this Ordinance shall take effect, the provision thereof shall be controlling within the limits of the City of Vernon. SECTION 2: ESTABLISHMENT AND DUTIES OF BUREAU OF FIRE PREVENTION (a) the Uniform Fire Code shall be enforced by the Bureau of Fire Prevention in the Fire Department of the City of Vernon which is hereby established and which shall be operated under the supervision of the Chief of the Fire Department. (b) The Chief of the Fire Department may detail 28 such members of the Fire Department as inspectors as shall from 29 time to time be necessary. I I I i I I l 1 2 3 The examination shall be open to members and nonmembers of the Fire Department, and appointments made after examination shall be for an indefinite term with removal only for cause. 4) 5 6 7 SECTION 3: DEFINITIONS (a) Wherever the word "jurisdiction" is used in the Uniform Fire Code, it shall be held to mean the City of Vernon. (b) Wherever the term "Corporation Counsel" is used the Uniform Fire Code, it shall be held to mean the Attorney for 8, in I 9 the City of Vernon. 10 11 12 SECTION 4: AMENDMENTS MADE IN THE UNIFORM FIRE CODE The Uniform Fire Code is amended and changed in the following respects: Sec. l.2l5 is deleted in its entirety, including I 13 14 the heading "Board of Appeals", and in lieu of said section and 15,1 ! heading there is inserted the following: "ALLOWANCE OF VARIANCE OR EXCEPTION FROM REQUIREMENTS OF CODE. Sec. l.2l5o Whenever the Fire Chief shall find upon the basis of reliable evidence, information or opinion placed before him that the public health, safety, and welfare will not be adversely affected or, in the alternative, will be well served thereby, he may, in his discretion and subject to such conditions and limita- tions as he may see fit to impose, relieve an owner or lessee from one or more of the requirements of this Code, and, without limi- ting the foregoing, may authorize the substitution of materials, types of construction and safety equipment or deviceso All requests seeking the allowance of a variance or exception from the requirements of this Code shall be presented to the Superintendent of Building for recommendations and to the Director of Public Works for his recommendations regarding frontage requirements, if the same be applicable, for allowance or rejection and for the terms, conditions, and limitations, if any, which said Superinten- dent of Building and said Director of Public Works recommend be -2- 1 imposed upon owner or lessee, if granted. The Fire Chief shall, 2 prior to his making his findings, solicit and include therein the 3 recommendations of other departments of the City, which may be 4 affected by the request for a variance of exception from the 5 requirements of this Code. 6 Any owner, occupant or lessee seeking a variance or excep- 7 tion fromthe requirements of this Code, which variance or excep- 8 tion has been denied or granted subject to conditions or ltmita- 9 tions, pursuant to the foregoing provisions of this Section 10 1.2l5, may request a hearing before the City Council for the 11 purpose of obtaining a new or different decision with respect to 12 said request for a variance or exception. Such request for a 13 hearing must state the following: 14 l. The name and mailing address of the applicant for the 15 purposes of the requested hearing. 16 2. A method of identification of the application or appli- 17 cations involved and the previous decision of the Fire Chief 18 or of the City Council, if any, with respect to each such 19 application. 20 3. The specific ruling which the applicant requests be made 21 by the City Council with respect to each such application. 22 4. A brief summary in non-technical language of the points 23 or contentions to be made by applicant at the requested 24 hearing, which summary shall be sufficient to inform any 25 interested person who may wish to meet or refute applicant's 26 presentation at the hearing. 27 The City COWlcil shall set a time and p lace for a hearing on '28 such application, providing it shall comply with the foregoing 29 requirements, which hearing shall take place not more than 30 thirty (30) days after receipt of the applicant's request. In 31 the event that the request for hearing does not comply with the 32 foregoing requirements, no hearing shall be set and the City -3- II 1 2 3 4 :.1 7 8 9 Clerk shall advise the applicant of the City Council's findings and that no hearing shall be set until such requirements are met. Such latter notice shall be mailed by the City Clerk to the app cant by United States mail, postage prepaid, to the address shown on the request for hearing, and if no adequate address is shown thereon, the City CleIk shall make a reasonable effort to locate an address for the applicant, to which the notice may be mailed and, failing to find such address, no notice shall be sent." SECTION 7: ~PEAL OF CONFLICTING ORDINANCES All former ordinances or parts thereof conflicting or incon- sistent with the provisions of this Ordinance or of the Code adopted herein are hereby repealed. SECTION 8: VALIDITY It is hereby declared to be the intention of the City Council of the City of Vernon that the sections, paragraphs, sentences, clauses and phrases of this Ordinance and the Code hereby adopted are severable and if any phrase, clause, sentence, paragraph or section of this Ordinance, or the Code hereby adopted, shall be declared unconstitutional or otherwise invalid by the valid judgment or decree of a court of competent jurisdiction) such unconstitutionality or invalidity shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this Ordinance or the Code hereby adopted. SECTION 9: POSTING OF ORDINANCE There being no newspaper printed, published or circulated in the City of Vernon, the City Clerk of the City of Vernon is hereby directed to certify to the passage of this Ordinance and shall post the same or cause the same to be posted, in three of the most public places in the City of Vernon) to wit: the northwest corner of 38th Street and Santa Fe Avenue; the northeast corner of Leonis Boulevard and Pacific Boulevard; and on the bulletin board in the lobby of the City Hall of said City located at 4305 Santa Fe Avenue, all in the City of Vernon, County of Los Angeles, State of California; that this Ordinance shall be in full force and effect thirty (30) days from and after the final passage of the same.
