Ordinance No. 845 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 1 2 3 4 5 6 7 8 ORDINANCE NO. 845 AN ORDINANCE OF THE CITY OF VERNON REGULATING THE DESIGN, CON- STRUCTION, INSTALLATION, QUALITY OF MATERIALS, LOCATION, OPERATION AND MAINTENANCE OF HEATING, VENTILATING, COMFORT COOLING, REFRIGE- RATION SYSTEMS, INCINERATORS, AND MISCELLANEOUS HEAT-PRODUCING APPLIANCES, ON PREMISES WITHIN THE CITY OF VERNON, AND ADOPTING THE UNIFORM BUILDING CODE, VOLUME II, UNIFORM MECHANICAL CODE, 1973 EDITION. THE CITY COUNCIL OF THE CITY OF VERNON DOES ORDAIN AS FOLLOWS: SECTION 1: The Uniform Building Code - Volume II - Uniform Mechanical Code - 1973 Edition, published jointly by the International Association of Plumbing and Mechanical Officials, and the International Conference of Building Officials, except as may be amended by Ordinance is hereby adopted as the Mechanical Code of the City of Vernon and may be cited as such. SECTION 2: Said Uniform Mechanical Code shall be 9 amended and added thereto as follows: Section 202 is amended by deleting the second paragraph. Section 203 shall be deleted in its entirety and the following shall be substituted therefor: "Section 203. Whenever the Building Official shall find upon the basis of reliable evidence, information or opinion placed before him that the public health, safety and welfare will not be adversely affected or, in the alternative, will be well served thereby he may, in his discretion and subject to such conditions and limitations as he may see fit to impose, relieve an applicant for a mechanical permit from one or more of the requirements of this Code and, without limiting the foregoing, may authorize the substitution of materials, types of construction, and safety equipment or devices. All requests seeking the allowance of a variance or exception from the requirements of this Code shall be presented to the Chief of the Fire Department for recommendations for allowance or rejection and for the terms, conditions, and limitations, if any, which said Fire Chief recommend be imposed upon such permit, if granted. The Building Official shall, prior -1- 1 to his making his findings, solicit and include therein the 2 recommendations of other departments of the City which may be af- 3 fected by the request for a variance or exception from the nequire- 4 ments of this Code. 5 Any applicant for a building permit seeking a variance 6 or exception from the requirements of this Code, which variance or 7 exception has been denied or granted subject to conditions or 8 limitations, pursuant to the foregoing provisions of this Section, 9 may request a hearing before the City Council for the purpose of 10 obtaining a new or different decision with respect to said request 11 for a variance or exception. Such request for a hearing must state 12 the following: 13 1. The name and mailing address of the applicant for 14 the purposes of the requested hearing. 15 2. A method of identification of the application or 16 applications involved, and the previous decision of the Building 17 Official or of the City Council, if any, with respect to each such 18 application. 19 3. The specific ruling which the applicant requests be 20 made by the City Council with respect to each such application. 21 4. A brief summary in non-technical language of the 22 points or contentions to be made by applicant at the requested 23 hearing, which summary shall be sufficient to infonn any interested 24 person who may wish to meet or refute applicant's presentation at 25 the hearing. 26 The City Council shall set a time and place for a 27 hearing on such application, provided it shall comply with the 28 foregoing requirements, which hearing shall take place not more 29 than thirty (30) days after receipt of the applicant's request. 30 In the event that the request for hearing does not comply with the 31 foregoing requirements, no hearing shall be set and the City Clerk 32 shall advise the applicant of the City Council's findings and that -2- 1 no hearing shall be set until such requirements are met. Such 2 latter notice shall be mailed by the City Clerk to the applicant 3 by United States mail, postage prepaid, to the address shown on 4 the request for hearing and if no adequate address is shown there- 5 on, the City Clerk shall make a reasonable effort to locate an 6 address for the applicant, to which the notice may be mailed, and 7 failing to find such address, no notice shall be sent. 8 Section 302(c) shall be amended by deleting the words 9 lIupon receipt of the total fees" in the third line, and substi- 10 tuting therefor: "when the fees specified in Section 304 have 11 been paido" 12 Section 303(b) is amended by striking out the number 13 "60" in line 4 and inserting the number "120". 14 Section 304 shall be deleted in its entirety and the 15 following substituted therefor: 16 "Section 304. Any person desiring a permit required 17 by this Code shall pay a fee as set forth by resolution of the 18 City Council." 19 Section 806(a) is amended by adding subdivision 3 to 20 read as follows: 21 "3. With clearance from automatic fire sprinkler heads 22 as specified in the Uniform Building Code Standard 38-1." 23 Section l5l8(a) is amended by adding the following 24 words between "or" and "au in the second line: "less than 100 25 pounds ofJl. 26 Section 1518 is amended by adding a new subsection (d) 27 to read as follows: 28 "(d) Refrigerant Diffuser Systems containing 100 29 pounds or more of a Group 2 refrigerant shall be equipped with 30 an approved Fire Department Diffuser as specified in the Fire 31 Prevention Code. The discharge system shall be designed and 32 constructed as required by Section l5l8(a) except that the -3- 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 1 2 discharge pipe from the emergency control box shall connect to the Fire Department diffuser. In this case, the emergency control 3 box required by subsection (c) above shall be provided with a 4 permanent label on the outside cover reading: "FOR FIRE DEPARTMENT 5 USE ONLY", and the name of the refrigerant in the system. 6 SECTION 3: If any section, sentence, clause, phrase or portion of this Ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent juris- diction, such decision shall not affect the validity of the remaining portion or portions of this Ordinance. SECTION 4: Every violation of this Ordinance is hereby declared to be a public nuisance. SECTION 5: Any person, firm or corporation violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined in an amount not exceeding Three Hundred Dollars ($300.00), or be im- prisoned in the county jail of the County of Los Angeles, or the city jail of the City of Vernon, as the committing magistrate may direct, for not more than ninety (90) days, or by both such fine and imprisonment, in the discretion of the court. Each day such violation is committed, or permitted to continue, shall consti- tute a separate offense and shall be punishable as such hereunder. SECTION 6: There being no newspaper printed, published and circulated in the City of Vernon, the City Clerk is hereby directed to certify to the passage of this Ordinance and shall post the same, or cause the same to be posted in three (3) of the most public places in the City of Vernon, to wit: the northwest corner of 38th Street and Santa Fe Avenue, the north- east corner of Leonis Boulevard and Pacific Boulevard, and on the bulletin board in the lobby of the City Hall of said City, located at 4305 Santa Fe Avenue, all in the City of Vernon, County of Los Angeles, California; that this Ordinance shall be -4- 1 in full force and effect April 15, 1974. 2 3 4 5 6 7 8 9 ADOPTED AND APPROVED this 5th day of March , 1974 J A~ ..
